Are loot boxes gambling? There is no universal answer: the legal treatment depends on the country and on what players can do with the rewards. In the UK, the government’s stated position as of February 2026 is that loot boxes with prizes valuable only inside the game, and not cashable, are not legally classified as gambling. That does not settle the law elsewhere, cover every game mechanic, or answer whether a particular purchase is appropriate for a child.
What is a loot box?
A loot box is a game feature that provides an apparently randomized item or reward. Depending on the game, a player may earn one through play or obtain one using in-game items, virtual currency, or real money. Rewards can be cosmetic, such as a character outfit, or affect gameplay.
The everyday term “loot box” does not cover every mechanic in the same way. The Entertainment Software Rating Board (ESRB) uses the notice “In-Game Purchases (Includes Random Items)” for paid randomized goods. Its examples include loot boxes, gacha items, card or item packs, and prize wheels. A rating notice flags a type of purchase; it does not decide whether the mechanic legally counts as gambling.
To understand a specific purchase, separate three questions: Is payment required? Does the player know exactly what they will receive before paying? Can the reward be traded, sold, or otherwise converted into money’s worth? Those details can matter both to consumer decisions and to legal classification.

Are loot boxes gambling under UK law?
The UK Gambling Commission’s explanation of the legal test focuses on whether a prize won by chance amounts to “money or money’s worth.” In its stated position, an item confined to a game and unavailable for cash-out is unlikely to be licensable gambling under the Gambling Act. The UK government decided in July 2022 not to extend the Act to loot boxes at that time. In a parliamentary answer dated 12 February 2026, it reiterated that non-cashable prizes valuable only within the game are not legally classified as gambling.
This is a UK-specific legal position, not a global ruling and not a blanket finding that every randomized purchase is harmless. The mechanics and the value of the prize matter. If a reward can be cashed out, or trading gives it monetary value, the analysis may differ from that for an item that stays within the game. The Commission has also distinguished real-money skin betting from ordinary in-game rewards and says it can act where gambling law applies.
The legal question is separate from whether a feature feels risky, is suitable for a particular age, or deserves stronger consumer protections. As Tim Miller, Executive Director of the UK Gambling Commission, wrote: “However, many parents are not interested in whether an activity meets a legal definition of ‘gambling’.” The distinction matters: an activity can fall outside gambling regulation and still raise practical concerns for a family.

How do other countries treat loot boxes?
Rules differ, so do not infer a game’s legal status from a decision in another country. Two examples in government accounts illustrate why a simple worldwide yes-or-no answer is misleading.

Netherlands
A Dutch government parliamentary answer for 2024–2025 says the Council of State ruled in March 2022 that obtaining and opening FIFA 19 loot boxes and later versions did not constitute a standalone game of chance requiring a licence under the Dutch definition. That is a description of the legal question and ruling in that case; it should not be recast as a universal ban on loot boxes or a rule for all European countries.
Belgium
The same Dutch government answer explains that Belgium has a different definition of gambling. Under the account it gives, some paid loot boxes may fall within gambling regulation and licensing requirements, and offering those without a licence is prohibited. It also says free loot boxes are not prohibited on that basis. This is a government summary of the distinction, not a complete account of every current Belgian rule.
When checking another jurisdiction, look for the local definition of gambling, how it treats game-only rewards, whether tradable or cashable prizes are treated differently, and what regulators have actually decided or enforced. A country’s treatment of one game or mechanic is not automatically a rule for every game.

For a player or parent, the practical question is not just whether an item is rare or desirable. Ask whether it has value outside the game and how that value is realized. An in-game item with no permitted cash-out is different, for the UK legal test, from a prize that can be converted into money’s worth. Trading systems and third-party markets may complicate the picture, even if the game itself does not offer a direct cash-out button.

