Usually, yes. If one restaurant location closes but the chain or affiliated restaurant group is still operating, a paid gift card normally remains valid at participating locations. The closure can make redemption inconvenient, but it does not by itself erase the stored value.
The result changes when the card was issued only by the closed restaurant, the entire company has stopped operating, or the issuer has entered bankruptcy. The card’s terms, the locations that still participate, the card type, the state law tied to the purchase, and the issuer’s replacement or refund policy determine what you can actually do.

First, identify what actually closed
A neighborhood closure and a company-wide shutdown are legally and practically different. A card issued for an affiliated group of merchants can generally be used across that group if the terms allow it. A certificate sold by one independent restaurant may have no alternative redemption venue once that business closes.
One location closed, other locations operate
For a chain-wide card, check whether the remaining restaurants are owned by the same company, franchisees covered by the card terms, or an affiliated restaurant group. A nearby location may have a different owner and still decline the card if it is not a participating merchant. Ask before ordering rather than assuming that a familiar logo means acceptance.

The entire company closed
If the operator has liquidated, stopped answering customers, or filed bankruptcy, the card may no longer work even though its printed expiration date has not passed. The business might continue honoring cards during a transition, another company might voluntarily accept them, or neither might do so. Acceptance by a purchaser or competitor is a business decision, not an automatic federal requirement.
Check the card before you try to spend it
Gather the information that determines your options. Photograph both sides of a physical card, save the electronic card message, and record the card number, security code, balance, purchase date, terms, and receipt. Do this before the issuer’s website disappears or a card portal is taken offline.
Classify the card
| Card or certificate type | Typical redemption rule | Main risk after a closure |
|---|---|---|
| Paid card for a chain or affiliated restaurant group | Usually redeemable at participating locations identified in the terms | A remaining location may not participate, or the company may become insolvent |
| Paid certificate for one independent restaurant | Normally limited to the named business | No practical place to redeem it if that business permanently closes |
| Promotional, loyalty, award, or bonus certificate | Controlled mainly by the promotion’s conditions | May fall outside federal paid-gift-card protections, especially when no money was exchanged |
| Paper-only or otherwise excluded instrument | Depends on the issuing program and applicable state law | Expiration and fee rules can differ from ordinary retail gift cards |
Look for language such as “valid at participating locations,” “redeemable only at,” a franchise limitation, an expiration date, or a statement that the certificate is promotional. The person who bought the card may have a receipt or account record that you do not; ask that purchaser for it if possible.
Confirm the purchase jurisdiction
Federal rules provide a baseline, but state law can add protection. Keep the state where the card was purchased and the state named in the terms separate from the state where you now live or where the restaurant closed. A conflict-of-laws question can matter when an online purchase, a mailed card, and a restaurant in different states are involved.

What federal law protects
The federal gift-card provisions in the 2009 CARD Act, codified at 15 U.S.C. §1693l-1, generally protect funds on covered store gift cards for at least five years from the date of purchase or the date of the last load. The Federal Trade Commission describes the same five-year minimum for covered retail cards.
The five-year rule preserves funds, not a restaurant
An issuer generally cannot make covered funds expire earlier than five years after purchase or the last reload unless the statutory conditions are met and the terms are clearly disclosed. That rule does not require the merchant to keep a particular dining room open, maintain a payment system, or remain solvent. If the only merchant named on a card has disappeared, the legal balance may still exist while the practical redemption opportunity does not.
When inactivity fees can apply
Regulation E permits a dormancy, inactivity, or service fee only after at least one year without activity. The issuer must clearly disclose the fee amount, how often it can be charged, and the possibility of the charge. No more than one such fee may be imposed in a calendar month. A closure does not automatically authorize a fee; the card must meet the rule’s conditions and the disclosure must be adequate.

Federal coverage generally concerns store cards redeemable at a single merchant or an affiliated group of merchants. Loyalty points, awards, promotional certificates, paper instruments, and other excluded products can be treated differently, particularly when the recipient paid nothing for them. Read the specific terms instead of applying the five-year rule to every item called a “gift card.”

What to do when another location is open
Use this sequence so you obtain a clear answer and preserve evidence if the first employee is unsure.
- Check the current location list. Use the issuer’s current website, app, or telephone directory to identify open locations. A listing that says “temporarily closed” is different from a permanent closure.
- Call a nearby participating location before visiting. Give the card type, not just the restaurant name, and ask whether that location accepts cards issued by the closed site or by the wider group.
- Contact central customer service. Ask whether the card is chain-wide, which locations are authorized, and whether the balance can be transferred to a replacement card.
- Request a specific remedy. Ask for a replacement card, transfer to another location, a refund, or written instructions. Ask for the case number and the name or department handling the request.
- Test the balance safely. If a location agrees to honor the card, ask the employee to verify the balance before a full meal. Do not surrender the original card until the transaction is completed or the issuer confirms a transfer.
Keep emails, chat transcripts, call dates, and receipts. If a location says its point-of-sale system cannot process the card, ask whether that is a temporary technical problem or a policy refusal and request the policy in writing.
What to do when the restaurant or chain is bankrupt
Bankruptcy changes the question from “Has the card expired?” to “Will this insolvent estate or a successor honor it?” The FTC says a bankrupt company may continue honoring its cards, a competitor may accept them, or neither may do so. Oregon’s consumer guidance likewise warns that bankruptcy or the closure of a local store can make a card useless regardless of the printed expiration date.

