Yes—bitcoin donations to U.S. federal political committees are legal, but they are regulated like other contributions. The campaign must verify the donor, apply the ordinary source prohibitions and contribution caps, value the bitcoin in U.S. dollars when received, and report it as an in-kind contribution. For the 2025–2026 cycle, an individual may give up to $3,500 per election to a federal candidate committee. That answer is specific to bitcoin and federal elections; another token or a state or local race may follow different rules.

What the federal rule actually says

The Federal Election Commission (FEC) addressed bitcoin in Advisory Opinion 2014-02, issued May 8, 2014. It concluded that “bitcoins may be accepted as contributions under the Act.” The opinion treated bitcoin as “money or anything of value,” so accepting it does not create an exemption from the Federal Election Campaign Act (FECA). A committee must handle a bitcoin contribution under the same basic limits, donor-source restrictions, screening duties and reporting framework that apply to other contributions.

That holding is about bitcoin received by the federal committee described in the opinion. It is not a blanket ruling that every cryptocurrency, token, stablecoin or digital asset is automatically acceptable in every political race. FEC advisory opinions answer specific factual requests. A materially different asset, fundraising arrangement or transaction should be analyzed under the current statute, regulations, later advisory opinions and court decisions rather than treated as automatically covered by AO 2014-02.

How much can an individual donate in 2025–2026?

The FEC’s 2025–2026 contribution-limit table lists $3,500 per election for an individual giving to a federal candidate committee. “Per election” is a legal unit, not a yearly allowance. A candidate’s primary and general election are separate elections; a runoff or special election can also have its own limit when the candidate participates.

For example, an eligible individual could generally give $3,500 for a candidate’s primary and another $3,500 for that candidate’s general election. Giving bitcoin does not increase either amount. The campaign must convert the asset to a dollar value at receipt and count that value toward the donor’s applicable limit.

Recipient 2025–2026 individual limit How the limit is expressed
Federal candidate committee $3,500 Per election (primary, general, runoff or special election, as applicable)
Political action committee (PAC) $5,000 Per year
State, district or local party committee $10,000 combined Per year
National party committee $44,300 Per year

These figures come from the FEC’s 2025–2026 table and apply to the listed recipient categories. Do not use the $3,500 candidate figure for a PAC or a party committee. Party committees can also be subject to separate coordinated-party-expenditure limits and other rules not shown in this basic comparison.

What a campaign must do when bitcoin arrives

1. Identify and screen the donor

The committee treasurer is responsible for examining contributions for compliance. Before accepting a bitcoin transfer, the campaign should collect the donor information required for a federal contribution record and determine whether the donor is an eligible source. Federal committees may not accept contributions from prohibited sources, including foreign nationals (with the limited exceptions recognized in federal law), federal government contractors and other barred sources. A digital wallet address by itself does not establish who supplied the money or whether the source is lawful.

The campaign also has to monitor the donor’s aggregate giving to that committee or candidate for the relevant election. A donor who has already reached the applicable cap cannot avoid the limit by sending a second transaction, using a different wallet or changing from dollars to bitcoin.

2. Establish the contribution’s dollar value

The FEC’s bitcoin guidance says a committee should value the contribution at bitcoin’s market value when the committee receives it. If a processing entity supplies a contemporaneous exchange-rate determination, the committee should rely on that rate first. If there is no processor rate—or no processor—the committee may use another reasonable bitcoin-to-dollar exchange rate.

The timing matters because bitcoin’s price can change substantially within minutes. The amount counted against the donor’s limit is the documented market value at receipt, not a later sale price and not the amount left after network or processor charges. A campaign should preserve the time, valuation method, exchange-rate source and transaction records so its treasurer can support the reported figure.

3. Report it as an in-kind contribution

Bitcoin receipts are reported like in-kind contributions. The committee records the contribution at its market value and identifies the donor in its regular FEC reporting. Processor fees are not subtracted from the contribution value. The fees should be reported separately as operating expenditures, leaving the gross contribution amount visible for limit and disclosure purposes.

4. Keep the asset only within the permitted handling process

AO 2014-02 allowed a committee to retain bitcoin in a wallet pending liquidation. The FEC treated the asset similarly to certain property contributions that can be held until they are converted. Holding the bitcoin does not suspend compliance duties: an excessive contribution, a prohibited-source contribution or another unlawful receipt still has to be returned or refunded as required.

Can a campaign spend the bitcoin directly?

There are two separate points in the FEC record. In AO 2014-02, the Commission did not obtain the four affirmative votes required to approve the requestor’s proposed conclusion about buying goods and services directly with received bitcoin. That portion of the request therefore did not become an approved holding.

Current FEC bitcoin-investment guidance gives campaigns a practical rule: sell the bitcoin and deposit the proceeds in the campaign depository before using the funds for disbursements. In other words, a committee should not pay a vendor directly from the wallet with contributed bitcoin. The sale, deposit and later expenditure should be documented in the committee’s books and reported under the applicable FEC categories.

This conversion step also creates a clean audit trail. The contribution is recorded at its value when received; the liquidation records the conversion and any resulting change in value; the campaign then spends dollars from its depository. The committee should follow its treasurer’s accounting procedures and current FEC instructions for reporting the sale and any gain or loss.

