Short answer: An AI-generated athlete advertisement is not automatically authorized, truthful, or compliant. For a U.S. campaign, a brand must clear two separate questions: does it have permission to use the athlete’s identity and any team, league, event, uniform, or other protected material; and does the finished message meet advertising rules on truthfulness, substantiation, testimonials, and material-connection disclosures? The fact that software created the image, voice, or video does not answer either question.
The Federal Trade Commission (FTC) says endorsements must be truthful and not misleading across media, while FTC staff says the 2024 Consumer Reviews and Testimonials Rule has “no blanket prohibition on the use of AI-generated avatars in marketing.” That statement is not a license to imitate a real athlete, imply product use that never occurred, or omit a required disclosure. Name, image, and likeness (NIL) protections generally arise under state law, vary by state, and can be supplemented by contract, league, union, school, team, and platform rules.
This is a U.S.-focused practical framework based on FTC and U.S. Patent and Trademark Office (USPTO) material current to October 13, 2026. It is not a determination of the law for a particular athlete, jurisdiction, or campaign.

A licensed sports advertisement starts with an identified rights holder and a negotiated permission. A synthetic campaign may start with a prompt, stock footage, or a digital model, but if viewers can recognize a real athlete—or reasonably believe the message comes from one—the same identity, publicity, trademark, and advertising questions arise. AI changes how the content is produced; it does not erase the rights attached to the person or the claims made to consumers.

Keep these approvals separate in the campaign file:
- Identity authorization: permission for the athlete’s name or nickname, photograph or video likeness, voice, catchphrase, signature move, and any digital replica or altered performance used.
- Organizational rights: permission for team, league, event, school, uniform, stadium, trophy, logos, or other protected material that appears or is audible. The reviewed federal sources do not establish who controls a particular mark, so confirm it with the relevant rights holder.
- Advertising compliance: a truthful, non-misleading message supported by evidence, with material connections disclosed where consumers encounter the endorsement.
- Operational control: agreed limits on media, territory, term, edits, synthetic generation, approval, monitoring, takedown, and future reuse.
A signed athlete agreement may solve only the first and part of the fourth item. It does not make an unsupported performance claim true, and a team license may not authorize an individual’s voice clone.
What the FTC rules mean for an AI athlete ad
Endorsements must be truthful and substantiated
The FTC’s endorsement overview explains that endorsements must be truthful and not misleading. Its guidance says an endorser should not claim experience with a product they have not had, and objective advertising claims need substantiation. The FTC summarizes the principle this way: “Endorsements are an important tool for advertisers, and they can be persuasive to consumers. But the law says they also have to be truthful and not misleading.” See the FTC Advertisement Endorsements guidance.

That rule applies whether the athlete speaks on camera, appears as a computer-generated replica, or is represented by a voice model. A script such as “I use this recovery product after every game” communicates personal experience. If the real athlete never used it, the brand should not put that statement in the athlete’s mouth or use a visual designed to create the same impression. Changing the face or voice with AI does not turn a testimonial into neutral product narration.
Claims about performance, safety, speed, accuracy, health effects, or superiority require evidence appropriate to the claim. Separate the athlete’s opinion from an objective promise: “I like the flavor” is an experience claim that must be genuine; “reduces recovery time by 30 percent” is an objective claim that needs reliable substantiation before publication.

