For a U.S. buyer, a retro handheld’s preloaded ROMs are not automatically legal merely because they came on the device. The device and the game files are separate legal questions. Copyright can cover the game program and its audiovisual, musical, and other original elements, while the seller must have rights to reproduce and distribute each title.
The answer for a particular collection depends on the games, the rights holder, how the files were obtained, the seller’s authorization, any circumvention involved, and the country whose law applies. The rules below are a U.S. federal-law baseline, not a determination about any particular listing.
What “included” tells you—and what it does not
A handheld can be lawfully sold as hardware while the files stored on its card or internal memory raise a separate copyright question. Buying the console, cartridge adapter, or microSD card does not by itself establish that the vendor was allowed to copy every game onto it or distribute those copies to customers.

A game’s executable program, artwork, music, dialogue, and other original elements can therefore be relevant to the analysis. “Preloaded” describes a delivery method, not a license. A seller could have authorization for a collection, but the presence of files on a new device is not evidence of that authorization on its own. You need information about the particular titles and the rights under which the seller supplied them.
The U.S. rules that matter
Copyright covers more than the plastic cartridge
The physical handheld and the digital files are different objects. Ownership of the hardware gives you possession of the hardware; it does not transfer the copyright in the games stored on it. A rights holder may control reproduction and distribution of protected game material even when the files are supplied on a removable card.
This distinction is why a product description promising “thousands of games” cannot, by itself, answer whether the package is authorized. The relevant evidence is title-by-title permission, a license from the rights holder, or another legally sufficient basis for the seller’s copies.

Section 117 of Title 17 contains specific rules for certain copies or adaptations of a computer program made by the owner of a copy. The Copyright Office’s statutory text states:
“Notwithstanding the provisions of section 106, it is not an infringement for the owner of a copy of a computer program to make or authorize the making of another copy or adaptation of that computer program provided:”

The conditions immediately following that sentence are decisive. The additional copy or adaptation must be either:
- An essential step in using the program with a machine, and used in no other manner; or
- Made solely for archival purposes, with all archival copies destroyed if possession of the program ceases to be rightful.
Those conditions address particular copies made by an owner of a copy. They do not create a general permission for a commercial vendor to acquire game files, bundle them with unrelated hardware, and sell the bundle. An individual’s circumstances may differ from a seller’s mass distribution activity.
Transfers under section 117 have their own limits
Section 117(b) also restricts transfers. Exact additional copies made under the section may be transferred only with the copy from which they were made and as part of transferring all rights in the program. An adaptation may be transferred only with authorization from the copyright owner. Consequently, even when a particular backup or adaptation fits section 117, that does not automatically authorize handing copies to customers or uploading them for others.

The DMCA adds an anti-circumvention question
Section 1201 of the Digital Millennium Copyright Act generally prohibits circumventing a technological measure that controls access to a copyrighted work, including games and computer software. This is a different issue from whether a copy or distribution is authorized. A person might face a copying question, a circumvention question, or both.

Section 1201 has a triennial rulemaking process for limited exemptions. The Copyright Office’s 2024 Ninth Triennial Section 1201 Proceeding explains that exemptions are specific and temporary; they are not a blanket consumer or seller license to circulate game files.

Institutional preservation exemptions are not a handheld-owner entitlement
The current regulation, 37 C.F.R. §201.40, includes narrow video-game provisions for specified circumstances. For example, eligible libraries, archives, and museums may have preservation-related permissions when the acquisition, institution, purpose, and access or distribution all satisfy the rule. The exemption is conditioned on lawful acquisition, eligible institutions, noncommercial preservation activity, and limits on access or distribution.
Those institution-specific provisions should not be presented as a general right for a private buyer to copy or share a commercial game collection. The regulation is available at 37 C.F.R. §201.40. An exemption from one anti-circumvention restriction also does not automatically resolve separate copyright rights in reproduction or distribution.
How to assess a specific retro handheld
No single label such as “open source,” “backup,” “preloaded,” or “for personal use” proves that a collection is authorized. Use the following sequence before relying on the files.
- List the actual titles. Record every game, region, language version, and included BIOS or firmware file. A vague count of “10,000 games” is not a rights statement. Identifying the titles lets you ask which rights holder controls each one.
- Look for authorization that is specific to the collection. Check whether the seller identifies a license, publishing agreement, rights-holder permission, or a catalog of legitimately licensed games. A statement that the device is legal, or that the files are for personal use, does not substitute for evidence that the seller may distribute them.
- Ask who made the files and how. Determine whether the seller supplied its own authorized files, received them from a licensed distributor, or copied them from cartridges, downloads, or an unidentified archive. The source and chain of permission matter; the fact that a file can be downloaded does not establish the right to redistribute it.
- Separate your copy from the seller’s copy. If you personally own a qualifying copy of a program, section 117 may be relevant to a specific essential-use or archival copy under its conditions. That fact does not retroactively authorize a vendor-made bundle, and it does not automatically give you the right to obtain a ROM from an unrelated source.
- Identify any access-control bypass. Note whether making or using the file requires bypassing encryption, authentication, cartridge protections, or another technological measure. Then check whether a precise section 1201 exemption covers the exact work, user, purpose, and time period. Do not assume that an exemption for preservation by an eligible institution applies to a consumer purchase.
- Locate the governing jurisdiction. The buyer’s country, the seller’s country, the location of copying or downloading, and the contract terms can all affect the analysis. The rules described here are U.S. federal provisions. They do not establish the result in Canada, the United Kingdom, the European Union, Australia, or another jurisdiction.
- Preserve the evidence. Save the product page, title list, license language, invoices, seller correspondence, and file-source information. If the amount or risk is significant, take those records to a lawyer who practices in the relevant jurisdiction rather than relying on a general internet explanation.
Common situations and the legal issue each raises

Why “I own the game” is not a complete answer
Ownership language can refer to different things: a physical cartridge, a purchased license, a copy of a program, or merely possession of a downloaded file. Section 117 uses the specific concept of an “owner of a copy” and then imposes conditions on the additional copy or adaptation. It does not say that owning a physical game gives anyone an unrestricted right to download any matching file from any source.

The file’s provenance matters. A ROM supplied by a rights holder or authorized distributor presents a different fact pattern from a ROM copied by an unknown third party and placed on a retail card. Your ownership of an original may be relevant to your own lawful-copy analysis, but it does not prove that the unrelated source had permission to make or distribute its file.
Does an emulator make the bundled ROMs legal?
No automatic rule follows from the presence of an emulator. Emulator software and game files are separate subjects. The sources establish that games and software can be copyrighted and that circumvention may be restricted; they do not classify every emulator, firmware image, BIOS file, or ROM collection.
Evaluate the game file independently: identify who supplied it, what rights they had, whether copying or distribution was authorized, and whether accessing it required bypassing a technological measure. Installing a lawful emulator does not cure an unauthorized game copy, and an emulator’s legality does not prove that the files shipped with a device were licensed.
What a careful buyer can and cannot conclude
- You can conclude: a preloaded collection needs its own authorization analysis; section 117 is conditional; section 1201 exemptions are limited; and institutional preservation rules are not a general consumer permission.
- You cannot conclude from the packaging alone: that every title is licensed, that a “personal use” notice makes distribution lawful, or that owning a matching cartridge validates a vendor’s ROM source.
- You should qualify any conclusion: identify the jurisdiction, the titles, the seller’s evidence, the source of the files, and any circumvention involved.
