Usually, you cannot simply keep a valuable object found on a beach. The result depends on the country, the land manager, the object’s age and significance, whether it came from a wreck, and whether you had permission to search. In England and Wales, an object that legally qualifies as treasure must be reported within 14 days; ownership does not automatically pass to the finder. UK wreck material has a separate reporting route. In a US national park, you must leave an artifact where you found it.
The short answer depends on five facts
“Treasure” is not a universal legal category. Before deciding whether you may take, keep, sell or remove anything, establish:
| Question | Why it matters |
|---|---|
| Where is the beach? | England and Wales, Scotland, Northern Ireland, the United States and other countries use different laws. |
| Who manages the land? | A national park, private owner, local authority or foreshore owner may impose separate access and collecting conditions. |
| What is the object? | Potential treasure, ordinary lost property, an archaeological object and wreck material follow different procedures. |
| Where exactly was it found? | Foreshore, dry sand, seabed, protected land and private land can have different rules. |
| How did you search? | Permission, good faith, digging and concealment can affect both legality and any reward. |
A valuable-looking item is not automatically legal treasure, and a beach location does not create a general “finders keepers” right.

The Treasure Act process described here applies to England and Wales. The Treasure Act 1996 can apply to a qualifying object found on the foreshore just as it can to one found inland. The fact that an item was lost rather than deliberately buried does not by itself take it outside the rules.

The 200-year and significance tests
The 2023 Treasure Act Code of Practice includes certain metal-containing objects at least 200 years old when they also meet the required historical, archaeological or cultural-significance threshold. The statutory definition is technical: material, age, composition, association with other objects and significance can all matter. You do not have to make the final legal classification yourself.
If you cannot tell whether an object qualifies, treat it as a potential treasure find and ask your local Finds Liaison Officer. Do not clean it aggressively, separate associated pieces or sell it while classification is unresolved.
Report within 14 days
GOV.UK’s reporting guidance requires a potential treasure find to be reported to the local Finds Liaison Officer within 14 days of either finding it or realising that it might be treasure. The official wording is: “You must report treasure to your local Finds Liaison Officer within either: 14 days of first finding it; 14 days of realising an item might be treasure, even if you’ve had it for longer.”

What to do immediately after finding a possible treasure object
- Stop disturbing the site. Recover the object only as far as is safe and lawful. Do not widen a hole, excavate around it or remove nearby material to search for associated items.
- Record its context. Photograph the object in place if possible, note the date and time, use a phone map to record the location, and write down whether it was in dry sand, the foreshore, a cliff, a stream outlet or another feature. Keep notes about depth, orientation and nearby objects.
- Protect the object without altering it. Place it in a clean, stable container; avoid polishing, scraping, chemical cleaners and unnecessary handling. Keep any fragments or associated material together.
- Check the land manager and permission. Identify who controls the beach and whether your detecting or collecting was authorised. Keep written permission, club instructions or a permit if you have one.
- Contact the local Finds Liaison Officer. Report within the applicable 14-day period and provide the location, photographs, circumstances and your contact details. Follow instructions about delivery, packaging and temporary storage.
- Do not transfer the item. Do not post it for sale, export it, give it away or send it to an informal expert before the official process determines what it is.
A Finds Liaison Officer or museum curator will discuss how and where the object was found and prepare a report. If a museum wishes to acquire an item classified as treasure, it is valued through the official process.
Who owns treasure in England and Wales?
Treasure does not automatically become the finder’s property. Under the Treasure Act 1996, it vests in a franchisee if one exists and otherwise in the Crown, subject to prior interests and rights. That ownership rule applies regardless of whether the object was found on a beach, farmland or another place.
What happens if it is not treasure?
If the official assessment concludes that an object is not treasure, or if no museum wants to acquire it, GOV.UK says it may be returned to the finder. The landowner and site occupier are informed and have an opportunity to object. Return is therefore not an automatic entitlement at the moment of discovery.

Reward is separate from possession
An eligible finder may receive a reward when a museum acquires treasure, but eligibility is assessed separately from immediate possession. Permission to search and acting in good faith are important factors. Trespassing, concealing a find, failing to report it or damaging the archaeological context can reduce or remove reward eligibility. Never assume that a reward will equal the object’s retail or sentimental value.

