There is no single national payer for the electricity infrastructure needed by data centers. A large customer can be billed for its dedicated interconnection, substations and other facilities, while shared transmission, generation and capacity investments may be recovered from multiple customer classes under utility tariffs.
Federal regulators set wholesale-market and interstate-transmission rules; state public-utility commissions decide how costs appear in retail rates. That split means a data-center project can produce very different bills for households depending on its region, tariff and the protections attached to the project.
Why the payment question has become urgent
U.S. electricity demand is accelerating as cloud computing, artificial intelligence and other digital services add large, often round-the-clock loads. The Energy Information Administration (EIA) says demand grew about 1.7% per year from 2020 through 2025, compared with 0.1% annually from 2005 through 2019.

Its 2024 assessment projects 325–580 TWh by 2028, a range that reflects uncertainty about AI adoption, efficiency and construction schedules. A 2025 Lawrence Berkeley National Laboratory update estimates data centers could consume 11.8% of U.S. electricity by 2030.

In organized wholesale markets, the Federal Energy Regulatory Commission (FERC) reported 2.8% electricity-demand growth in 2024. FERC Chairman Mark Christie warned on March 20, 2025: “The combination of rapidly increasing electricity demand, driven by hyperscale customers such as data centers, paired with the alarming rate of base load generation retirements and lack of new dispatchable generation, is not sustainable and must be addressed.”
The issue is therefore larger than a single server campus. Utilities and grid operators must decide which new assets are necessary, how quickly they are needed and whether the customer that prompted them will remain long enough to pay for them.
What the grid must build

- Generation and firm capacity: New plants, retained capacity or other dependable resources to serve continuous demand, especially when older generators retire.
- High-voltage transmission: New lines and reinforcements to move power into growing load pockets.
- Substations and transformers: Equipment that steps voltage down and connects bulk transmission to local networks.
- Distribution reinforcement: Local circuits, protection systems and switching equipment sized for a large new customer.
- Interconnection studies and queue reforms: Engineering and administrative changes needed to evaluate projects faster and avoid reserving capacity that never materializes.
- Flexibility and storage: Demand response, onsite generation and batteries that can reduce peak requirements or provide backup service.
- Reliability planning: Forecasts that account for uncertain project completion and the timing of generation retirements.
Some of these assets serve one customer; others improve the wider network. That distinction drives the bill.
Three ways regulators allocate the cost
| Approach | Typical charges | Protection against unfair shifting | Main trade-off |
|---|---|---|---|
| Large-load or cost-causation | The data center pays for dedicated facilities, interconnection work and incremental network costs it causes or reserves. | Long-term service contracts, minimum-demand commitments, collateral and financial guarantees can cover cancellation or nonpayment risk. | More of the initial cost sits with the project, which can make development slower or more expensive. |
| Shared rate base | Some generation and transmission investment enters regulated utility rates paid by several customer classes. | A public cost-of-service case must show system benefits and assign costs among classes. | Per-unit costs may fall when new demand uses existing capacity, but households can absorb losses if forecasts fail. |
| Hybrid protection | The project pays direct and incremental costs while eligible shared upgrades are recovered through approved rates. | Special tariffs, minimum bills, exit fees, transparent studies and periodic true-ups limit stranded-asset exposure. | The result is more administratively complex and requires continuing oversight. |
There is no automatic rule that “Big Tech” pays for every upgrade. A tariff normally distinguishes facilities built solely for the customer from network investments that provide measurable reliability or economic benefits to others. Regulators must also decide whether a customer is paying for capacity it actually uses, capacity it has reserved or capacity built speculatively for a possible expansion.
Who decides: FERC, states and regional grids
FERC regulates wholesale electricity markets and interstate transmission tariffs. Regional operators such as PJM, MISO and SPP administer organized-market rules under FERC oversight, while ERCOT and vertically integrated states operate under different combinations of federal and state authority. The governing tariff and the location of the project determine which process applies.

State public-utility commissions retain authority over retail electricity rates, service terms and conditions. A state commission can approve a special large-load tariff, require a minimum payment, allocate costs among residential and commercial classes or reject a utility’s proposed treatment. This federal-state division is why two similarly sized data centers can face different obligations and why household-rate impacts vary by state.

That is an example of the shared-rate-base model, not a universal rule for every jurisdiction.
What changed with FERC’s June 2026 orders
On June 18, 2026, FERC issued orders requiring all six regional grid operators under its jurisdiction to justify or reform tariffs for large loads. The orders address whether existing rules properly assign costs and protect reliability as hyperscale demand grows, while preserving state authority over retail rates.

FERC said the actions are “designed to ensure that consumers nationwide continue to enjoy reliable, affordable power—even as demand soars and technology leaps forward.” In practice, the orders put pressure on wholesale tariffs and regional interconnection procedures; they do not let FERC set a household’s retail rate or eliminate state commission review.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone. Will a data center raise your electric bill?
It can, but the outcome depends on the approved allocation and the project’s performance. A household is more exposed when a utility places new generation, transmission or distribution assets in its general rate base and the large customer receives a discounted or temporary tariff. Exposure is lower when the project funds dedicated facilities, makes a binding minimum-demand commitment and posts security for an early exit.
New demand can also spread fixed network costs across more megawatt-hours, potentially reducing average costs if the facility operates as forecast and uses existing capacity efficiently. Conversely, a canceled project, an underused line or an overly optimistic load forecast can leave existing customers paying for assets that produce little benefit. The relevant question in a rate case is not simply whether a data center is present, but whether its incremental costs and documented system benefits are matched.

How to evaluate a proposed large-load tariff
Residents, regulators and policymakers can compare proposals using the same questions:
- Cause: Which facilities would not be needed without the new load, and are those costs assigned to the customer?
- Benefit: Who receives reliability, capacity or economic benefits from shared upgrades, and is that benefit quantified?
- Commitment: Is there a long-term contract, minimum-demand payment or other enforceable obligation?
- Risk: Who pays if construction is canceled, delayed, downsized or abandoned?
- Transparency: Are the utility’s load forecast, cost-of-service study and assumptions available for review?
- Consumer protection: Are residential and low-income customers shielded from unjustified transfers?
- Review: Does the tariff require periodic true-ups as actual demand, costs and reliability conditions change?
These tests do not require every dollar to be assigned to one customer. They require the allocation to follow cost causation, recognize documented system benefits and leave cancellation risk with the party best able to control it.
The practical answer
America’s digital growth is creating a genuine need for new generation, transmission, distribution and interconnection capacity. Large customers should normally cover facilities built specifically for them and the incremental costs they cause or reserve. Broader investments may reasonably be shared when they serve the wider system, but only with transparent studies, enforceable commitments and protections against stranded costs. Whether your electric bill rises will be decided in the tariff and state rate case governing the project—not by the national data-center trend alone.
