There is no worldwide yes-or-no answer. Whether you can legally trade a prediction-market contract depends on where you are, what the contract is about, how it is structured, and whether its operator is authorized under the rules that apply there. The label “event contract” or “prediction market” does not settle whether regulators treat it as a derivative, a bet, or both. Here is how to check your jurisdiction and the specific contract before you fund an account.
Are prediction markets legal in your state or country?
It depends on the jurisdiction and the exact contract. A platform accessible through an app or website is not necessarily authorized to offer every contract to every customer in every location. A registration or licence in one country does not automatically grant permission elsewhere.
The examples below illustrate how different regulators approach event contracts; they are not a complete survey of the world. Rules, litigation, platform access, and contract terms can change. This is general information, not an individual legal determination.

United States: federal oversight, with state disputes continuing
The Commodity Futures Trading Commission (CFTC) tells consumers that prediction markets are federally regulated and that, under federal law, they can operate in all 50 states. That is the agency’s description of its position, not a final court ruling resolving every state-law dispute or every contract.

The legal position is contested. In February 2026, the CFTC filed an amicus brief in a Ninth Circuit case asserting exclusive jurisdiction over CFTC-registered commodity derivative markets, including prediction markets. In April 2026, it filed lawsuits challenging actions by Arizona, Connecticut, and Illinois against CFTC-registered designated contract markets. Those actions document the agency’s position and ongoing litigation; they do not establish a final nationwide resolution. Check current court status, state notices, platform restrictions, and the contract you intend to trade.
In a March 16, 2026 advance notice of proposed rulemaking, the CFTC said event contracts may fall within the Commodity Exchange Act definitions of swaps or futures, and that a market offering swaps or futures to the general public must register with the CFTC as a designated contract market. This was an advance notice seeking comment, not a final rule. The notice also describes shared CFTC and SEC jurisdiction over mixed swaps and security futures, and the SEC’s sole jurisdiction over security-based swaps; event contracts should not all be treated as one legal category.

The CFTC reported that designated contract markets certified approximately 1,600 event contracts for listing in 2025, compared with an average of approximately five annually from 2006 through 2020. These are certified listings, not trading volume, user numbers, or proof that every listing is lawful in every state.

European Union: the event question can affect classification
On July 3, 2026, the European Securities and Markets Authority (ESMA) reminded firms to assess whether event contracts fall within existing national product-intervention measures on binary options. ESMA says classification as a financial instrument depends on the event question. A contract may also qualify as a bet under a member state’s gambling law.

If an event contract qualifies as a financial instrument, ESMA says it is a derivative and, because it has a binary outcome, falls within the scope of existing national measures prohibiting the marketing, distribution, or sale of binary options to retail clients. Distribution in the EU of event contracts that qualify as financial instruments requires investment-firm authorization, including distribution only to non-retail clients. Check the competent authority and rules in your particular member state.
Great Britain: check Gambling Commission licensing
A UK Parliament answer dated September 8, 2026 says a prediction market would require a Gambling Commission licence to operate in Great Britain. If approved, it would be classified as a “Betting Intermediary” and regulated under the Gambling Act 2005. The answer is specific to Great Britain; do not assume it establishes the position in Northern Ireland.

Canada: securities treatment and gambling rules may differ
On August 27, 2026, the Canadian Securities Administrators and the Canadian Investment Regulatory Organization said sports- and entertainment-based event contracts should not be regulated under securities and derivatives legislation. They said the status of other types of event contracts was still being assessed. Their notice also said two CIRO dealer members had been authorized to facilitate a limited set of event contracts, subject to terms and possible future restrictions.
British Columbia provides a distinct provincial example. Its Independent Gambling Control Office said that, under current provincial legislation, products based on sports or entertainment outcomes are gambling and must be regulated under the federal Criminal Code of Canada and provincial gaming legislation. The office identified BCLC’s PlayNow.com as the only permitted commercial online gambling site in BC and said other online gambling websites accessible to BC players, including sites offering sports or entertainment event contracts, operate illegally in the province. This is a BC-specific position, not a Canada-wide conclusion.

Why the exact contract matters
Two contracts on the same platform may concern different subjects and raise different legal questions. Sports, elections, economic indicators, politics, and entertainment outcomes should not be assumed to share a classification. ESMA says the event question can determine whether a contract is a financial instrument; Canadian regulators have also distinguished sports and entertainment contracts from other event contracts in their securities and derivatives guidance.
Nor does a contract’s label decide its legal treatment. Depending on its structure and jurisdiction, an event contract may be regulated as a financial product, a bet, or potentially fall within more than one regulatory framework. When comparing one with a locally licensed sportsbook or another regulated product, check who authorizes the operator, how the product is classified, whether that event category and customer are eligible, how settlement and disputes work, what it costs to trade or exit, and what protections and complaint routes apply. These products are not necessarily legally or economically equivalent.
What to check before trading an event contract
- Pin down your location. Identify your country and relevant state, province, territory, or other subnational jurisdiction. Check the rules tied to where you are physically located as well as your residence if the regulator or platform distinguishes between them.
- Identify the event category. Write down what the contract concerns—such as sports, elections, economics, politics, or entertainment. Do not assume every contract offered by one platform has the same regulatory status.
- Find the actual operator. Read the customer agreement to identify the legal entity, not just the app or brand name. Search the relevant local securities or derivatives and gambling regulators’ registers, warnings, and enforcement notices. The CFTC advises customers to use registered entities and to verify apps through links on the platform’s official website. A registration in another jurisdiction does not establish local authorization.
- Confirm the contract and customer are eligible. Check whether the specific event, retail customer type, and distribution method are permitted where you are. EU readers should check national binary-options measures where relevant; readers in Great Britain should check Gambling Commission licensing; BC readers should consult the provincial position described above.
- Read the full contract specification. Verify the precise question, resolution source, deadline, settlement method, who makes the determination, and what happens if information is delayed, unavailable, or disputed. The CFTC says customers are entitled to transparent contract rules and settlement information: “You are entitled to timely, transparent information about event contracts, including trading rules and contract terms (e.g., payout, prices, and how settlement determinations will be made, who decides, and how).”
- Check costs, account terms, and exit conditions. Review fees, commissions, penalties, withdrawal terms, counterparty arrangements, and whether you can close an open position before settlement. Do not assume there will be enough liquidity or an easy exit.
- Understand protections and complaint routes. Check how funds are held, how disputes are handled, and which regulator or exchange accepts complaints. For US customers, the CFTC identifies the broker, designated contract market, National Futures Association, and CFTC as possible complaint routes. The CFTC warns that customers dealing with unregistered entities operating outside the United States may have little or no protection.
- Pause if the answer is unclear. Ask the relevant regulator or a qualified lawyer in your jurisdiction before funding an account. Do not use a VPN or false location details to bypass platform restrictions; the guidance cited here does not establish that doing so is a lawful workaround.
What the CFTC says about risk and settlement
The CFTC advises consumers to understand risks, fees, and settlement terms; use registered entities; and verify apps through links from the platform’s official site. It also advises trading only with risk capital and checking market- and contract-specific rules. Read the terms carefully, including whether you can lose the full amount at risk.

A separate CFTC staff advisory dated August 12, 2026 addresses “mention market” contracts—contracts settled on whether a person says or mentions words, attends or appears at an event, or otherwise interacts with another person. It warns: “These contract types present a heightened risk of manipulation because their settlement turns on the discrete conduct of a person that may be neither independently generated nor externally verifiable.” This warning is specific to the contract types described in the advisory; it is not a blanket finding about all event contracts.
