Yes—qualifying seeds supplied for sowing are listed at a nil GST rate under HSN 1209 in the CBIC rate table. That treatment is limited by use: the same entry expressly excludes seeds intended for any purpose other than sowing. A packet of vegetable or flower seed sold for planting can therefore fall within the nil-rate entry, but a product sold as food, oilseed, processing material or for another use cannot be classified from the word “seed” alone.
The wording currently traces to Notification No. 9/2021-Central Tax (Rate), dated 30 September 2021, which took effect on 1 October 2021. The corresponding Union Territory tax notification carries the same date and effect.
What GST rate applies to seeds for sowing?
CBIC’s GST goods-and-services rate table places “Seeds, fruit and spores, of a kind used for sowing” under HSN 1209 at a nil rate. In everyday language, this is often described as GST-exempt or GST-free. More precisely, the schedule assigns a zero rate to the qualifying entry.
The classification depends on the seed being of a kind used for sowing and on the supply being intended for that use. The tariff wording is not a blanket exemption for every item marketed as a seed.

The official limitation
The explanation attached to the entry states: “This entry does not cover seeds meant for any use other than sowing.” That sentence is the key test when a product name is ambiguous. A seller or buyer should look at the product specification, declared purpose and tariff classification rather than relying only on a marketplace title or a common name.
Is HSN 1209 always nil-rated?
No. The nil-rate line is specifically for seeds, fruit and spores of a kind used for sowing. The use condition is part of the entry, not an optional description.
| Supply described in the CBIC schedule | Relevant treatment | What the description means |
|---|---|---|
| Seeds, fruit and spores of a kind used for sowing (HSN 1209) | Nil rate | Applies where the goods meet the sowing-use wording. |
| Tamarind seeds meant for any use other than sowing | 5% in the displayed table, comprising 2.5% central tax and 2.5% state or Union Territory tax | A specific example showing that a non-sowing purpose is treated separately. |
| Other seed products or uses not described by these entries | Not stated in the cited material | The result must be checked against the product’s own classification and the current schedule. |
The tamarind example is not a universal 5% rate for every seed used for a non-sowing purpose. Different goods can have different classifications and rates.
Why the intended use matters
Seeds can be sold for planting, eating, extracting oil, processing, research or other purposes. Two goods that look similar may therefore fall under different entries. HSN 1209’s wording focuses on the kind of goods and their sowing use, while the explanation removes non-sowing supplies from that entry.
Examples that can fit the sowing entry
- Vegetable seeds supplied in a packet for planting in a garden or farm.
- Flower seeds sold for cultivation.
- Other seed, fruit or spore material whose stated purpose is propagation or sowing and whose classification matches HSN 1209.
These are examples of the use question, not an automatic ruling on every variety, treatment or package. The product’s documentation still matters.

Examples that need a different analysis
- Seeds sold as food or an ingredient.
- Seeds supplied for oil extraction or industrial processing.
- Seeds intended for any other use expressly outside sowing.
- A mixed-use lot or bundle whose packaging does not identify a single sowing purpose.
The cited notifications do not resolve every variety, treated seed, mixed-use lot or bundled supply. Those cases require the full product facts and the applicable schedule to be examined.
When did the current wording take effect?
Notification No. 9/2021-Central Tax (Rate), issued by the Government of India’s Ministry of Finance, Department of Revenue on 30 September 2021, substituted the HSN 1209 entry with the wording for “Seeds, fruit and spores, of a kind used for sowing.” It states that the change came into force on 1 October 2021.
Notification No. 9/2021-Union Territory Tax (Rate), also dated 30 September 2021, provides the corresponding Union Territory tax amendment with the same effective date. For a transaction in a state, Union Territory or special jurisdiction, the applicable tax notification and current rate schedule should be checked for the relevant tax component.
Does “GST-exempt” mean the seller never charges GST?
For a supply that genuinely falls within the nil-rated HSN 1209 sowing entry, the rate shown for that entry is zero, so the invoice should not add a positive GST amount for that item. “Nil-rated” is the more precise schedule terminology; “GST-exempt” is common shorthand used by buyers.
That conclusion applies only after the goods meet the entry’s conditions. If the item is actually supplied for a non-sowing purpose or belongs to another tariff entry, applying zero merely because the product is called a seed can create a classification error.