What happens if the contribution is too large or unlawful?

Bitcoin’s form does not change the remedy. The FEC says campaigns may not retain excessive contributions. Depending on the circumstances, a committee may need to refund the excess, redesignate it to another permissible election or reattribute it to another eligible contributor, using the procedures and deadlines that apply to ordinary contributions.

The same principle applies when the source is prohibited or the donor cannot be verified. A wallet holding the asset does not make an impermissible contribution lawful. If a committee has already converted the bitcoin, it still must address the underlying contribution problem and document the corrective action. Treasurers should use the FEC’s current compliance instructions for the exact refund, redesignation or reattribution process instead of improvising a cryptocurrency transfer.

Bitcoin is not automatically every cryptocurrency

People often use “cryptocurrency” as a broad label, but the FEC determination identified here is bitcoin-specific. The opinion does not establish that every token has the same legal or accounting treatment. A token may have different transfer mechanics, valuation data, issuer involvement, privacy characteristics or restrictions on ownership. Those differences can affect whether a committee can identify the contributor, establish a reliable market value and comply with reporting rules.

Before accepting an asset other than bitcoin, a committee should obtain a current legal analysis addressing at least:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Whether the asset can be treated as money or anything of value under the federal campaign-finance rules.
  • How its fair market value will be fixed at the moment of receipt.
  • Whether the donor and beneficial source can be verified, including intermediary or exchange involvement.
  • How the committee will liquidate, custody and report the asset.
  • Whether sanctions, securities, tax, money-transmission or other laws create additional restrictions.

The FEC opinion expressly did not decide questions arising under laws outside the Commission’s jurisdiction, including tax and securities law. Federal campaign-finance permission is therefore not a complete legal opinion on the transaction.

Federal, state and local elections are different systems

The $3,500 limit and AO 2014-02 answer apply to federal committees. They do not establish a nationwide rule for a governor, mayor, state legislative, county or municipal campaign. States can prohibit cryptocurrency contributions, allow them under different valuation and disclosure rules, or impose limits that differ from federal caps. Some local jurisdictions follow state law; others have their own election code.

For a nonfederal race, identify the committee’s jurisdiction first, then check the current election authority’s contribution-limit, prohibited-source and digital-asset guidance. Ask specifically whether the authority permits the particular asset, how it defines the receipt date and value, and whether an exchange or processor must be disclosed. Do not assume that a campaign’s ability to accept bitcoin in a federal race transfers to a state or city contest.

A practical compliance checklist for donors and campaigns

For an individual donor

  1. Confirm that the recipient is a federal committee if you are relying on the federal bitcoin rule.
  2. Confirm your eligibility as a contributor and provide the identifying information the committee requests.
  3. Ask the campaign how it will determine the dollar value at receipt and record the transaction time.
  4. Check your cumulative giving for the relevant election; for a federal candidate in 2025–2026, keep the bitcoin’s valued amount within $3,500 for that election.
  5. Keep the transaction hash, date, amount, exchange-rate evidence and the campaign’s receipt acknowledgment.

For a campaign treasurer

  1. Use a screening process that identifies the contributor and checks prohibited sources before acceptance.
  2. Capture a contemporaneous exchange rate from the processor when available; otherwise document another reasonable rate.
  3. Record the gross market value as an in-kind contribution and track it against the donor’s applicable limit.
  4. Report processor charges separately as operating expenditures rather than netting them against the contribution.
  5. Maintain the bitcoin in a controlled wallet while arranging liquidation and preserve custody records.
  6. Sell the bitcoin and deposit the proceeds into the campaign depository before paying goods or services.
  7. Review the receipt for excess, prohibited-source or otherwise unlawful characteristics and issue any required refund, redesignation or reattribution.
  8. Retain valuation, identity, wallet, liquidation and reporting documentation for the committee’s compliance records.

Common mistakes and how to avoid them

  • Calling $3,500 a yearly limit: It is per election for a federal candidate, while PAC and party limits use different periods and amounts.
  • Counting the net proceeds: The contribution is valued at receipt; processor fees are separate expenditures.
  • Using the sale price as the contribution value: The relevant value is the market value when received, supported by a contemporaneous rate.
  • Assuming a wallet proves donor eligibility: A public address does not identify the contributor or rule out a prohibited source.
  • Paying vendors directly in bitcoin: Current FEC guidance calls for liquidation and deposit before disbursement.
  • Applying the federal opinion to every token or race: AO 2014-02 is bitcoin-specific and concerns federal committees.
  • Treating an advisory opinion as a universal safe harbor: The FEC describes advisory opinions as responses to particular facts; materially different arrangements need their own analysis.

Bottom line for a prospective donor

If you are donating bitcoin to a U.S. federal candidate committee during 2025–2026, the contribution can be legal when the donor is eligible, the campaign can verify the source, and the bitcoin’s market value at receipt stays within the applicable limit. For an individual candidate contribution, that limit is $3,500 per election. The campaign must report the gross value as an in-kind contribution, handle fees separately, liquidate before spending and correct any excess or prohibited contribution. For another cryptoasset or a state or local race, obtain the jurisdiction-specific rule before sending funds.
