Sometimes, but not everywhere. A loot box is a randomized in-game reward that may be bought with money, purchased virtual currency, or earned through play. Whether it legally counts as gambling depends on the country, the game’s rules, whether prizes have real-world value, and the specific consumer or age-classification regime. Randomness alone does not produce a universal legal answer.
What a loot box is
A loot box (also called a pack, chest or crate) gives you an unknown item from a defined pool. You may pay directly, spend virtual currency bought with money, or receive an opening through ordinary gameplay. You see the type of reward only after the opening is processed.
Why the uncertainty matters
Buying a known cosmetic item is a conventional purchase: the product and price are visible before payment. A loot box sells a chance at one of several outcomes. That uncertainty can make it difficult to compare value, especially when the currency is sold in bundles that do not match the price of one opening.
Different reward types change the practical risk
- Cosmetic rewards change appearance without affecting a match or campaign.
- Gameplay rewards can alter progression, equipment or competitive performance.
- Tradable or redeemable rewards may be transferred to another player or exchanged through an approved marketplace.
- Non-transferable rewards remain inside the game and normally cannot be converted to ordinary money.
Those distinctions matter when you assess both the consumer risk and the law that applies. A box that costs money but produces only an in-game cosmetic is treated differently from a system whose prizes can be sold or cashed out.

When does a loot box meet a gambling definition?
Gambling laws commonly examine three ideas: consideration (something of value is paid or staked), chance (the outcome is not selected by the player), and a prize or value. The exact statutory wording differs, and regulators may use consumer-protection rules or classification systems instead of gambling law.
Cash-out and transferability are important, but not universal tests
The UK government’s 2022 position was that loot boxes generally sat outside gambling regulation at that time. It highlighted that rewards normally could not legitimately be cashed out, had little real-world monetary value outside the game and were mainly useful for in-game play. That is a jurisdiction-specific explanation, not a global rule. A game that permits lawful transfer, resale or redemption can present a different legal analysis.
Even where a box is outside gambling legislation, other obligations can still apply. Advertising, unfair commercial practices, data protection, age restrictions, payment rules and platform policies may govern how the feature is sold and disclosed.

“Gambling-like” is not the same as “legally gambling”
The suspense, repeated attempts and variable rewards can resemble gambling. That description identifies a design feature; it does not decide the legal classification. The UK government reported an association between loot-box purchases and problem gambling, while stressing that evidence had not established whether the relationship was causal. Buying a box does not mean a person has a gambling disorder, and the available evidence does not show that every purchaser will develop one.
How current rules differ by jurisdiction
The examples below illustrate why a yes-or-no answer is unsafe. They use different legal mechanisms and dates and are not a complete worldwide survey. Check the law and the game’s terms where you live before relying on a conclusion.

Spain provides a useful evidence example rather than a universal legal classification. A 2025 Spanish government campaign cited a study of 6,603 people aged 11–30 who played video games: 30.4% reported buying at least one loot box in the previous year, and buyers were 4.5 times more likely to have betting problems. What the numbers say about young players
The UK Gambling Commission’s Young People and Gambling 2024 statistics provide UK-specific figures, not a global prevalence rate:
- 37% of young people surveyed said they had paid for loot boxes, packs or chests.
- Among those who had paid, 54% said they used virtual currency bought with money. Respondents could select more than one payment method.
- 51% of those young payers said they used money from their own bank account.
The figures describe reported behavior. They do not establish that every purchase was harmful or that loot boxes caused gambling problems. Read the Gambling Commission summary.
How to judge a loot box before paying
Use this process for a particular game. It turns a virtual-currency prompt into a cost-and-risk decision you can check.

- Identify the transaction. Is the reward randomized? Is an opening free, earned through play, paid directly, or paid with currency that was bought for money?
- Calculate the ordinary-currency cost. Divide the price of the smallest practical currency bundle by the number of openings it buys, then account for leftover currency. If a bundle forces you to buy substantially more than one opening, record the actual amount charged, not just the nominal token price.
- Find the probability table. Look for a reward-by-reward percentage, including any categories or tiers. If the odds are hidden, vague or difficult to reach, pause rather than assume the box is good value.
- Check what the reward does. Note whether items are cosmetic, affect gameplay, duplicate items you already own, or can be traded or redeemed.
- Check alternatives. Can the same item be earned without payment, bought directly, or obtained through a transparent progression path? A free route does not make paid openings risk-free, but it changes the decision.
- Read the age and purchase descriptors. Review the platform’s age rating, chance-based-purchase warning and account terms. In Australia, for example, current classification advice uses an M rating for games containing purchasable loot boxes and a “chance-based in-game purchases” descriptor.
- Set a stop rule. Decide a maximum amount and number of openings before starting. Do not raise the limit because an earlier opening produced an unwanted result.
Odds describe one opening, not a promise that you will receive a particular item after a certain number of tries. Unless the game explicitly states a guarantee, treat each opening according to the published terms.

Safety depends on the child, the game and the controls around payment. The combination of uncertain outcomes, frictionless purchases and a currency that obscures price deserves adult attention even when prizes have no cash value.

- Create a child account rather than sharing an adult account.
- Turn on the platform’s purchase approval or password requirement for every transaction.
- Set the account spending limit to zero or to an agreed amount. UK government-backed industry guidance specifically supports a default £0 limit on child accounts, but its implementation is not universal.
- Block stored payment methods on the child profile where the platform permits it.
- Review purchase history and notifications regularly.
- Agree in advance whether earned currency may be spent and whether any paid opening is allowed.
Have a neutral conversation
Explain the difference between buying a known item and paying for a chance at an unknown one. Ask the child to show you the odds and the real-money price. Focus on the design and the agreed limit rather than shaming the child for wanting a reward; secrecy makes unauthorized spending harder to detect.

Use the game’s age information, not just the box art
Ratings and descriptors vary by country and may change when a game is reclassified. A suitable age rating does not guarantee that spending controls are enabled, so check both the rating and the account settings.
What to do after an unauthorized or regretted purchase
- Stop further openings and save the receipt, transaction ID, date and account name.
- Use the platform’s official refund route first and read the game provider’s refund policy. The UK’s 2023 update welcomed fair and lenient refunds as a backstop, but actual eligibility depends on the provider, platform and local consumer law.
- Change the account password, remove stored payment details and require approval for future purchases.
- If a child is under the relevant consent age, state that clearly in the support request and keep copies of the response.
- Contact your payment provider only after checking the platform process; a chargeback can affect an account and does not replace the provider’s own review.
These steps are general consumer guidance, not individualized legal advice. For a disputed or large transaction, consult the consumer-protection authority in your country.
Questions to ask about any game
Is buying a loot box the same as gambling?
It can share gambling-like uncertainty, but legal treatment depends on jurisdiction, prize value, transferability and the game’s particular mechanics. A box with no legitimate cash-out may fall outside gambling law in one place while a different system receives stricter treatment elsewhere.
Are loot boxes illegal?
There is no worldwide ban. Some places regulate disclosures, parental consent, age classification or prize redemption; others use existing consumer rules. Check the current rules where the player is located and the game’s terms.
How do I turn off loot-box purchases?
Use the child or family account’s purchase-approval setting, set the spending limit to zero, remove saved payment methods and disable in-game purchases if the platform offers that switch. Confirm the change by attempting a small, non-chargeable purchase flow or checking the account’s settings and notification page.
What are the odds of getting a particular item?
The answer should appear in the game’s probability disclosure. Record the percentage for the exact item or tier, whether duplicate rewards are possible and whether any guarantee is stated. If no clear odds are provided, you cannot calculate a reliable chance before paying.
