AI governance is the system an Australian business uses to decide where artificial intelligence may be used, who is accountable, what safeguards are required, and how performance is checked over time. It is not a one-off policy or a large specialist department. Controls should match the use case, the sensitivity of the data and the possible consequences of an error. A low-risk drafting assistant needs a lighter process than an AI system influencing credit, employment, health or access to services.

The practical starting point is the Australian Government’s Essential AI Practices. Its foundations material is aimed at organisations beginning with AI or using it in lower-risk ways; the implementation guidance is for teams building or customising systems and for more complex or higher-risk use. Privacy duties apply both to personal information entered into an AI product and to personal information in its output.

What AI governance means in an Australian business

Governance turns a general intention to “use AI responsibly” into operational decisions. It defines approved purposes, prohibited uses, decision rights, testing, human review, records, incident response and supplier obligations. The board or senior leadership sets the direction, while procurement, security, privacy, legal, risk, technology and frontline teams carry out the controls.

Accountability does not move to a software vendor simply because the model is hosted elsewhere. business.gov.au puts the point plainly: “Your business is responsible for everything your AI tools do.” Read that statement in the context of the business.gov.au AI guidance and the obligations that apply to your organisation, industry and location.

Good governance is continuous. A model update, new data source, changed vendor terms, expanded user group or new decision purpose can change the risk profile and trigger a fresh review.

Choose the right Australian Government guidance track

The National AI Centre provides two related tracks, not competing certification schemes. Use the foundations material to establish basic discipline, then move to implementation guidance as systems become more consequential or technically complex.

Decision factor Foundations guidance Implementation guidance
Typical organisation or stage New to AI, or using established tools for lower-risk work Building, customising or operating complex systems, including higher-risk uses
Examples Internal drafting, summarising non-sensitive documents, low-impact productivity support Automated recommendations, systems affecting individuals, custom models, integrations with critical workflows
Control emphasis Clear ownership, an AI register, proportionate assessment, privacy and human checks Stronger testing, monitoring, oversight, documentation, incident management and supply-chain accountability
How to use it Adapt the practices to organisational size, use cases and risk Apply deeper evidence and control maturity as consequence, uncertainty or system complexity rises

Start with the foundations guidance. Consult the implementation guidance when your team develops or materially customises a system, makes decisions about people, handles sensitive information at scale, or cannot readily detect and correct failures. The implementation page identifies guidance material published 5 May 2026; check the live page for the current version before relying on a document.

A six-step governance framework

1. Name an accountable owner

Give one senior person authority to set the organisation’s AI direction and accept or reject material risks. The owner need not be a full-time AI executive. In a small business it may be a director or operations leader; in a larger organisation it may be a risk, technology or digital executive supported by a cross-functional group.

MacBook screen cleaner, monitor cleaner or screen cleaner spray for electronic devices with microfiber cleaning cloth
  • Define who approves new use cases and exceptions.
  • Assign operational tasks to the teams selecting, procuring, developing and using each tool.
  • Set escalation routes for privacy incidents, unsafe outputs, security events and unexplained model behaviour.
  • Record the accountable owner and review date for every material use case.

The Essential AI Practices treats clear accountability and governance as core practices. Responsibility should be visible in job descriptions, approval records and contracts, not just in a policy document.

2. Create an AI register

Inventory actual use, including informal experimentation that has become part of daily work. The register can be a controlled spreadsheet or an existing risk-management system. The official business announcement notes that the guidance includes an AI register template; use the business.gov.au announcement to locate the current material.

Capture at least:

  • tool, model or system name and supplier;
  • business purpose and affected process;
  • business owner and technical owner;
  • types and sensitivity of data entered, retrieved or generated;
  • people or groups affected by outputs;
  • whether outputs inform, recommend or automatically trigger an action;
  • human review, challenge and override arrangements;
  • testing evidence, known limitations and incidents;
  • contractual terms covering data use, retention, access, security and notification; and
  • approval status, next review date and retirement conditions.

Require staff to register a tool before it is connected to business data or used for an external decision. Keep a separate record of rejected or retired uses so that an old integration cannot quietly return.