How should a business check a seed product before invoicing?
- Describe the goods precisely. Record the species or variety, form, packaging, treatment and whether the product is a seed, fruit or spore material.
- Identify the declared purpose. Check labels, catalogue descriptions, purchase orders and customer instructions for a clear sowing or planting purpose.
- Compare the facts with HSN 1209. Confirm that the goods are of a kind used for sowing and that the supply is not meant for another use.
- Check for a more specific entry. Look for a separate schedule line covering the product or its non-sowing purpose. The CBIC table’s tamarind-seed example demonstrates why this check matters.
- Keep supporting records. Retain the product specification, packaging or customer documentation used to support the intended-use conclusion.
- Apply the result consistently. Use the same classification on quotations, invoices, returns and accounting records unless the facts change.
- Escalate uncertain cases. Obtain professional tax advice when the product is treated, mixed-use, bundled, imported, repackaged or otherwise difficult to classify.
This process does not replace a formal classification opinion. It is a practical way to identify the facts that the schedule requires.

What should appear on an invoice?
An invoice should identify the goods clearly enough that the classification and intended use can be understood. A description such as “seeds” may be too vague for a mixed catalogue. A more informative description can include the variety, pack size, HSN used by the supplier and “for sowing” when that is genuinely the documented purpose.
The seller should not add a non-zero GST amount to a qualifying nil-rated line, but should also avoid labelling every seed product as nil-rated without checking its use. If one order contains both sowing seed and goods for another purpose, each line should be assessed separately rather than applying one rate to the entire order.
What about treated, coated or bundled seeds?
The official material cited for this question does not settle how every treated or coated seed, mixed-use lot or bundle should be classified. Treatment can affect the commercial description, and a bundle can contain goods with different uses or tariff headings.
For these products, retain the technical specification and packaging information, identify what the customer is actually buying, and obtain a product-specific classification view before relying on the nil rate. A generic online listing or seller nickname is not enough evidence by itself.

How should buyers verify a marketplace or retail listing?
- Read the packet or product specification, not only the listing title.
- Look for an explicit planting, cultivation or sowing purpose.
- Check whether the seller describes the item as food, an ingredient, an oil source or processing material.
- Review the invoice’s product description and tax line.
- Ask the seller for clarification when the purpose is missing or contradictory.
The tax explanation does not endorse a particular retailer or guarantee how an individual seller has issued an invoice. If the invoice conflicts with the documented purpose, request a corrected explanation or consult a tax professional.
Are all seeds GST-free in India?
No. The CBIC entry is limited to seeds, fruit and spores of a kind used for sowing, and its explanation expressly excludes seeds meant for any other use. The schedule’s separate treatment of tamarind seeds intended for non-sowing use illustrates the boundary.
There is no single alternative GST rate that can be assigned to every non-sowing seed. The correct rate depends on the particular product and classification in the current schedule.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. What if the product’s purpose changes after purchase?
The relevant question for the supply is the documented purpose and classification of the goods being supplied. If a buyer later uses a sowing seed for another activity, that later decision does not by itself rewrite the seller’s product description; however, unusual arrangements, repacking or resale for a different purpose can create a new classification question.

Where the seller knows that goods are being supplied for a non-sowing use, the HSN 1209 nil-rate entry should not be assumed. The transaction should be reviewed on its actual facts.

How often should the rate be checked?
Tax schedules and notifications can change. The 1 October 2021 effective date explains the wording covered here, but it is not a promise that future amendments will leave the entry unchanged. Before issuing a high-value invoice, filing a return or resolving a dispute, check the current CBIC rate table and any later notification that applies to the transaction date.
Practical answers to common questions
Is a packet of vegetable or flower seeds zero-rated?
It can be, when the packet is genuinely supplied for sowing and the goods fit the HSN 1209 wording. Confirm the product description and intended use rather than relying on the category name alone.
Does HSN 1209 cover seeds sold for eating?
The cited entry says it does not cover seeds meant for any use other than sowing. Food or other non-sowing supplies therefore need their own classification and rate analysis.
Is every tamarind seed taxed at 5%?
No. The CBIC table specifically shows 5% for tamarind seeds meant for a use other than sowing. That example should not be generalized to all tamarind seeds or all other-use seeds.
Can a seller decide the rate from a marketplace title?
No. A marketplace title may omit the intended use or describe a mixed product. The specification, packaging, transaction documents and applicable tariff entry should be considered together.
What should a business do if classification remains unclear?
Collect the technical and commercial facts, compare them with the current schedule, and obtain professional tax advice before applying a nil rate or defending an invoice position.
