Autistic suspects may face disadvantages in forensic interviews, but the evidence does not show that every autistic person does, or how often it happens in real police interviews. A 2023 mock-interview study found that innocent autistic participants gave fewer details supporting their innocence and reported more difficulty understanding questions, more anxiety, and less perceived support. Yet autistic and non-autistic participants provided similar amounts of investigation-relevant information and showed similar consistency between their statements and the evidence. The findings point to a potential risk—not a universal outcome or a real-world prevalence rate.
What does the evidence show?
A mock-interview study found both potential disadvantages and similar outcomes
Bagnall and colleagues’ 2023 study involved 32 autistic and 33 age- and IQ-matched non-autistic adults. Participants took part in a virtual burglary scenario and then a mock police interview; some were assigned an innocent condition and others a guilty condition, with guilty participants instructed to lie.
- Among innocent participants, autistic adults reported fewer details that supported their innocence.
- Across the innocent and guilty conditions, autistic participants reported greater difficulty understanding interview questions, higher anxiety, and lower perceived support during the interview.
- The groups reported similar amounts of investigation-relevant information, and their statements showed similar consistency with the evidence.
These findings are not contradictory. A person may provide information relevant to an investigation and remain consistent while still finding the process more difficult or giving fewer details that help explain an innocent account. The study authors concluded that investigative interviews were more socially and cognitively demanding for the autistic mock-suspects in their study. That conclusion applies to those participants and that experimental setting; it does not predict how every autistic suspect will respond.
Support workers have also reported interview difficulties
A 2020 questionnaire study asked 55 Appropriate Adults about their understanding of autism and their experiences supporting suspects. Respondents showed some awareness of autistic characteristics but less awareness of how those characteristics might affect an interview. They reported 15 incidents in which they considered autism characteristics to have disrupted interview procedures. These are respondents’ observations, not a controlled measure of how often disruption occurs in police interviews.

How might autism affect an interview?
A suspect interview can demand that a person understand questions, retrieve and organize memories, communicate under pressure, and respond to an interviewer’s handling of evidence. The 2023 mock-interview participants’ reports of question-comprehension difficulty and anxiety provide direct evidence that these demands can be challenging for some autistic people.
Other possible difficulties include recalling specific events freely, placing details in context, and organizing an account. Tactical disclosure—when an interviewer reveals or withholds evidence during questioning—can add unexpected social and reasoning demands. These are possible mechanisms described in a discussion by Dr Katie Maras, a University of Bath researcher, not characteristics to presume in an individual. In that 2022 discussion, Maras also noted that published research on suspect interviews was limited.

Can interview behavior be mistaken for deception?
Interview behavior is not a reliable shortcut to deciding whether someone is telling the truth. Hesitation, an unusual communication style, or difficulty understanding a question should not, on its own, be treated as evidence of guilt or deception. The 2023 study discusses how cues associated with deception may also appear when autistic mock-suspects are telling the truth. It does not establish that any single behavior reliably signals truthfulness or lying.

What support or adjustments may help?
Interview planning should take the individual’s communication and comprehension needs into account and aim to obtain a detailed, accurate account without leading the interviewee. Depending on the person, it may help to make questions easier to understand, allow time to process and respond, and structure the conversation so the person can address one topic at a time. The available evidence supports considering individual adjustments; it does not establish one interview technique as best for every autistic suspect.
Maras’s discussion describes the Witness-Aimed First Account (WAFA) method, which breaks an account into smaller topic sections, as promising for helping witnesses recall events. That is witness-interview guidance. The sources summarized here do not establish that WAFA has been validated as a method for interviewing suspects, so it should not be presented as proven suspect-interview practice.

What legal safeguards apply?
Rules depend on jurisdiction. In England and Wales, the Police and Criminal Evidence Act (PACE) Codes C and H address vulnerable people in police detention and interview. Code H describes circumstances in which an urgent interview may proceed without an appropriate adult, subject to conditions and senior authorization. These are England and Wales provisions, not universal rules.
An autism diagnosis alone does not automatically establish a person’s legal status as vulnerable or guarantee a particular procedural outcome. The applicable legal test and the individual circumstances matter. Anyone dealing with a live case should check the current official code and obtain advice appropriate to the jurisdiction.

What the evidence cannot tell us
The 2023 study was a mock-crime experiment, not a count of outcomes in custody interviews. The 2020 Appropriate Adult findings are self-reported observations. Together, they support concern about potential disadvantages and identify experiences worth addressing, but they do not establish how common those disadvantages are in real cases, whether they change case outcomes, or that all autistic suspects are affected in the same way.
A College of Policing project page describes a program examining standard suspect-interview practices through mock scenarios, custody-interview analysis, and interviews with autistic adults. The page listed a planned completion date of March 2023, but a project description is not a completed-results report; the findings summarized here do not establish the program’s final results.
