Before generating an AI talking-photo video, settle five things: whose likeness is used and whether permission is documented; where the video will appear; whether the script makes only truthful claims; how the provider handles your files and access; and who will review the finished video before publication. “AI talking photo” can mean animating one photograph with a script or building a reusable avatar from a person’s recording, and those workflows can have different consent and usage rules. Decide the job and audience first, then choose an avatar type and provider whose current policy permits that exact use. Treat the first output as a draft that requires a human check, not as an automatically publishable asset.

What an AI talking-photo video actually is

The term covers at least two production methods. In a photo-and-script workflow, you upload a still image, enter text, and the service synthesizes facial movement and speech. In a personal-avatar workflow, a person records a short video and completes a consent step so the service can create a reusable digital presenter. Inputs, identity checks, rights, and plan limits are not interchangeable.

For example, HeyGen describes a Personal Avatar that starts with a 15-second phone video and a consent statement, while its Avatar IV API announcement describes generating a video from a photo and a script. Those are provider-specific descriptions, not a universal standard. Confirm the exact input and consent flow for the feature you intend to use at HeyGen’s product description and its Avatar IV API announcement.

Synthesia’s Photo Avatar process is different again: its guidance says the person depicted must create the avatar directly and submit a photo matched to a consent video. The guidance is dated July 15, 2026 and applies to that feature, so do not assume another provider accepts a manager-uploaded image in the same way. See Synthesia’s Photo Avatars Content Moderation guidance.

Seven decisions to make before you open the generator

1. Define the job in one sentence

Write a sentence naming the viewer, the message, and the next action. “A new customer watches a 45-second explanation of our booking process and then opens the help page” is more useful than “make an AI video.” Identify the placement as well:

  • Internal training or an onboarding lesson
  • A product or feature explainer on your website
  • A customer-support answer
  • An organic social post
  • A paid advertisement or boosted post
  • A video embedded inside your own product

Placement changes the risk. A presenter that is acceptable in internal training may be restricted in paid promotion, and a video that looks like a customer story can imply an endorsement. Put the channel, audience, campaign dates, and intended call to action in the project brief before selecting an avatar.

2. Choose the likeness and record permission

Pick one of three deliberate routes:

  • Consenting owner or employee: Use a real person only after obtaining permission that covers creation, the script, distribution channels, duration, and paid promotion if applicable.
  • Permitted stock avatar: Use a platform-provided character only within the provider’s current license and content rules. A stock avatar is not a substitute for permission to impersonate a real person.
  • Non-identifiable generated presenter: If the platform offers one, this can avoid tying the message to a particular individual, but it still must comply with advertising, privacy, and platform rules.

Keep the permission record with the project: identify the person, the avatar feature, approved scripts or subject areas, channels, territory, end date, and whether paid media is allowed. HeyGen’s ethics statement calls for express permission to create or share generated avatars depicting individuals. Synthesia says its Photo Avatar must be created by the person shown, using a matched photo and consent video. Read the live requirements rather than treating an upload button as proof of authorization: HeyGen’s data-handling and content-authenticity statement and Synthesia’s feature guidance.

3. Match the avatar to the exact placement and provider policy

Separate stock, custom, webcam, photo, and personal avatars in your planning document. Their permissions can differ even inside one service. Synthesia’s Acceptable Use Policy restricts stock avatars in promoted, boosted, or paid social advertising unless Synthesia gives written express consent. The same policy also addresses uses that make a real-life actor appear to personally endorse a script. Its Platform Integrity guidance says authorized branded promotion can be allowed with custom or webcam avatars, subject to moderation policies, and flags undisclosed use of stock avatars to represent real people.

Policies change and can depend on the plan, avatar type, country, campaign, and platform. Save the policy version or a dated approval with your brief, and recheck it immediately before launch. “The tool generated it” is not evidence that the intended advertisement or endorsement is permitted.

4. Write a script that does not invent a person’s experience

Make the presenter’s identity and claims explicit in your copy. Do not write a fictional first-person account that sounds like a real customer describing a purchase, a named employee reporting work they did not perform, or a public figure expressing an opinion they never gave. Avoid lines such as “I used this service and it saved me three hours” unless that statement is true, documented, and authorized by the person speaking.

