Historical sundown towns are real and extensively documented. Whether any particular town still operates as one in 2026 is a separate question that requires recent, place-specific evidence. A historical listing, a predominantly white population, a local reputation, or a pin on an internet map cannot by itself prove that residents or visitors of color are currently excluded after dark.
The strongest current conclusion is therefore precise: the 2025 national dataset documents historical sundown-town practices, but it does not certify which places remain active today. Present-day claims must identify the conduct, date, geography, source quality, and corroboration.
What “sundown town” means
A sundown town was a place where Black people or other people of color were prevented from living in, remaining in, or sometimes traveling through the community after dark. Exclusion could be written into law or enforced through custom. The definition covers both mechanisms because a town could produce the same result without a formal ordinance.

Formal evidence can include municipal ordinances, zoning or housing rules, police directives, court records, or other official actions that restricted residence or movement by race. A document should be dated and tied to a specific jurisdiction; a rule from one neighborhood, township, or unincorporated area should not automatically be attributed to an entire county.

Informal exclusion
Informal systems relied on threats, harassment, intimidation, selective policing, violence, pressure on landlords or employers, or warnings delivered by local officials and residents. Because these practices left fewer records, a credible account normally needs corroboration from independent documents, witnesses, or contemporaneous reporting.
Historical label versus present-tense finding
Calling a place a historical sundown town describes a period for which evidence has been assembled. It does not mean that the same practice continues unchanged. A town can have a documented history, later reject the policy, change its population, or still show discriminatory conduct in a different form. Those possibilities must be investigated separately.
What the 2025 national dataset establishes
David Rigby and colleagues’ 2025 article in Scientific Data presents a national dataset of historical sundown towns linked to contemporary Census geographies. It identifies 2,248 historical places with evidence of sundown-town histories. Of those, 1,821 are outside the former Confederate South, showing that the phenomenon was national rather than confined to that region.

The authors describe the database as a living document. Additional places may be identified, and classifications may be refined. The project builds on prior historical work and crowdsourced investigation; it did not collect new primary evidence for every listed place. That provenance matters when interpreting a map pin or confidence label.

How confidence labels should be read
The dataset classifies the strength of the historical evidence as Surely, Probable, Possible, or Unlikely. These categories describe confidence in the historical designation, not a town’s present-day status.

Report the label with the place and the relevant period. Do not silently turn “Probable” into “confirmed,” and do not use a historical category as a shortcut to a current accusation.
Evidence that can establish a historical sundown town
A strong historical finding usually combines several source types and ties each one to a date and geography.

- Newspaper reporting: Articles can document warnings, expulsions, arrests, violence, or public debate. Check whether the report is contemporaneous and whether other sources corroborate it.
- Police and court records: Repeated stops, arrests, prosecutions, or judicial findings can reveal how a rule operated, but a record of enforcement must be interpreted in context.
- Oral histories: First-person accounts are valuable, especially when they identify dates, locations, officials, or recurring practices. Independent records strengthen the conclusion.
- Demographic patterns: Census data can suggest an effect or a change over time, but population composition alone cannot prove why people did or did not live in a place.
- Underlying source notes: The dataset’s notes explain why a place received its confidence label. Read those notes instead of relying on a map symbol alone.
No single source type is automatically decisive. An ordinance may show a formal rule but not how long it was enforced; an oral history may describe intimidation but need corroboration; a demographic pattern may be consistent with exclusion but also with economics, migration, geography, or individual choice.

