Automated mortgage underwriting is usually a recommendation or processing path, not an all-powerful robot that makes every final decision. A lender may run your application through an automated underwriting system (AUS), have a human underwriter review the file, or use both. The exact sequence depends on the lender, loan program, and applicable rules.

If an automated result contributes to a denial or less favorable terms, you are still entitled to a specific, accurate explanation of the principal reasons. You can check the underlying data, seek corrections, ask how a human reviewed the file, and pursue a fair-housing complaint if you believe discrimination occurred.

What “AI mortgage underwriting” actually means

Mortgage lenders use software to evaluate information such as income, assets, debts, credit history, loan amount, property details, and program rules. The software may be a traditional statistical scorecard, a rules engine, a machine-learning model, or a combination. “AI underwriting” is therefore not one standardized product, and it does not necessarily mean generative AI.

The system’s role also varies. It might:

  • calculate risk measures and return an eligibility recommendation;
  • route the file to a particular documentation or processing channel;
  • identify missing or inconsistent information;
  • support a lender’s own credit decision; or
  • evaluate a specific requirement while a person makes the final decision.

The Government Accountability Office reported in 2025 that the automated underwriting systems used by Fannie Mae and Freddie Mac do not use AI to make loan-purchase eligibility decisions, although some inputs use machine learning. GAO also noted that lenders may use third-party algorithmic systems to assess borrower risk and inform credit decisions. That distinction matters: an automated recommendation is not automatically a final approval or denial.

A lender should be able to tell you which system produced a finding, what role it played, and whether a human underwriter reviewed your file. Ask those questions rather than assuming that a screen result was the entire decision.

How an automated and human review can fit together

A typical file can move through several stages. The labels differ by lender, but the logic is often similar:

  1. Application and data collection: You provide information about income, employment, assets, debts, credit, the property, and the requested loan.
  2. Automated evaluation: An AUS applies the loan program’s rules and risk model and returns a finding, conditions, or a documentation path.
  3. Exception and quality checks: The lender checks for data mismatches, fraud indicators, missing documents, or requirements that the automated result cannot resolve.
  4. Human underwriting: A person may review the file initially, after an automated “refer” result, after a downgrade, or whenever the lender’s procedures require it.
  5. Final action: The creditor approves, conditions, counteroffers, or denies the application and sends disclosures required by law.

Some conventional and government programs are designed to accept many files through an AUS with limited manual work. Other files require a full manual review because of program rules, a credit history issue, a high debt ratio, unusual income, conflicting documentation, or an automated finding that does not satisfy a requirement.

FHA TOTAL: a concrete example of an automated finding

The Federal Housing Administration’s Technology Open To Approved Lenders (TOTAL) Mortgage Scorecard illustrates why “the algorithm denied me” can be an oversimplification. HUD describes TOTAL as a statistical algorithm that evaluates credit history and application information. Lenders access it through an AUS; HUD expressly says TOTAL itself is not an AUS.

TOTAL returns one of two broad processing classifications:

Finding What it generally means in FHA processing Human involvement
Accept The file generally follows the automated underwriting path. Manual underwriting is usually avoided unless a required manual downgrade applies or another FHA rule requires it.
Refer The file does not receive an Accept finding from TOTAL. The lender must send it to an FHA Direct Endorsement underwriter for manual underwriting under FHA requirements.

These meanings come from HUD’s FHA TOTAL materials. They do not mean that TOTAL alone can approve or deny an FHA-insured mortgage. HUD states that an FHA mortgagee may not accept or deny a loan solely on the TOTAL result. Every FHA loan must be underwritten under FHA Handbook 4000.1, including any applicable manual-downgrade rules.

FHA operational details can change. HUD updated FHA materials and credit-score implementation information in 2026, so confirm the current TOTAL page, Mortgagee Letters, and Handbook 4000.1 for the date and loan type involved.