Foreshore detecting and beach permission
The Crown Estate says formal Crown Estate consent is not required for metal detecting on its foreshore, subject to its terms and any third-party rights. Its policy is available at Metal detecting and drone flying. That statement is not a blanket licence for every beach: a local authority, harbour authority, conservation body, private owner or protected-site manager may impose additional restrictions.
The same policy requires compliance with the Treasure Act and warns that wreck found on the seabed may legally belong to another party. Check the exact boundary, ownership and local notices before using a detector, digging or removing an object. A permit to access a beach is not necessarily permission to detect, excavate or collect.
Possible wreck material follows a different route
An old object washed up by the sea may be wreck rather than Treasure Act treasure. UK wreck and salvage rules apply to recovered wreck material from UK territorial waters, or material brought into those waters. The GOV.UK wreck and salvage guidance requires reporting to the Receiver of Wreck.

Owners have one year after the Receiver receives the report form to come forward and prove ownership. The official Code of Practice distinguishes an object that is wreck for Merchant Shipping Act purposes from Treasure Act treasure. Do not assume that beaching makes a wreck item abandoned or yours.

Clues that warrant treating an object as possible wreck
- It appears to be part of a ship, cargo, fitting, anchor, cannon, navigation instrument or container.
- It is associated with timbers, ballast, a dispersed cargo or a known wreck site.
- It is heavily corroded, encrusted or found among material recently exposed from the seabed.
- Its age, provenance or location cannot be established from the object alone.
Photograph the context, avoid cleaning and contact the Receiver of Wreck for instructions instead of listing the item online.
United States: national parks prohibit taking artifacts
The National Park Service gives a clear rule for its protected units: if you find an artifact, leave it where it is. Its What If I Find an Artifact? guidance says visitors may not dig, collect artifacts or use metal detectors in national park units.
This is a rule for National Park Service land, not a universal rule for every US beach. Beaches may be managed by a state park, federal agency, municipality, tribal government or private owner, each with different regulations. Identify the actual land manager and check federal, state, local and private-property rules before searching or removing anything. If you are already in a national park and find an object, note its location, photograph it without moving it and notify a ranger.
Scotland, Northern Ireland and beaches elsewhere
England-and-Wales instructions should not be exported to other UK jurisdictions. GOV.UK’s step-by-step reporting guidance states that Scotland and Northern Ireland have different rules for historic or valuable finds. The 14-day Treasure Act procedure described above is therefore not a substitute for advice from the relevant local heritage authority or museum service.

Other countries can assign ownership to the state, a landowner, the finder, a wreck authority or a combination of them. Before removing, keeping, selling or exporting an uncertain find, identify the country, coastal jurisdiction and land manager, then obtain current instructions from that authority. A tourist’s assumption that a rule from home applies abroad is particularly risky because export and archaeological-protection laws may add penalties.
Common beach-finding mistakes and the safer alternative
| Mistake | Why it is risky | Safer action |
|---|---|---|
| “It is on a beach, so it is free to keep.” | Beach ownership and collecting rights vary; Treasure Act and wreck rules can still apply. | Identify the land manager and object category before removing or disposing of it. |
| “It looks valuable, so I will sell it first.” | Sale can interfere with reporting, ownership claims and evidence of good faith. | Report a potential treasure or wreck item before advertising it. |
| “I will clean it to identify it.” | Polishing or chemicals can destroy evidence and reduce archaeological value. | Photograph it, keep it stable and follow official handling instructions. |
| “A detector club’s permission covers every beach.” | Permission is location-specific and may not cover protected land, private foreshore or excavation. | Confirm written permission for the exact site and activity. |
| “All old metal is Treasure Act treasure.” | The legal definition includes age, material and significance tests; wreck is handled separately. | Ask a Finds Liaison Officer or the Receiver of Wreck when classification is uncertain. |
A practical decision checklist
- England or Wales, potentially 200 years old and significant? Treat it as potential treasure and report to a Finds Liaison Officer within 14 days of discovery or of realising its possible status.
- Evidence of a shipwreck or seabed cargo? Treat it as possible wreck material and contact the Receiver of Wreck.
- US National Park Service unit? Leave the artifact where found; do not dig, collect or use a metal detector.
- Scotland, Northern Ireland or another country? Stop and obtain jurisdiction-specific heritage advice before taking further action.
- Unclear location or object type? Preserve the context, document the find and ask the responsible heritage or land-management authority rather than guessing.
What “keep” can mean legally
There are several different questions hidden in “Can I keep it?” You may be asking whether you can carry it away temporarily, possess it while an authority examines it, receive it back if it is not acquired, or obtain title to sell it. Those outcomes are not interchangeable. In England and Wales, reporting a possible treasure find is mandatory even when the eventual result may be return to you; a wreck report can lead to an owner’s claim; and a national-park artifact must remain in place.
The safest rule is simple: preserve the object and its location, establish the land manager, classify the likely legal route and report promptly. Only the competent authority’s process can tell you whether the item may ultimately be returned, rewarded or retained.