3. Assess each use case, not just the product

Risk comes from what a system does in context. The same general-purpose model may be low risk for brainstorming and high risk when its output ranks job applicants. Assess the intended purpose, affected people, data, error modes and available remedies.

  1. Describe the action. State precisely what the AI receives, produces and causes a person or system to do.
  2. Identify affected parties. Include customers, employees, applicants, children, vulnerable people and bystanders whose information may enter the workflow.
  3. Estimate harm. Consider the seriousness and likelihood of financial, physical, discriminatory, privacy, security, reputational or service-access harm.
  4. Check human control. Decide whether a trained person can understand the output, verify it, override it and explain the final decision.
  5. Test failure paths. Ask what happens when data is missing, the model is unavailable, an output is confidently wrong, or a malicious prompt manipulates the system.
  6. Set the control level. Require stronger evidence, approvals and monitoring where consequences, uncertainty, scale or irreversibility are greater.

Document why the selected controls are proportionate. A simple use may need an approved tool, staff training and sampling. A consequential use may require formal validation, bias and robustness testing, independent review, detailed logs, continuous monitoring and a tested shutdown procedure.

4. Protect data and privacy

Before staff paste personal information into a commercial AI service, establish what is collected, where it goes, how it is used, how long it is retained, who can access it and whether the proposed use is compatible with your privacy obligations. Do not assume that a “business” account automatically permits every data type or use.

The Office of the Australian Information Commissioner (OAIC) states that privacy obligations can apply to personal information supplied in prompts and to AI-generated output that contains personal information. Its Guidance on privacy and the use of commercially available AI products was published 21 October 2024 and updated 17 January 2025.

  • Minimise data: remove identifiers or use synthetic examples where the task permits.
  • Control access with identity, role-based permissions and logging.
  • Check whether supplier terms allow prompts or outputs to train a shared model.
  • Define retention and deletion arrangements for prompts, files, embeddings, logs and outputs.
  • Assess overseas disclosures, subcontractors, security controls and breach notification terms where relevant.
  • Update privacy notices and policies so people receive clear information about material AI use.

OAIC’s commercial-product guidance focuses on Privacy Act compliance and is not a complete checklist for every sector or regulatory regime. The Privacy Act’s application depends on the organisation and circumstances; obtain current OAIC guidance and qualified advice for a specific deployment.

5. Set human oversight and transparency rules

Write down when a human must check an output, what competence that reviewer needs and what evidence they must record. Review should be meaningful: a person who merely clicks “approve” without time, information or authority to disagree is not effective oversight.

  • For customer-facing chatbots, provide a clear route to a human and identify that the user is interacting with AI.
  • For recommendations affecting a person, require review of relevant source information and a reasoned decision independent of the model’s confidence score.
  • For high-impact or irreversible actions, prohibit fully automated execution unless the organisation has specifically justified and controlled it.
  • Give staff a way to report unsafe, biased, inaccurate or privacy-invasive outputs without penalty.

Explain AI involvement in notices and policies in language users can understand. OAIC advises clear and transparent information about AI use, including identifying public-facing tools such as chatbots.

6. Review, monitor and improve

Approval is the beginning of operation, not the end of governance. Define measures that reveal whether the system remains suitable: accuracy for the real task, error and appeal rates, disparate outcomes, privacy incidents, security alerts, override frequency, latency, cost and drift in input data.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Set review triggers for model or software updates, changed supplier terms, new data, a new population of affected people, a material incident, a complaint trend or a change in purpose. For complex or higher-risk uses, the implementation guidance calls for stronger testing, monitoring, oversight and supply-chain controls. Keep versioned records so an investigator can reconstruct which model, prompt, data and reviewer produced an outcome.

Vendor due diligence before procurement

Do not select an AI product solely on a demonstration or a high-level accuracy claim. OAIC recommends checking whether a product is suitable for the intended use, whether it has been tested for that use, how human oversight can be embedded, the privacy and security risks, and who can access personal information entered or generated.