An AI avatar is not categorically banned
FTC staff’s Consumer Reviews and Testimonials Rule Questions and Answers says the rule has “no blanket prohibition on the use of AI-generated avatars in marketing.” The Consumer Reviews and Testimonials Rule took effect October 21, 2024. Staff also explains that a testimonial is an advertising message consumers are likely to believe reflects the opinions, beliefs, or experience of a consumer or celebrity who purchased, used, or otherwise experienced the product, service, or business.
The absence of a blanket ban is narrow. The staff Q&A is not definitive or comprehensive and does not create a safe harbor. It discusses the scope of that rule, not whether a particular athlete was copied lawfully, whether the ad is deceptive, or whether another state or federal rule applies. FTC staff also notes that the rule’s disclosure requirements are limited to certain company-insider situations; an influencer or athlete disclosure failure can still violate the FTC Act even when that specific rule does not apply.
Material connections must be obvious where the endorsement appears
Payment is not the only connection that matters. FTC staff’s Disclosures 101 for Social Media Influencers identifies financial relationships, free or discounted products or services, personal or family relationships, and employment relationships as examples of material connections. The connection should be obvious to the audience, and the disclosure should be easy to see and understand in the same place consumers encounter the endorsement.
For a short social video, put a clear disclosure in the video and, where relevant, in the accompanying caption rather than hiding it behind a profile link or after a “more” cut. For an audio spot, say the relationship in the audio. For a livestream, repeat the disclosure when the endorsement returns after a break. Labels should use plain language such as “Paid partnership with [brand]” or “Ad,” provided the platform presentation makes the label conspicuous and understandable. A disclosure that the image is AI-generated may help prevent confusion, but it does not replace disclosure of payment or another material connection.
What rights a brand may need to license
NIL is broader than a photograph
The USPTO’s Name, image, and likeness guidance describes NIL as identifying attributes that can include a name or nickname, image in photographs and video, voice, catchphrase, and signature move. A campaign can use several of these at once even when the athlete’s face is stylized or partly obscured. A recognizable voice, celebration, or catchphrase can create a rights issue without a conventional headshot.

NIL protections generally arise under state law and vary by state. The USPTO says there is not yet a federal personality-rights law. A state may protect commercial use during a person’s life, after death, or through different statutory and common-law remedies; the applicable result depends on the athlete, the conduct, and the jurisdiction. Obtain state-specific advice instead of assuming that a license valid in one state covers every market.
Trademark protection does not replace a likeness license
An athlete’s name, image, or likeness can also function as a trademark when consumers use it to identify the source of goods or services. Trademark registration has its own requirements and does not substitute for permission to use the person’s identity. Conversely, a likeness release does not automatically authorize a registered team, league, event, or sponsor mark.
Inventory every recognizable element: jersey design, team colors used as a source identifier, league insignia, event title, stadium signage, championship trophy, broadcast footage, music, and other people in the scene. The federal materials reviewed here do not determine ownership or licensing authority for those elements. Confirm each one with the relevant rights holder and the campaign agreement.
A digital-replica clause should be explicit
The USPTO recommends that contracts and licenses explicitly address AI-generated depictions and digital replicas. In practical drafting, identify the approved attributes and uses rather than relying on a general “likeness” sentence. The following points are drafting considerations, not a universal statutory checklist:
- Which name, image, voice, movement, catchphrase, statistics, biographical facts, and other attributes may be modeled.
- Whether the model may create new speech, gestures, game footage, or combinations that never occurred.
- Approved media and formats, such as television, paid social, organic social, websites, retail screens, audio, games, or virtual events.
- Territory, languages, term, renewal, exclusivity, and whether the brand may reuse the asset after the campaign ends.
- Permitted editing, upscaling, aging, wardrobe, body substitution, compositing, and safety restrictions.
- Who reviews scripts, prompts, renders, voice outputs, captions, and final cuts, and how quickly objections must be handled.
- Security, access, watermarking or provenance practices, incident response, takedown rights, and destruction or return of model files.
- Approvals and remedies if a platform, league, school, union, or state law changes during the term.
Do not assume that permission to use a real interview authorizes training a voice model, generating new statements, or creating future campaigns. Ask the rights holder to state those permissions directly.

