AI safety testing probes how an AI system behaves under selected conditions; an AI audit independently evaluates evidence about the system or its processes against transparent criteria. Testing can produce evidence an auditor uses, but a test is not automatically an independent audit. Neither exercise, by itself, proves that a system is safe in every context or satisfies a legal conformity requirement.

The practical distinction is simple: testing asks “What happens when we give this system these inputs, attacks, users or operating conditions?” Auditing asks “Does the available evidence about performance or process meet stated criteria, and are the organization’s claims supported?” A legally required conformity assessment is a third category governed by the applicable law, system classification and assessment route.

What AI safety testing means

“AI safety testing” is not one universally binding procedure. It is a family of evidence-gathering methods used to discover undesirable behavior, vulnerabilities, performance limits and risks under defined conditions. The conditions might include ordinary user prompts, unusual inputs, adversarial attacks, particular languages, demographic groups, operating environments or changes to connected tools.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

A test always has a boundary. Its result describes the inputs, population, model or system version, environment, metrics and procedures that were actually examined. A successful result therefore supports a bounded claim, such as “the tested release met this refusal-rate threshold on this test set,” rather than the unqualified claim that the system is safe everywhere.

Red-teaming is one form of testing

The National Telecommunications and Information Administration (NTIA) March 2024 glossary defines red-teaming as “a structured testing effort to find flaws and vulnerabilities in an AI system, often in a controlled environment and in collaboration with developers of AI.” Red-teamers may probe prompt injection, unsafe instructions, data leakage, privilege escalation, harmful content or unexpected interactions with tools. Red-teaming is testing; calling it a red-team exercise does not establish that an independent audit took place.

Testing can be technical or process-focused

Technical tests can measure accuracy, robustness, calibration, toxicity, privacy leakage, security resistance, latency or reliability. Process tests can check whether required controls operate as designed, for example whether access reviews occur, incident records are complete or a model-change gate is followed. Both produce evidence, but the test itself does not decide whether the overall evidence meets an independently defined assurance criterion.

What an AI audit means

NTIA defines an AI audit as “with respect to an AI system or model, an evaluation of performance and/or process against transparent criteria.” In that glossary, “audit” is used for independent evaluations that can verify a system’s claims or assess broader trustworthy-AI attributes.

An audit therefore starts with criteria, not merely a list of probes. The criteria might cover documented performance claims, risk controls, governance, data management, security, fairness, monitoring or a combination. The auditor examines evidence, evaluates whether it is sufficient and relevant, records findings and explains the basis for conclusions. Evidence can include test results, source or configuration records, policies, logs, interviews, documentation and observations of operating controls.

Independence is a central feature of NTIA’s usage. An internal team can conduct valuable testing and can even perform assurance work under some organizational frameworks, but it should not be described as independent merely because it is called an “audit.” The responsible report should identify who performed the work, what relationships or conflicts existed, what criteria were applied and what was outside scope.

Testing, auditing and legal conformity are three different activities

Activity Primary question Typical evidence What the result does not establish
Safety or performance testing How does the system behave for selected inputs, users, attacks and conditions? Benchmarks, measurements, adversarial probes, test cases, logs and repeat runs That untested contexts are safe, that claims meet independent criteria or that a legal duty is satisfied
AI audit Does performance or process evidence meet transparent criteria, and are claims supported? Test results plus documentation review, interviews, records, controls and traceability checks That every possible failure has been found or that the system is risk-free
Legal conformity assessment Has the system followed the procedure required by an applicable law for its category and use? Prescribed technical and quality evidence, declarations, records and, where required, notified-body involvement That voluntary testing or a private audit substitutes for the legally specified route

Terminology varies among institutions. Before relying on an assessment, read its scope and methodology instead of assuming that “audit,” “evaluation,” “certification” and “red team” mean the same thing everywhere.

How the two activities answer different questions

Objective and criteria

A test has an operational objective: expose a weakness, estimate a metric, compare versions or verify a control under chosen conditions. The test protocol defines inputs, expected outcomes, pass or fail rules and measurement methods. An audit evaluates evidence against transparent criteria that may include both performance and process. It can ask whether the test protocol was appropriate, whether the results are reproducible and whether the organization’s public claim is supported by the evidence.

Scope

Testing commonly targets a model, application, feature, workflow or attack surface. An audit can cover that technical object but may also examine the surrounding data pipeline, human approvals, monitoring, incident response, supplier controls and governance. A narrow audit can be entirely legitimate; its conclusion must not be generalized to components it did not examine.

Method and evidence

Tests use benchmark sets, representative samples, synthetic cases, adversarial prompts, penetration techniques, simulations or production monitoring. Auditors may use those outputs along with document inspection, interviews, sampling of records, configuration checks and control walkthroughs. NIST emphasizes documenting test sets, metrics, tools, results and measurement methods so that an evaluator can understand what a number means and reproduce or challenge it.