Find the issuer’s announced procedure
- Search the company’s official notices, customer-service recording, and bankruptcy or restructuring announcements for a gift-card policy.
- Identify the bankruptcy court case and the claims or customer-information page, if one exists.
- Check whether the court or debtor has announced a deadline, claim form, spending limit, or requirement to use cards only at locations still operating.
- Submit a claim or other requested documentation by the stated deadline, keeping a copy and proof of delivery.
A bankruptcy claim may be treated as an unsecured consumer claim and may recover only a portion of the balance, depending on the case. Do not assume that a five-year federal protection turns the card into cash or guarantees payment from an insolvent estate.

Consider a successor or competitor offer carefully
A buyer, franchise operator, or competitor might accept old cards as a goodwill measure. Ask whether acceptance covers the entire balance, has a spending deadline, requires a replacement card, or is limited to selected locations. Obtain the offer in writing because voluntary acceptance can end or change during a transition.
How state law can change the result
State rules may be stronger than the federal baseline, but they do not necessarily keep a failed merchant open. For example, Florida law bars expiration dates and post-sale charges for covered gift certificates purchased in Florida. That can prevent an issuer from reducing the balance through an unlawful expiration or fee, while still leaving a practical collection problem if the business has closed or entered bankruptcy.
Oregon consumer guidance takes the opposite practical emphasis: it warns that a merchant’s bankruptcy or a local-store closure may render a card useless regardless of the expiration date. The two points are not contradictory. One addresses whether the stored value may legally expire; the other addresses whether a functioning merchant remains available to accept it.

Compare the likely outcome for common situations
| Situation | Likely result | Best next action |
|---|---|---|
| One chain location closed; other authorized locations remain | Usually redeemable, subject to participating-location terms | Confirm acceptance with another location or central customer service |
| Single-location restaurant permanently closed; no successor announced | No practical redemption venue may remain | Request a refund or written alternative and preserve proof of purchase |
| Company operating but card portal is offline | Balance may still exist; the outage does not prove expiration | Use telephone or written support and ask for a replacement or transfer |
| Company in bankruptcy and still serving customers | Cards may be honored temporarily, but policy can change | Use the card only after confirming current acceptance and check court notices |
| Promotional or loyalty certificate | Terms may permit different expiration or closure treatment | Read the promotion rules and ask whether money was paid for the certificate |
| Issuer refuses without citing a policy | Outcome depends on the terms and applicable state law | Request a written explanation, then contact the relevant state office |
How to handle a refusal at the restaurant
Stay specific and avoid arguing from the printed expiration date alone. Ask the employee to identify the card’s issuing entity, whether the location is an authorized participant, and whether a manager can verify the balance. If the answer is “we do not take those anymore,” ask for the current policy or customer-service contact.
Send the issuer a concise written request containing the card number’s last four digits, approximate balance, purchase date, closed location, the location that refused it, and the remedy you want. Do not publish the full card number in a public review or unsecured message. Attach a receipt or photograph with sensitive security codes redacted unless the issuer provides a secure submission method.
If the issuer never responds, or its answer conflicts with the written terms, organize your evidence chronologically: purchase proof, terms, closure notice, contact attempts, refusal, and any bankruptcy announcement. That record makes a state consumer complaint or court-supervised claim more useful than an unsupported assertion that the card “should still work.”

1Clear out junk files and repair common Windows errors2Fix the driver behind crashes, sound loss and screen glitches3Repair Windows errors before they cause bigger problemsQuestions to ask before buying or giving another restaurant card
- Is the card accepted at every location, only company-owned locations, or selected participating restaurants?
- Can a franchisee decline it?
- Is there an expiration date, and when can inactivity fees begin?
- What happens if the named location closes or the company files bankruptcy?
- Can customer service replace a lost card or transfer its balance?
- Is the card paid for, promotional, or part of a loyalty program?
Save the receipt and terms with the card rather than relying on a printed balance or a website that may later change. For a gift, tell the recipient whether the card is intended for one location or a wider group.
Bottom line for your card
If only one restaurant closed, start by treating the card as potentially valid and verify another authorized location. If the entire company closed or entered bankruptcy, act quickly: preserve the card and receipt, locate any replacement or claims procedure, and do not confuse the federal five-year rule with a guarantee that an insolvent merchant will pay. When the issuer will not provide a clear answer, the card terms and the law of the relevant purchase state are the evidence that determines your next escalation.