- Game-only reward: The item can be used in the game but cannot be cashed out. The UK regulator says such items are unlikely to be licensable gambling.
- Tradeable or cashable reward: A way to sell, exchange, or convert the item into money’s worth can change the legal analysis. Do not assume the game-only treatment applies.
- Third-party activity: A service that accepts skins or other items for real-money betting is not necessarily just another loot-box feature. The UK Gambling Commission distinguishes skin betting and says it can act where gambling law applies.
These are practical distinctions, not a substitute for a jurisdiction-specific legal decision. The available statements do not establish that every form of trading has the same legal effect in every country.
What do the available figures tell us—and not tell us?
UK government figures provide dated snapshots, not a measure of today’s entire gaming market. A Department for Digital, Culture, Media and Sport (DCMS) response in 2022 reported that 2.5% of PEGI-rated games from August 2020 to May 2022 carried the “in-game purchases (includes random items)” descriptor. This is a share of PEGI-rated games over that period, not all games and not current prevalence.
The same 2022 government response reported that an Ipsos Mori survey commissioned by an industry trade association found 7% of players had paid for a loot box during the 12 months ending in December 2020. The 7% figure belongs to that survey and period; it is not a fresh estimate or a survey conducted by the government. DCMS also said its own player survey was not representative of the UK gaming population, so its respondent percentages should not be treated as population estimates.

What does “includes random items” mean on a game rating?
On an ESRB rating, “In-Game Purchases (Includes Random Items)” tells you the game offers paid purchases whose contents are randomized. The ESRB notice can cover several kinds of mechanic, not just something literally called a loot box. It is a disclosure to help players and parents identify the purchase feature; it is not a legal verdict that the game is gambling.
For PEGI-rated games, look for the “in-game purchases: includes random items” descriptor. DCMS noted that this purchase descriptor is not itself linked to a specific PEGI age rating. A rating and a random-item notice therefore answer different questions: do not treat the descriptor alone as an age recommendation or legal classification.

Use the rating information as a starting point, then inspect the purchase flow and account settings. A notice may alert you to randomized paid items, but the relevant details are whether payment is optional, what the player can win, whether odds are shown, and what controls are available.

- Check the game’s rating and purchase notices. Look for the ESRB “In-Game Purchases (Includes Random Items)” notice or, for a PEGI-rated game, the “in-game purchases: includes random items” descriptor. Treat these as disclosures about mechanics, not as proof that the feature is legally gambling.
- Inspect the specific purchase. Check whether the item is randomized, whether the player can see the reward before paying, whether rewards affect gameplay or are cosmetic, and whether items can be traded or cashed out.
- Look for probability information. Review the game’s explanation of the odds and how probabilities are determined. UK government guidance calls for clear probability disclosures and transparent information so players can make informed choices.
- Review account and platform controls. Check the family or parental-control settings and any spending limits on the child’s account. UK government guidance calls for parental consent or knowledge before anyone under 18 acquires a paid loot box, uptake of parental controls, and a default £0 spending limit on child accounts as best practice.
- Confirm what the controls actually do. The guidance describes calls and industry commitments, not proof that every game or platform has implemented each measure. Check the settings on the specific account rather than assuming a control is active by default.
Parents can also decide whether to allow randomized purchases at all, even when a game’s rewards are not cashable. That decision is about a child’s spending and exposure to chance-based purchases; it does not depend on the feature meeting a legal definition of gambling.

What if a child made an unwanted purchase?
Start with the platform or publisher’s refund process and check the purchase record to identify where the transaction occurred. UK government guidance calls for fair and lenient refund policies as a backstop, while acknowledging that controls may not always prevent an unauthorized purchase. A refund is not guaranteed by that guidance, so follow the provider’s stated process and keep any relevant transaction details.
Then review the account’s purchase permissions and spending settings. If a child’s account is not protected as expected, adjust the controls available on the platform and game. Guidance and industry commitments should not be mistaken for proof that a particular account has a spending cap or requires parental approval.
How should you compare two games’ randomized purchases?
A rating notice alone will not tell you how one game’s mechanic compares with another. Use the same questions for each game so the differences are clear.
- Payment: Is money required, or can the player earn the randomized reward through play? Can in-game currency itself be purchased?
- Advance information: Does the player know the exact item before paying, or only the category of possible rewards?
- Odds: Are probabilities disclosed, and does the game explain how they are determined?
- Effect: Are rewards cosmetic, or can they affect gameplay?
- Value outside the game: Can rewards be traded, sold, or cashed out?
- Family controls: What purchase approvals and spending limits are available, and are they active on the account?
These comparisons help explain both the player experience and why legal treatment may differ. ESRB’s random-items notice identifies a category of paid mechanics; UK gambling-law analysis emphasizes whether prizes amount to money or money’s worth.