Independence and conflicts

Developers often perform internal tests because they have the access and expertise needed to debug quickly. Independent review can add credibility and help mitigate internal bias or conflicts of interest. Independence is not the same as being unfamiliar with the system: an external or separate assessor still needs sufficient access, technical competence and a clearly bounded mandate.

Timing

Testing is a lifecycle activity. NIST’s AI Risk Management Framework says, “AI systems should be tested before their deployment and regularly while in operation.” Tests should be repeated after material model, data, prompt, tool, infrastructure or policy changes and when monitoring reveals a new risk. Audits are often periodic or triggered by a significant change, incident, contractual requirement or regulatory deadline. A legal conformity assessment may have a prescribed point before market placement or service and may be required again after a substantial modification.

Audience and decision

Engineers use test findings to fix a model or gate a release. Product and risk leaders use them to set residual-risk decisions and monitoring. An audit report is intended for decision-makers who need an independent conclusion about evidence and controls, such as a board, customer, regulator or procurement team. A conformity assessment supports the legal decision specified by the relevant regime.

Where testing fits in an AI lifecycle

  1. Define the intended use and unacceptable outcomes. Describe users, environments, connected tools, languages, data sensitivity and foreseeable misuse. A metric without an intended-use context can be misleading.
  2. Translate risks into testable questions. For example: Can an untrusted document cause a tool call? Does error rate differ materially across the documented user groups? Can a user recover from an unsafe or incorrect response?
  3. Choose test data and methods. Record how cases were sampled, which edge cases were added, what attack techniques were used, and what populations or languages were omitted. Keep a separate holdout set when overfitting to a public benchmark is a concern.
  4. Set metrics and decision rules. Define denominators, thresholds, confidence or uncertainty information where appropriate, severity categories and who can accept a residual risk.
  5. Run pre-deployment evaluation. Test the release candidate in an environment that reflects intended configuration, permissions, retrieval sources, tools and human review. A model-only result may not predict behavior of the integrated system.
  6. Record reproducible evidence. Preserve model and software versions, prompts, test-set identifiers, tool versions, random seeds where relevant, timestamps, environment settings, failures and remediation decisions.
  7. Fix, retest and gate. Classify failures, apply mitigations, rerun affected cases and document exceptions. Passing one run without retesting a changed component leaves the evidence stale.
  8. Monitor in operation. Track incidents, drift, abuse patterns, user feedback, error rates and newly discovered attack techniques. NIST’s lifecycle guidance treats operational testing as regular work, not a one-time release checkbox.

What an AI audit does with that evidence

  1. Agree the engagement scope. Identify the system or model, versions, intended uses, geographic or organizational boundaries, exclusions, reporting audience and assessment period.
  2. Set transparent criteria. Criteria may come from a published framework, contract, internal policy or law. State how each criterion will be interpreted and what counts as sufficient evidence.
  3. Assess independence and competence. Disclose financial, employment or design relationships that could affect judgment. Confirm that assessors understand the model, domain and applicable requirements.
  4. Map claims to evidence. For every material claim, identify the test, record, control owner and date supporting it. Check whether the evidence covers the actual deployment rather than a laboratory prototype.
  5. Sample and verify. Inspect selected records, configurations, change approvals, incidents, test cases and monitoring results. Interview responsible staff and follow discrepancies to their source.
  6. Evaluate limitations. Note untested populations, missing logs, incompatible metrics, weak sampling, stale results, unresolved incidents and assumptions that restrict the conclusion.
  7. Report findings and conclusion. Separate observations, nonconformities, recommendations and areas outside scope. Explain the criteria, evidence, uncertainty and any management response rather than presenting a bare pass label.
  8. Follow up. Verify corrective actions or schedule a subsequent review. An audit report is a point-in-time evaluation; it does not replace operational monitoring.

How testing and auditing work together

Testing and auditing are complementary. A well-designed test supplies empirical evidence; an audit checks whether the test was appropriate, controlled, documented and interpreted honestly. Independent review can also improve the test plan by exposing blind spots, conflicts of interest or metrics that do not reflect the deployment.

For example, a team might red-team a customer-support assistant for prompt injection and measure successful unauthorized tool calls. An auditor could then verify the system version tested, inspect the sampling and severity rules, review whether production permissions match the test environment, examine incident handling and assess the resulting evidence against transparent security and governance criteria. The audit does not turn the measured rate into a universal safety guarantee; it gives decision-makers a reasoned conclusion about the defined scope.

What the EU AI Act changes about conformity assessment

A private test or audit is not automatically the conformity assessment required by the European Union’s AI Act. The Act’s procedures depend on the system category, use context and applicable route. High-risk systems require conformity assessment before market placement or service, but the procedure varies.

Internal control and notified bodies

Article 43 provides internal-control routes for certain Annex III categories and involves a notified body in specified cases. It is therefore incorrect to say that every high-risk assessment must be performed by an external notified body, just as it is incorrect to say that every internal test satisfies the Act. The organization must identify the relevant category and follow the procedure, technical documentation, quality controls and declarations that apply to it.

