No—there is no confirmed U.S. ban on ANBERNIC handhelds in the evidence available as of October 12, 2026. A report published that day says the Entertainment Software Association (ESA) recommended that the Office of the United States Trade Representative (USTR) classify ANBERNIC as a “superfake,” citing handhelds sold with microSD cards containing pirated game ROMs. That is a reported industry-group recommendation, not a USTR decision or an order barring sales.
What the report says—and what it does not
Retro Handhelds reported on October 12, 2026, that the ESA had recommended that USTR classify ANBERNIC as a “superfake.” The report connects the recommendation to handhelds sold with microSD cards said to contain pirated game ROMs. The term is the ESA’s reported characterization; it is not an official USTR finding.

The information reported does not show that ANBERNIC is currently barred from U.S. sales. It also does not confirm current stock, shipping routes, or retailer listings. Those are separate questions from whether a government restriction has been issued, and current availability has not been established here.

The 2025 shipping suspension was described as tariff-related
On April 21, 2025, Android Authority reported that ANBERNIC had suspended orders shipping from China to the U.S. in response to tariff-policy changes and recommended products from its U.S. warehouse. The Italian investigation was separate
Ars Technica reported on July 16, 2025, on an Italian investigation involving a creator who reviewed handhelds with pre-loaded ROMs. That case is distinct from the reported U.S. trade-policy recommendation. Its jurisdiction and allegations do not establish the U.S. legal status of ANBERNIC or determine the legality of every emulator or ROM use in the United States. Ars Technica’s July 16, 2025 report

Why Section 337 is not the same as the reported USTR recommendation
The U.S. International Trade Commission (USITC) says its Section 337 investigations most often involve intellectual-property claims, including allegations of patent or trademark infringement by imported goods. That provides context for a separate trade-enforcement process; it does not establish that the USITC has opened a case or issued an order against ANBERNIC.