What historical evidence cannot prove about 2026
The following items are not, by themselves, proof that a town currently bars nonwhite people after dark:
- A place appearing in the historical dataset.
- A low present-day Black population or an all-white census tract.
- A local reputation for racism without dated, place-specific documentation.
- A screenshot, blog post, or internet map that omits source notes and dates.
- The absence of a visible sign or ordinance. Informal intimidation can exist without either, while a sign’s removal can indicate change without proving that discrimination ended.
- A general statement that discrimination is illegal. Law establishes rights and remedies, not the factual absence of every violation.
The national dataset links historical places to modern geographies so researchers can examine durable effects. That design should not be mistaken for a finding that each linked town is still enforcing exclusion.
How to investigate a claim that a town is active today
Use a current-status investigation that treats the historical record as context, not as a verdict.
- Define the allegation. Specify whether the claim concerns residence, overnight presence, travel, policing, harassment, violence, or access to businesses. “It is a sundown town” is too broad to test.
- Set the time window. Identify when the alleged conduct occurred. A report from 1955 cannot establish what happened in 2025, and a recent incident cannot automatically describe decades of policy.
- Set the geography. Name the city, township, neighborhood, reservation, unincorporated area, or county involved. Confirm that the source’s boundary matches the place being discussed.
- Seek recent primary material. Look for current ordinances, meeting minutes, police policies, court filings, housing complaints, civil-rights investigations, and contemporaneous local reporting. Record publication and incident dates.
- Separate policy from experience. A written rule, repeated police practice, landlord refusal, threats, and isolated misconduct are different claims. Describe the mechanism rather than treating them as interchangeable.
- Corroborate independently. Compare witness accounts with records, and distinguish firsthand testimony from repetition of an online story. Note contradictions instead of smoothing them away.
- Check for change. Look for evidence of repeal, institutional reform, demographic change, public apologies, settlements, or continuing incidents after 1968. The comparison must include both the historical practice and what happened afterward.
- State a bounded conclusion. Say what the evidence supports, for which period and geography, and what remains unproven. “Documented historical practice; current activity not established” is a valid result.
Can a town be a sundown town without a sign or ordinance?
Yes, in principle. The definition includes conventional practices such as threats, harassment, intimidation, and selective enforcement. A community could pressure residents or visitors to leave without publishing a racial rule. Conversely, the lack of a sign or ordinance does not establish that informal exclusion occurred. A present-day claim still needs recent testimony or records tied to identifiable conduct.

When evaluating an informal claim, ask who acted, what was said or done, when and where it happened, whether the conduct was repeated, and whether independent evidence confirms it. Anonymous warnings and unsourced anecdotes may justify further inquiry but are not conclusive proof.
Are all-white towns automatically sundown towns?
No. Population composition is not a mechanism of exclusion. A town may be demographically homogeneous for many reasons, including migration history, housing costs, geography, employment patterns, age structure, or individual preference. To classify it as a sundown town, investigators need evidence that racial exclusion caused or sustained the absence of residents or visitors, and they must identify the period and actors involved.
The same caution applies in reverse: a town with Black residents is not automatically free of discriminatory treatment. Demographics can coexist with harassment, unequal policing, housing discrimination, or barriers to newcomers. Current conduct has to be documented directly.

What the law says about present-day exclusion
The U.S. Department of Housing and Urban Development states that housing discrimination is illegal in nearly all housing, including private housing, public housing, and housing receiving federal funding. The Fair Housing Act prohibits discrimination because of race, color, national origin, religion, sex, familial status, or disability.

The U.S. Department of Justice Civil Rights Division enforces federal laws protecting people from discrimination based on race, color, national origin, disability status, sex, religion, familial status, and loss of other constitutional rights. Its public information includes routes for reporting discrimination, harassment, and hate crimes.
These protections matter when assessing a current allegation, but legality and prevalence are different questions. A prohibited act can still occur; proving it requires evidence of the conduct and its connection to a protected characteristic. Conversely, the existence of a legal remedy does not show that a particular town has an active sundown-town system.
How to compare two places without overstating the evidence
Use the same six axes for each place. This prevents a well-known story from receiving more certainty than a less familiar case.

A comparison can legitimately conclude that one place has stronger historical documentation while neither place has enough recent evidence for a 2026 finding.
How to read maps and online lists responsibly
Start with the map’s date, publisher, geographic unit, and legend. Determine whether a marker represents a city, a former settlement, a county centroid, or an approximate location. Then open the underlying source notes and record the confidence label. A map is an index to evidence, not evidence in itself.
Check whether the information describes a historical period or a current observation. The linked Census and American Community Survey records run from 1940 through 2020, so they can illuminate historical and demographic patterns but do not supply a 2026 incident report. If a page makes a present-tense claim without naming a date, source, and mechanism, treat it as unverified.
A practical checklist for readers and reporters
- Name the place and the exact boundary.
- Write down the alleged conduct, not just the label.
- Attach every claim to a date or date range.
- Identify whether the evidence is formal, informal, or demographic.
- Preserve the dataset confidence label and its source notes.
- Use at least one independent corroborating source for serious allegations.
- Look for evidence of repeal, reform, or later incidents.
- Do not infer intent from population statistics alone.
- Distinguish an unresolved evidence gap from evidence that no discrimination occurred.
- For a current housing, harassment, or hate-crime incident, consider the appropriate local, state, HUD, or DOJ reporting channel.
Bottom line
Sundown towns are a documented part of United States history, and the 2025 dataset identifies 2,248 historical places, most outside the former Confederate South. But a historical designation is not a current-status finding. In 2026, no authoritative national registry identified in the available sources certifies which towns are active sundown towns. A defensible present-day conclusion requires recent, place-specific evidence of exclusion or intimidation, reported with its date, geography, mechanism, source quality, and corroboration.