Use objective product language, supported results, and a clear company voice instead. If a real employee is presenting an approved company message, say so internally and retain the authorization; do not turn the avatar into a fabricated testimonial. The U.S. Federal Trade Commission’s Endorsement Guides, revised in June 2023, apply to advertising endorsements across media. The FTC explains the principles at Advertisement Endorsements. Its reviews and testimonials FAQ says there is no blanket ban on AI-generated avatars, but a deceptive portrayal or testimonial can still create FTC Act risk. This is U.S. guidance, not a complete analysis of every country or regulated sector.

5. Decide whether and how to disclose the synthetic presenter

Ask what an ordinary viewer could reasonably infer. If the video could be mistaken for a camera recording or could make viewers believe a real person personally recommends the product, plan a prominent disclosure in the video or its immediate context. Use plain wording such as “AI-generated presenter” when that accurately describes the production.

Do not assume one worldwide “AI label” rule. The FTC materials cited above address truthful advertising, endorsements, and deceptive impressions; they do not establish that every synthetic business video has the same disclosure obligation. Check the law and platform policy for the market and placement, especially for political, health, financial, employment, or high-reach advertising. Follow provider provenance requirements too: Synthesia’s policy prohibits removing mechanisms intended to validate provenance or distinguish AI-generated content.

6. Check data, retention, and workspace access

List every asset the service will receive: photographs, recorded video, voice characteristics, script text, captions, brand files, and analytics. Before uploading, answer these operational questions:

  • Who can create, edit, download, or publish avatars in the workspace?
  • Are projects and source files private by default, and can an administrator change that setting?
  • Can the provider use your files to improve models, and is consent optional?
  • How long are source recordings and generated videos retained?
  • Can you delete an avatar and its source material, and how is deletion confirmed?
  • Where are the files processed, and what contractual terms apply to your business?

HeyGen states that user data is used to improve models only with consent and that videos are private by default. Those are the provider’s stated practices, not a replacement for reviewing current privacy documentation, workspace controls, and your contract. See its data-handling statement, then have the person responsible for privacy or security approve the actual configuration. Obtain additional advice for personal data, minors, biometric information, or regulated records.

7. Make human review a release gate

Assign a named reviewer who did not create the draft. Synthesia warns that a Photo Avatar may not perfectly match the person and can show unexpected visual variations. Treat every generated file as an unapproved draft until the reviewer checks:

How the main platform choices differ

Compare services against your use case, not against a generic “best avatar” ranking. The following points are documented distinctions; verify live feature and plan details before purchase.

Decision axis HeyGen Synthesia
Input and consent Its Personal Avatar description starts with a 15-second phone video and a consent statement. Its Avatar IV API announcement describes a photo-and-script flow; confirm which product you are buying. Its Photo Avatar guidance says the depicted person must create the avatar directly and provide a photo matched to a consent video.
Use permissions Its ethics statement calls for express permission to create or share generated avatars depicting individuals. Check the current terms for stock, personal, paid, and branded uses. Stock and custom/webcam avatars have different rules. The Acceptable Use Policy restricts stock avatars in paid promotion without written express consent and addresses implied personal endorsements.
Privacy and control The provider says model-improvement use requires consent and videos are private by default. Confirm retention, deletion, administrator access, and contractual terms. Review the current workspace, privacy, retention, and provenance controls for the specific plan; the cited materials do not establish a universal setting for every account.
Production workflow Check current editor features for script revisions, languages, captions, approvals, and API handoff. Check current editor and moderation behavior for your avatar type, including how revisions affect consent and review.
Quality for your use Render a representative script and review pronunciation, movement, likeness, captions, and the complete viewer impression. Allow for the visual variation warned about in Photo Avatar guidance; judge the actual source image and script rather than a demo.
Cost and scale Current prices and limits were not established here. Compare included minutes, users, languages, storage, and API access with your publishing cadence. Current prices and limits were not established here. Compare the same capacity measures and any moderation or avatar-creation limits.
API or product integration The Avatar IV API announcement describes learning, sales and customer experience, and creative or marketing workflows. It says access is on Pro and Scale tiers with enterprise custom rates in that announcement; verify present tiers. Confirm whether the current plan exposes the integration, approval, and localization controls your product requires.

