The Allahabad High Court set aside an ex parte GST adjudication order after a taxpayer said a post-cancellation show-cause notice was sent only through the common portal. The court relied on a Uttar Pradesh circular directing subordinate authorities to ensure physical service in adjudication proceedings initiated after registration cancellation; it did not hold that every portal-only GST notice is invalid across India.
What happened in the case
In Mukesh Kumar Jain v. Assistant Commissioner, CGST, the petitioner said their GST registration was cancelled on 5 September 2023. A show-cause notice followed electronically on 25 June 2025, after the cancellation. The petitioner said they learned of the proceedings only when recovery was pursued after an ex parte adjudication order dated 21 April 2026.
The dispute was therefore not simply about whether a notice appeared on the common portal. It concerned a proceeding started after cancellation, the method used to notify the taxpayer, and whether the taxpayer had a meaningful opportunity to respond before an order was made.
Why the court considered physical service important
The court referred to a circular issued by the Commissioner of Commercial Tax, Uttar Pradesh, on 7 May 2025. As described in the judgment, it instructed subordinate authorities to ensure physical service of notices in adjudication proceedings initiated after registration had been cancelled. The court treated that instruction as binding on those authorities.

Explaining the practical reason for the circular, the court said: “The above Circular is founded on sound common sense inasmuch as once the registration of a person is cancelled, he may remain disabled and in any case he may not be obligated to work on the Common Portal, thereafter.” The judgment was authored by Justice Swarupama Chaturvedi and Justice Saumitra Dayal Singh.
The reasoning addresses the risk that a person whose registration has ended may not continue monitoring the portal. It does not establish that portal service alone is automatically defective in every GST proceeding, or that the same circular governs taxpayers outside Uttar Pradesh. The decision applies the circular as the court understood it to the facts before it.

What the High Court ordered
The court set aside the adjudication order dated 21 April 2026 and allowed the petitioner two weeks to file a final reply. The directions also protected the opportunity to address material relied upon by the department and to attend a hearing:

- The authority was to consider those requests before the final hearing.
- The personal-hearing date was to be communicated with at least 15 days’ advance notice.
- After the hearing, the authority was to pass an appropriate reasoned order.
These are directions in this case, not a general two-week filing period or a universal 15-day hearing rule for all GST matters.

How to assess a similar GST demand
A taxpayer facing a demand after registration cancellation should establish the sequence and service record before assuming the judgment applies. The relevant distinctions include whether the adjudication proceeding began before or after cancellation, whether notice was served physically or through another documented method, and which state’s circular or instructions govern the authority.
- Build the timeline. Keep the cancellation order, show-cause notice, adjudication order, portal records and any recovery communication. Record the dates of issuance and when each item was actually received or discovered.
- Check how service was made. Preserve envelopes, delivery records, emails, portal downloads and screenshots where available. A portal entry and proof of physical delivery are different facts; identify what the authority’s record says rather than relying only on memory.
- Check the jurisdiction and applicable instruction. The judgment discusses the Uttar Pradesh Commissioner of Commercial Tax circular dated 7 May 2025. The reported judgment does not reproduce the circular’s full text, exceptions or its interaction with statutory service provisions, so those details should be verified against the current primary documents.
- Act promptly on the order and deadlines. Seek advice from a qualified tax professional or lawyer about available procedural steps and time limits. If preparing a reply, identify the documents relied on and any cross-examination request that is relevant to the case, and retain proof of submission.
Limits of the ruling
This is a fact-specific Allahabad High Court disposition applying a U.P. circular as described in the judgment. It does not settle how other High Courts treat portal-only notices after cancellation, whether later decisions have refined the issue, or whether a different statutory service method is sufficient in another case. The operative circular, actual service evidence, governing provisions, limitation periods and any subsequent authorities can change the analysis.
