U.S. traders should not assume profits from sports event contracts are tax-free just because a platform does not send a tax form. The IRS says income can be taxable even without a Form 1099-K, but that general guidance does not settle how these contracts themselves should be classified for federal tax purposes. That unresolved classification can change how gains and losses are treated.

What is clear—and what remains unsettled

The IRS’s general Form 1099-K FAQ says: “All income, no matter the amount, is taxable unless the tax law says it isn’t – even if you don’t get a Form 1099-K.” That means a missing form, a small amount, or leaving money in an account does not by itself establish that a gain is nontaxable. The FAQ is general income and reporting guidance, not an IRS ruling on sports event contracts. Read the IRS FAQ.

The harder question is what kind of transaction a particular contract represents. KPMG’s 2026 analysis discusses contracts offered by CFTC-regulated contract markets, including Kalshi and CME, while expressly not deciding whether they are derivatives or wagers. It does not establish one treatment for every platform or trader. The contract terms, venue, and taxpayer’s facts may matter. Read KPMG’s 2026 tax analysis.

Why the classification matters

Different tax frameworks can change the character and timing of income, as well as which losses may be deductible and where they belong. The possibilities below are discussed in the reviewed tax analysis; none is a universal, confirmed answer for retail sports contracts.

Section 1256 regulated-derivative treatment If a contract qualifies, Section 1256 can involve mark-to-market treatment and a 60% long-term / 40% short-term capital-gain split. Qualification for retail sports event contracts is presented as a possibility, not an IRS-approved conclusion.
Other capital-asset treatment General capital-asset principles could make holding period and capital-loss rules relevant. This is also a possible analysis, not a settled rule for all event contracts.
Wagering treatment Winnings would generally be ordinary income, and wagering-specific loss limits would apply. No reviewed IRS ruling establishes that all prediction-market sports contracts are wagers.

For the wagering scenario specifically, KPMG says the federal deduction for gambling losses is limited to 90% of those losses beginning in 2026 under the OBBBA. That limit is conditional on wagering treatment applying; it does not decide whether a sports contract is a wager. KPMG’s analysis of the conditional loss rule.

What tax forms and platform statements can tell you

As described in Kalshi’s Help Center, users who meet applicable reporting thresholds may receive a 1099-INT for interest payments, a 1099-MISC for credits or rewards, a 1099-B for broker transactions involving crypto transfers, and a 1099-DA for digital-asset transactions reported by ZeroHash. The listed 1099-B category is not a statement that sports-contract trading itself generates a 1099-B. These details are Kalshi-specific and should not be assumed to apply to other platforms or tax years. See Kalshi’s tax-documentation information.

Kalshi also describes a monthly profit-and-loss statement that includes fees and rebates, uses FIFO (first in, first out), and refreshes on the first of each month. The platform says the statement is a tool to assist members, not tax advice. A platform statement can help organize activity, but it is not necessarily a complete tax answer or a substitute for retaining the underlying trade history.

Records to keep for your return

Keep records that let you reconstruct each position and reconcile it with any information return. Save an export of the activity, rather than relying only on a dashboard view.

  • Trade date, contract name, side, and quantity
  • Entry and exit prices, settlement or sale proceeds, and contract outcome
  • Fees, rebates, credits, and rewards
  • Annual trade-history exports and any open positions at year-end if relevant to the approach used for your return
  • Every tax form or information return received from the platform

Compare platform totals with your trade-level records and investigate differences before filing. A tax service’s guide likewise identifies dates, contracts, prices, fees, and net proceeds as useful reconstruction data; that guidance is practical recordkeeping help, not an authority resolving the legal classification. See the recordkeeping discussion.

How to approach filing decisions

  1. Identify the venue and contract. Do not automatically apply analysis written for CFTC-regulated contract markets to offshore, crypto-native, or differently structured platforms.
  2. Collect the complete records. Gather trade exports, year-end position information where relevant, and all forms; reconcile them rather than treating a form as a full ledger.
  3. Resolve the classification before choosing a reporting route. The reviewed sources do not support telling every trader to use a particular IRS form or schedule.
  4. Get individualized tax advice when the amounts or loss treatment matter. A qualified tax professional can assess the contract, venue, and your circumstances. Tax software may help organize figures, but it cannot make the unsettled legal question settled.

This article concerns U.S. federal income tax. State tax rules may differ, and the reviewed sources do not resolve state-specific treatment. As of October 9, 2026, the cited analysis does not provide a universal filing instruction or an event-contract-specific IRS classification.