  1. Define the use case and data boundary. Give the supplier a written description of permitted inputs, outputs, users, jurisdictions and prohibited content.
  2. Request evidence. Ask for testing methodology, limitations, known failure modes, security documentation, accessibility information and change-management practices.
  3. Inspect data terms. Clarify training use, ownership, retention, deletion, backups, subprocessors, access by support staff and handling of prompts and outputs.
  4. Test in a controlled environment. Use representative but non-sensitive data first. Test ordinary, edge, adversarial and failure cases, and involve the staff who will operate the system.
  5. Contract for accountability. Include audit or assurance rights, incident notification, service levels, update notice, cooperation with complaints and regulator inquiries, exit assistance and secure data return or deletion.
  6. Plan exit. Identify how workflows continue if the service is unavailable, changes materially, becomes unsuitable or is withdrawn.

A supplier’s assurance is evidence for your assessment, not a transfer of your responsibility. Reassess when the vendor changes the model, terms, hosting location or subprocessors.

Match controls to common Australian business scenarios

Scenario Key risks Baseline controls When to escalate
Internal drafting or summarising public material Inaccurate statements, confidential text accidentally included Approved account, no personal or confidential data, user verification and attribution checks When outputs are sent externally without review or fed into regulated decisions
Customer-service chatbot Misleading advice, disclosure of personal information, inaccessible service Clear AI notice, human hand-off, approved knowledge base, conversation logging and privacy review When it can change accounts, make eligibility decisions or handle sensitive matters
Recruitment screening Discrimination, opaque rejection, inaccurate ranking and privacy harm Validated criteria, bias testing, human decision-maker, candidate challenge route and retention limits Before deployment at scale or where a score automatically excludes applicants
Custom model using customer or employee data Model leakage, security compromise, drift, supply-chain and regulatory exposure Formal risk assessment, data governance, robust testing, access controls, monitoring, incident and rollback plans Use the implementation track and obtain specialist legal, privacy and technical review

A practical adoption sequence for a small or mid-sized business

  1. First 30 days: appoint the accountable owner, publish an interim acceptable-use rule, survey existing tools and create the register.
  2. Days 31–60: classify each use, stop unapproved personal-data inputs, complete privacy and supplier checks for priority tools, and train users on verification and reporting.
  3. Days 61–90: approve low-risk uses with documented controls, run representative tests, establish incident and human-escalation procedures, and report material risks to leadership.
  4. After launch: monitor the measures defined for each use, review on trigger events, retire tools that cannot meet the required controls, and move complex or consequential systems to implementation-level governance.

This sequence is a management pattern, not a statutory deadline. Adapt it to the organisation’s size, sector, data and risk profile.

Special offer. See more information about Outbyte and uninstall instructions. Please review EULA and Privacy policy.

Common governance failures and fixes

  • Shadow AI: staff use unapproved tools because the approved process is slow. Offer a safe, usable pathway and monitor access rather than relying on a ban.
  • Product-first approval: a tool is approved for every purpose after one successful demo. Approve defined use cases and reassess when purpose or data changes.
  • Human-in-the-loop theatre: reviewers lack time or authority to challenge outputs. Set review criteria, training, workload limits and an escalation route.
  • Policy without evidence: the organisation says it tests models but cannot show results. Store test cases, versions, decisions, incidents and corrective actions.
  • Ignoring suppliers: procurement checks price and features but not training use, retention or exit. Make AI-specific questions and contractual terms mandatory.
  • One-time privacy review: the model, data or audience changes after approval. Use change triggers and a scheduled reassessment.

Where the official guidance ends

The National AI Centre material is practical Australian Government guidance, not a universal licence to deploy any system. OAIC’s product guidance addresses privacy questions but does not cover every obligation under employment, discrimination, consumer, financial-services, health, security, records or state and territory law. A deployment may also involve contractual duties, professional standards or rules imposed by a regulator or customer.

Before a high-impact deployment, obtain advice suited to the organisation and jurisdiction, and preserve a clear record of the assumptions, evidence and approvals behind the decision. Recheck the live government pages for updated guidance, templates and dates as the Australian framework develops.
