There is no settled nationwide yes-or-no answer. Whether a sports prediction contract may be offered or traded can depend on its terms, the platform’s regulatory status, the state involved, and any current court orders. As of October 9, 2026, federal and state authorities are still contesting how these contracts should be treated.
What a sports prediction contract is—and why the label does not settle legality
A sports prediction market contract is a financial contract tied to the outcome of an event, often with a binary payoff. The CFTC describes event contracts generally as derivative contracts based on an underlying event. Calling a product a “prediction market” or a “contract” does not, on its own, determine whether it is lawful. The contract’s legal structure and the venue offering it matter.
The key distinction is between the federal rules that may apply to a regulated derivatives market and state gambling laws that may apply to sports wagering. The agencies and litigants disagree about how those rules interact for at least some sports contracts.
How the federal CFTC framework applies
Some event contracts may be swaps or futures
In a March 16, 2026 advance notice, the Commodity Futures Trading Commission said event contracts can fall within the Commodity Exchange Act’s definitions of swaps or futures. A prediction market offering swaps or futures to the general public must register with the CFTC as a designated contract market (DCM), which is subject to the federal Commodity Exchange Act regime. Depending on a product’s legal classification, some other event contracts may instead fall within Securities and Exchange Commission jurisdiction. Read the CFTC’s advance notice.

Registration is not blanket approval of every sports contract
The CFTC says it has authority under Commodity Exchange Act section 5c(c)(5)(C) to prohibit particular event contracts if it determines they are contrary to the public interest. That authority does not mean that every sports contract on a registered market has received a final approval, or that every such contract has been prohibited. The CFTC’s March 2026 notice sought public comment on how existing law applies to prediction markets, including contracts tied to sporting events; it was an advance notice, not a final rule.
The proposed event-contract rule was withdrawn
On February 4, 2026, the Commission withdrew its 2024 event-contract rule proposal and said it did not intend to issue final rules from that proposal. Its Federal Register notice cited state regulatory actions and litigation involving CFTC authority, federal preemption of state gambling laws, Commodity Exchange Act definitions, and the meaning of “gaming” for sports-related contracts. Staff guidance is not a court ruling
On March 12, 2026, the CFTC’s Division of Market Oversight issued an advisory reminding designated contract markets of their obligations under the Act and CFTC regulations. The Commission’s announcement says it addressed DCM Core Principle 3, product-submission requirements, and considerations specific to sports-related event contracts. This is agency staff guidance, not a final court decision resolving whether a particular contract is lawful under state law. Read the CFTC announcement.
Why state law and federal authority are in conflict
Some states have treated sports event contracts offered through prediction markets as unlawful sports betting under state gaming laws. The CFTC, in turn, has argued that federal law gives it exclusive authority over qualifying contracts on CFTC-registered markets and has challenged state enforcement efforts as preempted. Those are competing legal positions, not a settled nationwide rule.

A June 12, 2026 CFTC release reported that New Mexico had sued Kalshi in state court, alleging unlawful online sports betting, and that the CFTC had then sued New Mexico for declaratory and injunctive relief. A comment submitted by the California Nations Indian Gaming Association in the CFTC rulemaking argues that sports event contracts are prohibited gaming and cites court decisions in support. That is the submitter’s advocacy position, not a CFTC determination or a final nationwide rule. Read the comment.

What to check before trading a sports contract
- Identify the exact product. Read the contract terms and determine what event and outcome trigger its payoff; do not rely only on the platform’s marketing label.
- Verify the venue’s regulatory status. Check whether it is a CFTC-registered DCM and whether the specific contract is offered within the applicable federal framework. Registration alone does not resolve every state-law question.
- Check the law and litigation for your location. Look for the current position of your state’s gaming regulator or attorney general, and any active enforcement case, injunction, or appellate ruling that applies to the platform or contract. The available federal sources do not provide a complete, current map of every state’s rules or every operative court order.
- Distinguish a filing from a ruling. Agency statements and parties’ court filings explain their positions; they do not establish that a court has finally resolved the dispute.
What the available numbers do—and do not—show
The CFTC’s March 2026 notice says approximately 1,600 event contracts were certified for listing in 2025 across multiple subjects. That figure is not limited to sports and does not show how many sports contracts were listed, whether any particular contract was lawful in a given state, or whether state-by-state availability had been settled.