AI-generated versus licensed sports advertising: a decision framework
| Question | Synthetic campaign | Licensed athlete campaign |
|---|---|---|
| Who appears or speaks? | A generated or altered person, possibly identifiable as a real athlete. | The contracted athlete, or an approved replica if the contract expressly allows it. |
| Identity authorization | Required when the output identifies or evokes a real person; scope depends on state law and contract. | Defined by the athlete or representative’s agreement, but verify every attribute used. |
| Organizational marks | Still require separate clearance for team, league, event, uniform, or other protected material. | May be covered by additional rights-holder agreements; never infer coverage from the athlete deal alone. |
| Product experience | Cannot imply the athlete used or preferred the product unless that is true and supportable. | Still cannot claim experience the athlete did not have; a license does not waive FTC truthfulness standards. |
| AI disclosure | Consider a clear synthetic-media notice when omission could confuse viewers; it does not replace an endorsement disclosure. | Usually not relevant to a conventional appearance, but disclose paid or other material connections. |
| Material-connection disclosure | Payment, free product, employment, family, or other material relationship must be clear where the endorsement appears. | The same disclosure principle applies to the real athlete. |
| Approval and reuse | Must address prompts, model files, edits, future generation, takedown, and security. | Must address media, term, territory, edits, approval, exclusivity, and reuse; add synthetic rights if replicas are possible. |
| Unresolved legal variables | State publicity law, platform policy, and rights to any marks or source material. | State publicity law, contract limits, league or union arrangements, school rules, and rights to any marks or source material. |
A clearance workflow for a real campaign
- Freeze the concept. Write down whether the creative uses a real athlete’s face, body, voice, name, nickname, catchphrase, signature move, statistics, biography, or recognizable performance. Record whether the person is intended to be identifiable or merely fictional.
- Build an asset inventory. List every person, logo, uniform, venue, event, broadcast clip, music track, prop, and product package. Capture stills and audio references so reviewers assess the actual output rather than a prompt description.
- Map each right to an owner. Identify the athlete or authorized representative, team, league, event organizer, school, union, broadcaster, photographer, music owner, and platform terms that may control the asset. If ownership or authority is unclear, stop production of public-facing versions.
- Check the license scope. Confirm that the written agreement covers the attributes, synthetic generation, media, territory, term, edits, approval, future reuse, and takedown process. A permission to use a photograph is not automatically permission to clone a voice or generate new dialogue.
- Separate experience from narration. Mark every first-person statement, visible use, rating, preference, and result claim. Obtain evidence that the athlete actually had the stated experience, or rewrite the line as clearly non-testimonial narration that does not create a false impression.
- Substantiate objective claims. Match each measurable promise to competent evidence available before release. Keep the evidence, test conditions, version, and date with the claim so later edits do not detach a qualification.
- Design disclosures in the format. Place payment or other material-connection disclosures next to the endorsement in video, audio, caption, livestream, display, or voice format. Test legibility, duration, contrast, volume, and mobile presentation with the same audience conditions in which the ad will run.
- Run legal and rights-holder review. Have qualified counsel assess applicable state publicity and privacy law, contract restrictions, league or union arrangements, school requirements, platform synthetic-media policies, and the jurisdictional mix of the media buy. Obtain written approval from every relevant rights holder.
- Lock and monitor. Preserve the approved script, prompts or generation settings where appropriate, source files, final render, substantiation, disclosures, licenses, approval trail, publication dates, territories, and takedown contacts. Monitor for unauthorized reposts or altered versions and act under the contract and applicable law.
How to write claims without creating a false testimonial
| Creative line or treatment | Primary risk | Safer review question |
|---|---|---|
| AI voice says, “I take this supplement before every game.” | Implied personal use that may never have occurred. | Did the athlete actually use it, and is the statement covered by the license and supported by records? |
| Generated athlete wears a current team uniform while praising a product. | Uncleared team or league marks and an implied official relationship. | Who licensed the uniform and marks, and does the agreement authorize this commercial context? |
| Replica delivers a new statistic or performance promise. | False endorsement and unsupported objective claim. | Can the brand substantiate the statistic, and did the athlete approve synthetic new speech? |
| Real athlete posts a sponsored clip with no label in the visible frame. | Consumers may not recognize the paid relationship. | Is the disclosure conspicuous in the post, video, audio, and platform preview where the endorsement appears? |
| Fictional athlete closely copies a famous player’s celebration and voice. | Potential identity or publicity-rights claim despite a different name. | Would a reasonable viewer identify or associate the person with a real athlete, and has counsel cleared that risk? |
Disclaimers cannot cure a fundamentally misleading impression. A small “fictional” label may not overcome a realistic voice clone, team uniform, and first-person product claim. The overall net impression matters, so review the complete ad as a consumer would see it.
Independent reader supportYour contribution helps us test, update, and keep practical guides available for everyone.Disclosure and presentation checklist
- Use ordinary words that an audience can understand without legal knowledge.
- Place the disclosure in the endorsement itself or immediately alongside it, not only in a profile, terms page, or linked document.
- Keep it visible long enough to be read in video and livestream formats; make audio disclosures audible at normal listening volume.
- Use the same language as the endorsement when a campaign targets audiences who may not understand English.
- Disclose payment, free or discounted goods, employment, family, personal, or other relationships that could affect how viewers evaluate the message.
- Consider a separate notice such as “AI-generated depiction” when the audience could otherwise believe the footage is authentic. Treat that notice as an identity and transparency measure, not a substitute for “Ad” or “Paid partnership” where required.
Common failure modes and recovery steps
“We changed the face, so no permission is needed.”
A recognizable voice, nickname, movement, catchphrase, biography, or composite can still point to a real person. Pause distribution, preserve the versions and prompts, remove identifying attributes that are not licensed, and obtain a rights analysis before relaunching.
“The athlete approved one photo, so the model can generate anything.”
Approval of a still image does not necessarily cover voice cloning, new speech, altered body movement, future campaigns, or new territories. Compare the intended use with the contract and secure an amendment where the scope is missing.
“The avatar is fictional, so it can claim personal experience.”
A fictional character can still make a testimonial-like claim that consumers interpret as an experienced user’s opinion. Remove the first-person experience, use a clearly identified narrator, or obtain genuine experience and substantiation before making the claim.