When a human underwriter may review your file

Human review is not limited to a denial. A person may examine a file to verify an automated finding, resolve an exception, or make the judgment required by a program’s rules. Common triggers include:

  • an FHA TOTAL “Refer” finding or a required manual downgrade;
  • income that is variable, self-employed, commission-based, newly started, or difficult to document;
  • recent job changes, gaps in employment, or conflicting employment records;
  • debts, assets, or deposits that need a documented explanation;
  • credit-report errors, thin credit, disputed accounts, or a recent major derogatory event;
  • property, occupancy, appraisal, or title issues that the scorecard cannot resolve;
  • data mismatches between your application, documents, credit report, and public records; or
  • a lender’s internal quality-control or fraud-prevention review.

The existence of an AUS does not create a universal right to demand manual underwriting. The sources cited here do not establish a general human-appeal entitlement for every mortgage product. You can request reconsideration and ask whether a human can review the file, but the lender may be permitted to rely on its program and underwriting procedures.

Can a lender deny a mortgage based on an algorithm?

An algorithm can contribute to an adverse decision, but it does not remove the creditor’s legal responsibilities. The Consumer Financial Protection Bureau’s Circular 2022-03 explains that the Equal Credit Opportunity Act and Regulation B require creditors to give applicants a statement of the specific principal reasons for adverse action, even when a complex algorithm makes the reasons difficult to identify. The CFPB states:

“Whether a creditor is using a sophisticated machine learning algorithm or more conventional methods to evaluate an application, the legal requirement is the same: Creditors must be able to provide applicants against whom adverse action is taken with an accurate statement of reasons.”

Read the full CFPB Circular 2022-03 for the requirement and examples. In a 2023 announcement, CFPB Director Rohit Chopra summarized the point: “There is no special exemption for artificial intelligence.” The CFPB guidance on credit denials using artificial intelligence also warns against generic checklist explanations that do not reflect the factors actually considered.

A notice saying only “internal standards were not met” may be inadequate if it fails to identify the principal factors that actually drove the decision. The reasons must be specific and accurate, not a post-hoc label chosen because a model is complicated.

What an adverse-action notice should tell you

When a creditor takes adverse action, the notice should identify the principal reason or reasons for the action in a way that is useful to you. Depending on the product and circumstances, the notice may also explain how to obtain information about the decision or the right to request additional details.

Use the notice as a diagnostic document:

  1. Write down each stated reason exactly as provided.
  2. Compare those reasons with your application, pay records, bank statements, debts, and credit reports.
  3. Ask the lender to explain any unfamiliar term or reason and whether it came from the AUS, a human underwriter, or both.
  4. Identify information that is wrong, incomplete, outdated, or attached to the wrong person.

The CFPB explains that specific reasons can help a consumer improve credit standing or correct misinformation or inadequate information. Its discussion of adverse-action notices for AI and machine-learning models describes why a lender cannot use model complexity as an excuse for an unhelpful explanation.

How to respond if the automated result seems wrong

1. Request the decision path

Ask the loan officer or lender’s underwriting contact:

  • Which AUS, scorecard, or other automated tool produced the finding?
  • Was the result an eligibility recommendation, a processing route, or part of the final credit decision?
  • Did a human underwriter review the file? If so, what issues did that person consider?
  • Which documents or data points were decisive?
  • Is reconsideration, resubmission with corrected data, or manual underwriting available for this loan program?

2. Check the application and credit information

Review names, Social Security number, addresses, employment dates, income, debts, limits, balances, payment history, and public-record information. A single transposed digit, duplicated debt, stale balance, or missing asset can change an automated finding. Compare the adverse-action reasons with the actual entries rather than relying on a verbal summary.

3. Correct inaccurate information

Tell the lender promptly which data is wrong and provide documents that support the correction. If the error appears on a credit report, use the dispute process identified by the reporting company and keep copies of the dispute and supporting records. Ask the lender whether it can rerun the application after the correction and what documentation it needs.