Substantial modifications

A substantial modification can trigger a new conformity assessment, subject to the qualifications in the Act. Change management should therefore record what changed, why it could affect compliance, which tests were repeated and whether the applicable assessment route changed.

General-purpose AI model evaluations

The EU AI Office has legal powers to evaluate general-purpose AI models for defined compliance or systemic-risk purposes. The Commission may appoint independent experts and request access through APIs or other technical means, including source code. This is a regulatory evaluation power, not a synonym for a vendor’s ordinary safety testing or a private audit.

The evidence an assessor should expect

NIST’s measurement guidance supports evidence that is contextual, repeatable and traceable. A practical evidence package commonly includes:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Intended use, system architecture, model and dependency versions, deployment configuration and user populations.
  • Test-set composition, sampling rationale, exclusions, prompts or attack scripts, tools, metrics, thresholds and measurement procedures.
  • Raw or reproducible results, aggregation rules, uncertainty information where used, failed cases and remediation history.
  • Data provenance, labeling or annotation instructions, privacy and security controls, access records and retention rules.
  • Change-management approvals, release gates, monitoring dashboards, incident reports, user complaints and corrective actions.
  • Policies defining roles, escalation, human oversight, supplier responsibilities and acceptance of residual risk.
  • Assessor qualifications, independence disclosures, criteria, sampling plan, limitations and final findings.

Documentation should identify the conditions under which a result was obtained. A benchmark score from an isolated model cannot automatically represent an integrated product with retrieval, tools, filters, human review or different permissions.

Choosing the right activity for a decision

Decision you need to make Most useful first step Additional assurance often needed
Should this release proceed to a controlled pilot? Targeted pre-deployment tests against intended use and high-severity failure modes Independent review of test design when incentives or consequences are significant
Did a mitigation reduce a known vulnerability? Repeat the affected test with the same and expanded cases Audit trail linking the change, results and release decision
Can we substantiate a public performance or trustworthy-AI claim? Tests and measurements that directly operationalize the claim Independent audit of criteria, evidence, sampling and wording
Do we meet a legal AI requirement? Classify the system and identify the applicable legal conformity route Required documentation, declarations and notified-body work where the law specifies it
Are controls operating across a large organization? Control testing and evidence sampling Independent audit with a defined scope and follow-up

Use the narrowest claim supported by the evidence. If testing covered only a model in a sandbox, report that scope. If an audit excluded suppliers or production monitoring, say so. If a legal route was not followed, do not present a voluntary report as legal approval.

Common mistakes and how to correct them

Calling every internal test an audit

Problem: The same development team tests its own release and labels the result an audit. Correction: Call it testing, disclose the team’s role and, when independent assurance is needed, commission a review with transparent criteria and conflict disclosures.

Treating one benchmark as proof of safety

Problem: A favorable score is generalized to users, attacks or environments not represented in the set. Correction: Report the population, conditions, metrics, failures and exclusions, then add tests that reflect actual deployment.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Testing only before launch

Problem: New data, users, attacks, dependencies or model updates invalidate an old result. Correction: Establish recurring operational tests, incident-triggered evaluations and retesting after material changes.

Assuming an audit guarantees safety

Problem: Readers interpret an audit opinion as a warranty against unknown failures. Correction: State the criteria, time period, evidence, limitations and residual risks. An audit evaluates the defined evidence; it cannot eliminate uncertainty.

Confusing a voluntary report with legal conformity

Problem: A company presents a red-team report or private audit as proof of compliance with the EU AI Act. Correction: Determine the system category and applicable procedure, then complete the legally prescribed conformity steps.

Ignoring deployment context

Problem: The test environment has different tools, permissions, prompts or human review from production. Correction: reproduce the intended configuration or clearly identify the gap and treat the result as limited evidence.

A concise checklist for reviewing an assessment

  • Is the object of assessment clearly identified by model, system, version and deployment?
  • Are intended uses, users, environments and excluded contexts stated?
  • Are criteria, metrics, thresholds and decision rules transparent?
  • Can another qualified person reproduce or challenge the testing?
  • Does the evidence include failures, exceptions and remediation, not only aggregate scores?
  • Were tests performed before deployment and regularly during operation?
  • Are assessors independent enough for the decision, and are conflicts disclosed?
  • Does the conclusion distinguish testing, independent audit and legal conformity assessment?
  • If EU AI Act compliance is claimed, is the system category and Article 43 route identified?
  • Are conclusions limited to the conditions and period actually examined?

Current framework note

NIST’s 2026 TEVV-Athlon draft describes a flexible way to build assessments around organizational objectives because AI applications and measurement needs differ. The draft comment period opened August 7, 2026, and closed October 6, 2026. As of October 13, 2026, it should be treated as a draft framework, not a final standard or a universal legal requirement.
