Sometimes. Open-source projects do not share one rule for AI-generated patches. Some project families permit code created partly or wholly with AI when the contributor can grant the required rights, clears any third-party material, follows disclosure rules, and reviews the change. Other projects impose stricter conditions: Apache Lucene permits AI-assisted coding but bars autonomous-agent contributions, for example.
The repository’s current contribution guide, AI policy, pull-request template, license terms, and your employer’s rules control your submission. A foundation-wide statement is not an automatic approval for every project beneath it.
Why there is no universal yes-or-no answer
“Open source” describes licensing and development models, not one governing organization. Each repository can set additional contribution conditions, and those conditions can change. A project may distinguish between using an assistant to edit code, accepting a generated suggestion, pasting an entire generated function, and allowing an autonomous agent to open or merge changes.

It also recognizes that individual projects and employers may impose stricter requirements.

The Apache Software Foundation (ASF) similarly treats AI-generated code as conditionally acceptable. Its guidance focuses on whether the contributor has sufficient rights, whether third-party material appears in the output, and whether the contributor can reasonably establish those facts. Apache Lucene, however, adds a project-specific restriction: contributors may use AI as a coding tool, but autonomous agents may not contribute, and people must understand and explain the work.
These examples show variation rather than a statistic about open source as a whole. No independently verifiable official figure establishes what percentage of repositories allow AI-generated patches.
How major project policies differ

The ASF guidance is described as evolving and references August 2026. Policies should therefore be checked again at the time of submission, not treated as permanent rules.

What to check before opening a pull request
- Read repository-specific instructions. Start with
CONTRIBUTING, the code of conduct, any AI policy, the pull-request template, and recent maintainer instructions. Look for distinctions between AI-assisted editing, fully generated code, generated documentation, and autonomous agents. - Check your employment or client policy. An employer can restrict which tools may receive source code, prohibit generated code, or require internal approval even when the public repository permits AI use.
- Read the AI tool’s terms. Determine what rights you receive in output, whether the provider imposes restrictions on commercial or open-source use, and whether your use of the service is allowed for the project’s code. The ability to download or copy output does not, by itself, prove that you can grant the project the rights it requests.
- Confirm the project’s contribution license and agreements. Identify the license attached to contributions and any developer certificate, sign-off, or contributor agreement. Your submission must be compatible with those requirements.
- Review every changed line. Verify behavior, tests, security implications, performance, dependencies, error handling, and consistency with the project’s design. You should be able to describe why each material change is present without asking the model to explain it for you.
- Investigate possible third-party material. If a similarity checker, reviewer, or your own search identifies code or text that resembles an existing project, find the source, read its license, and follow the repository’s ordinary notice and attribution process.
- Prepare the required disclosure. If the project asks for AI disclosure, use its exact field, label, or commit convention. If it does not prescribe a format, a concise record of the tool and version can make provenance easier to audit.
- Complete ordinary contribution formalities. Sign-offs, contributor license agreements, tests, review requests, and security reporting procedures still apply. AI assistance does not replace any of them.
Rights, licenses, and copyright are separate questions
Your rights to use the tool’s output
First ask whether the AI provider’s terms allow you to use the output in this contribution and to grant the project the license it requires. ASF guidance frames this as a contributor responsibility: you should be entitled to grant the ASF a sufficiently broad license for the project. The same principle applies to any repository with its own contribution license.
Terms can differ by service, account type, jurisdiction, and date. Keep a record of the terms that applied when you generated the patch if your organization requires an audit trail. Do not assume that an output labeled “yours” by a tool automatically satisfies a project’s contribution agreement.

Third-party code may appear in generated output
Output rights and third-party rights are different checks. A model can produce code that is identical or substantially similar to material distributed under another license. If that happens, identify the source and comply with its license, obtain permission where necessary, and provide the notice or attribution required by the project and the source license.
The Linux Foundation’s guidance calls for permission for pre-existing third-party copyrighted material and notice and attribution of those rights. ASF guidance likewise says the output should contain no unapproved third-party material, or that the contributor must have permission and meet the applicable conditions.
Copyrightability is unsettled
Whether purely AI-generated output receives copyright protection can vary by jurisdiction and remains unsettled. That uncertainty does not eliminate contribution risk. ASF recommends meeting the no-third-party-material or permission conditions where practical instead of relying only on an argument that an output is not copyrightable. A patch can still create licensing, confidentiality, security, or contractual problems even when the authorship question is unclear.
Scanning helps, but cannot prove clean provenance
Similarity and license scanners are useful investigation aids, not proof that a patch is free of third-party material. ASF notes that many tools reveal nothing about similarity to training data and that code scanners generally match only known open-source code. A clean scan therefore supports review but cannot replace it. Examine suspicious matches manually and retain the reasoning behind your decision.
When and how to disclose AI use
Disclosure rules differ. The Linux Foundation emphasizes notice and attribution when third-party rights are included. ASF recommends recording the tool used to create a contribution and gives a commit-message example such as Generated-by: <Name of Tool> <Version>. That example is a recommendation, not a universal mandatory token.