4. Ask for reconsideration without assuming it is guaranteed

A lender may have a reconsideration, exception, or resubmission process. Request the applicable procedure in writing, including deadlines and required documents. A request does not guarantee a different result, and no general rule gives every borrower an automatic right to a new human review.

Ability-to-repay duties still apply

Regulation Z requires a creditor to make a reasonable, good-faith determination that a consumer can repay a covered mortgage. The rule addresses information such as income or assets, debts, and the mortgage payment, along with underwriting standards and evidence bearing on whether the determination was reasonable.

An automated score can help organize or evaluate those facts, but it does not transfer the creditor’s responsibility to a machine. The current text of Regulation Z § 1026.43 is the reference for the 2026 edition and should be read with the requirements applicable to the specific mortgage transaction.

AI versus human review: what can and cannot be compared

There is no government-established statistic in the cited material showing that automated underwriting is universally more accurate, fairer, or safer than human underwriting. A sensible comparison focuses on the lender’s process rather than on the marketing label.

Question Why it matters What to ask
Decision role A scorecard may recommend a path without making the final decision. Does the system recommend, route, or decide eligibility?
Human involvement Some findings require or trigger manual underwriting; others do not. When does a human review the file, and who can review an exception?
Explanation Adverse-action reasons must reflect the principal factors actually considered. Can the lender explain the specific reasons in plain language?
Data and corrections Wrong or incomplete inputs can produce a wrong result. What data was used, and how can an error be corrected and rerun?
Repayment and fair lending Automation does not eliminate ability-to-repay or anti-discrimination duties. How does the process document repayment ability and fair-lending compliance?

Automated methods can process files quickly, apply rules consistently, and evaluate more data. They can also reproduce errors at scale. CFPB materials identify potential risks including biased source data or models, unlawful discrimination, privacy concerns, lack of transparency, and inaccurate predictions. Those are documented risks and possibilities, not proof that any particular lender’s model produced an unfair result.

Do not confuse underwriting models with automated property valuations

A borrower-risk or credit-underwriting model evaluates the applicant and the loan terms. An automated valuation model (AVM) estimates the property’s collateral value. They answer different questions and can be operated by different systems.

The CFPB’s interagency summary of the final rule on quality-control standards for automated valuation models describes controls for covered AVMs, including confidence in estimates, protection against data manipulation, conflicts of interest, random-sample testing and review, and nondiscrimination. Those AVM safeguards do not turn an appraisal estimate into a borrower credit decision, and an underwriting scorecard is not an AVM.

Practical questions to ask before choosing or continuing with a lender

You do not need to choose between an “AI lender” and a “human lender” as if they were two standardized categories. Instead, compare the process you will actually receive:

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.
  • Which AUS or automated tools are used for this loan program?
  • What does an Accept, Refer, or similar finding mean in this program?
  • When is a manual underwriter required, and when is one available by request?
  • What documents are most likely to resolve an exception or conditional approval?
  • How are data errors corrected and how quickly can the file be rerun?
  • Who provides the adverse-action notice and the specific reasons?
  • How can you request reconsideration or escalate a service problem?
  • How does the lender protect private application and credit information?

Answers should be specific to the lender, loan type, and property—not broad promises that “the computer decides” or that every file receives a personal review.

Key takeaways for borrowers

  • Automated underwriting is a category of tools, not a single universal AI process.
  • Its output may be a recommendation or processing path rather than the final lending decision.
  • FHA TOTAL returns Accept or Refer classifications through an AUS; FHA lenders must still follow Handbook 4000.1 and cannot rely on TOTAL alone to accept or deny a loan.
  • A human underwriter may review a file because of a program rule, a Refer finding, a manual downgrade, an exception, or lender policy.
  • A creditor must give specific, accurate principal reasons for adverse action even when a complex algorithm is involved.
  • Regulation Z’s reasonable, good-faith ability-to-repay requirement remains the creditor’s responsibility.
  • Check the notice and underlying data, seek corrections, ask about reconsideration, and contact HUD if you believe mortgage discrimination occurred.