Do not convert provider descriptions into independent quality scores. A short test using your real script, names, pronunciation, aspect ratio, captions, and disclosure is more informative than a polished demo.

A practical first-video workflow

  1. Brief: Record audience, purpose, placement, campaign dates, call to action, and whether the video is organic, internal, embedded, or paid.
  2. Likeness decision: Select a consenting person, permitted stock avatar, or non-identifiable presenter. Attach the permission record or license.
  3. Policy check: Read the provider’s current acceptable-use, avatar, advertising, provenance, and privacy terms for that exact avatar and plan.
  4. Script lock: Remove invented first-person stories, unsupported outcomes, and ambiguous endorsements. Have the subject-matter owner approve factual claims.
  5. Disclosure plan: Decide what viewers need to know and where the notice will appear for each channel and jurisdiction.
  6. Data setup: Limit workspace roles, confirm privacy and retention settings, and upload only the files required for the approved production.
  7. Draft render: Generate a short representative segment before committing to a long localization or campaign batch.
  8. Review: Run the identity, script, audio, motion, caption, brand, impression, and disclosure checklist. Log defects and revisions.
  9. Approval and release: Obtain sign-off from the designated owner, export the approved version, and preserve the final asset and audit record.
  10. Monitor: If the offer, policy, avatar, or campaign changes, repeat the policy and factual review rather than reusing an old approval automatically.

Common failure modes and fixes

What goes wrong Why it matters Fix before publishing
An employee discovers their photo was used without a clear release. Permission may not cover generation, distribution, duration, or paid media. Stop production, obtain explicit written permission for the actual uses, or replace the likeness with a permitted alternative.
A stock presenter appears in a boosted social ad. Some provider policies distinguish stock from custom avatars and restrict paid promotion. Check the current policy and obtain any required written consent; otherwise change the avatar or placement.
The script says “I tried” or “I saved” when no such experience exists. Viewers can read it as a testimonial or personal endorsement. Rewrite in objective company language or use a verified, authorized account from a real speaker.
The video looks like ordinary footage, but no context identifies it as synthetic. The overall impression may mislead even if each sentence is technically true. Add a clear, context-appropriate disclosure and retain provenance features.
A name, URL, price, or acronym is pronounced incorrectly. The error damages comprehension and can make a factual claim misleading. Use pronunciation controls or phonetic text, render again, and have a human listen with captions visible.
A later editor changes the approved script. The original factual, consent, and policy review may no longer apply. Version the script and require a new review for material edits, new channels, or new claims.

When an API or larger rollout is justified

An API makes sense when generation is part of a repeatable product or content pipeline, such as localized lessons, account-specific support clips, or a high-volume creative workflow. It also increases governance requirements: define who can submit scripts, which avatars are selectable, what claims are blocked, how approvals are recorded, and how generated files are deleted. HeyGen’s Avatar IV API announcement identifies learning, sales and customer experience, and creative or marketing use cases; it describes Pro and Scale access plus enterprise custom rates in that announcement. Verify current access, rate limits, security terms, and billing directly before designing around them.

For a one-off explainer, manual generation with a short test and documented review is usually easier to control. Do not buy capacity based only on a minute allowance: also count editors, languages, storage, render time, moderation queues, API calls, and the number of review cycles your claims require.

Legal and policy boundaries to escalate

Escalate the project for current legal or compliance review when it involves political persuasion, health or financial advice, employment decisions, children, biometric or highly sensitive personal data, a celebrity or public figure, a regulated claim, or a large paid campaign. The FTC sources cited here are U.S.-specific guidance and do not replace state, non-U.S., sector, or platform rules. Provider policies are also living documents: the Synthesia materials cited include a July 15, 2026 feature page and a separate platform-integrity policy, while HeyGen’s ethics statement is effective November 13, 2023. Check the current versions and retain the date you relied on.

The go/no-go test

Publish only when you can answer “yes” to all of these questions: Do we have permission for this likeness and these channels? Does the provider permit this avatar, campaign, and plan? Are every claim and implied endorsement truthful? Is the data and access configuration acceptable? Is any needed disclosure present? Has a named human reviewed the exact final render, including captions and pronunciation? If any answer is “no” or “unclear,” pause the launch and resolve that item before generating more variations.