“A general legal disclaimer solves the problem.”
Fine print cannot authorize an athlete’s identity, create evidence for an unsupported claim, or reverse a misleading overall impression. Fix the license, script, evidence, or presentation that caused the problem.
Records a brand should retain
Maintain a campaign folder that lets a reviewer reconstruct what was approved and why. Include the identity and mark inventory; executed licenses and amendments; rights-holder approvals; model, voice, and source-media permissions; final scripts and prompts where contractually appropriate; substantiation for every objective claim; disclosure text and format tests; geographic and platform settings; publication dates; complaints; monitoring results; and takedown instructions. The USPTO also recommends monitoring for unauthorized uses and preserving evidence of commercial use. Those records help distinguish an authorized campaign from an altered repost or an output that exceeded the agreed scope.
When to obtain specialist advice
Use sports and advertising counsel experienced in athlete likeness licensing, digital replicas, and endorsement contracts when the campaign identifies a real athlete, uses a voice or movement model, includes team or league material, targets multiple states, involves a student-athlete, creates new first-person statements, or will remain available after the license term. Counsel should review the actual creative and agreements, not just a high-level concept. Rights-management services may help with administration, but no service can replace confirmation from the rights holder and a campaign-specific legal review.

Practical verdict for brand teams
Choose synthetic production for efficiency only after deciding whose identity the audience will perceive and securing permission for every recognizable attribute. Choose a conventional licensed appearance when the campaign needs genuine product experience, athlete approval, or an established rights package—but still verify claims, marks, disclosures, and term limits. In either case, treat the final output as advertising: truthful, evidence-backed, clearly disclosed, and supported by a written record of what each rights holder authorized.