Follow the repository’s requested format if one exists. It may ask for a pull-request checkbox, a commit trailer, a statement in the description, or no disclosure for ordinary assistance. Do not add a disclosure that falsely suggests the model wrote all of the patch if you used it only for a small edit; describe the involvement accurately and briefly.

Record the tool and version, the approximate date, the prompts or source context your organization permits you to retain, and the checks you performed. Never disclose confidential source code or personal data merely to create a provenance record.
Human review and accountability remain mandatory
Submitting a generated patch makes you the person accountable for the contribution under the project’s ordinary process. You are responsible for its license compatibility, security properties, tests, maintainability, and factual claims in the pull request.
Lucene makes this explicit by requiring contributors to understand and explain their work in their own words. Treat that as a practical test: if you cannot explain the algorithm, data flow, edge cases, and failure behavior, the patch is not ready for review.
Review should cover more than whether tests pass. Generated code can introduce insecure defaults, missing authorization checks, incorrect error handling, unnecessary dependencies, data races, inefficient queries, or an API pattern that conflicts with project conventions. Ask a maintainer or subject-matter reviewer about risks you cannot independently assess, and disclose uncertainty rather than presenting generated assumptions as facts.

Autonomous agents are a separate policy question
“AI-generated” can describe a suggestion accepted by a human, a complete function generated from a prompt, or an agent that edits files, runs tests, opens a pull request, and responds to review. Policies may treat those cases differently.
Apache Lucene permits AI as a coding tool but bars autonomous-agent contributions. A repository with that rule may still allow you to use an assistant interactively while requiring you to make and explain the final decisions. Other projects may impose their own boundaries, such as requiring human-authored commit messages, prohibiting generated documentation, or requiring a named human owner for every change.
Check both the text of the policy and the workflow implied by the pull-request template. If an agent opened the request, be prepared to disclose that fact and to take over all review and communication yourself when the project requires human-led contribution.

Linux Foundation project
Begin with the individual project’s rules rather than relying on the foundation’s general guidance. Confirm that the AI tool’s terms are compatible, inspect the output for third-party material, and add any required notice or attribution. If the project or your employer has a stricter AI policy, follow the stricter rule.
Apache project
Establish that you can grant the ASF the necessary rights, investigate possible copied code, and use the recommended tool-provenance record when appropriate. Similarity scans are evidence to investigate, not a guarantee that the patch has no training-data or license issue. Also check any applicable contributor agreement requirements.

Apache Lucene
You may use AI for coding, but you must understand and explain the resulting change, and an autonomous agent may not contribute. A human should own the design decision, testing, commit, and reviewer communication.
Linux kernel
Meet the kernel’s ordinary licensing rules and provide the required contributor sign-off. The kernel documentation excludes code that lacks a compatible license or creates copyright problems. AI assistance does not waive those requirements or transfer responsibility to the tool.
What to do when the policy is silent or unclear
- Search the repository history and current maintainer announcements for an applicable clarification, while treating informal comments as subordinate to the current written policy.
- Ask a maintainer a narrow, concrete question before opening the patch: identify the type of AI assistance, whether any agent acted autonomously, and what disclosure you propose.
- Keep the patch small and well tested so reviewers can evaluate it independently.
- Document your rights and provenance checks privately if the project does not request them publicly.
- Do not submit until you can satisfy the project’s license, sign-off, disclosure, and explanation requirements.
If a dispute concerns a specific jurisdiction, contract, or allegedly copied work, obtain qualified legal advice. Project guidance is practical contributor policy, not a universal legal ruling.

Can I submit a patch if AI wrote only part of it?
Often, but the same checks still apply: read the repository policy, confirm your rights to use the output, investigate third-party material, review the change, and follow any disclosure format. Some projects regulate all AI-assisted contributions, not only fully generated files.
Does passing a license scanner prove that generated code is safe to contribute?
No. Scanners generally detect known code and may not reveal similarity to training data. A clean result is one input to a human provenance and license review, not proof of originality or permission.
Who is responsible if an AI-generated patch causes a problem?
The human contributor remains responsible under the project’s normal contribution process. AI use does not transfer accountability for security, licensing, tests, or design decisions to the tool provider.
Is the ASF commit token required in every open-source project?
No. Generated-by: <Name of Tool> <Version> is an ASF recommendation. Use it only when appropriate or requested; another repository may require a different disclosure or none at all.
