In 2026, game companies face a changing mix of child-safety proposals, existing platform duties, consumer-protection pressure, gambling enforcement, AI transparency rules and accessibility concerns. These six themes are an editorial guide to EU and UK developments—not an official regulatory ranking or a single rulebook. The EU KIDS Act is a proposal, not law, while other requirements and policy signals have different legal status.
1. Online safety and protection of minors
On 17 September 2026, the European Commission published its proposed EU KIDS Act. The proposal includes “online games” among digital services whose design may create risks to minors’ privacy, safety and security. It would establish safety-by-design measures, but it is still a proposal: the European Parliament and Council must examine it before it can become law.
What game companies should watch
The proposal makes service design—not just the presence of objectionable content—part of the child-safety discussion. For a game, relevant design questions may include how young players encounter other users, what safeguards exist around social features, and whether defaults account for minors. These are useful areas to review, not a claim that the proposal already imposes new duties on every game publisher.

2. Monetization, loot boxes and consumer protection
European Parliament material urges stronger protection for minors around loot boxes and other randomized paid content, in-game currencies and microtransactions. Earlier Parliament material also identifies manipulative purchase design, poor transparency and dark patterns as consumer-protection concerns. These are policy signals and calls for action; they do not amount to a blanket enacted EU ban on loot boxes.

Where the risk lies
Regulatory attention can extend beyond whether a purchase is technically optional. The concerns include how randomized paid rewards are presented, whether players can understand what they are spending, how virtual currencies obscure real-money costs, and whether purchase flows pressure minors. Companies should assess those mechanics against the rules applicable in each market rather than assume one EU-wide prohibition or a universal approval standard.
3. Gambling boundaries and tradable items
In the UK, the government says the Gambling Commission may take strong enforcement action when game products amount to unlicensed gambling, including skin gambling. The condition is important: this does not establish that all loot boxes, skins or virtual items are legally gambling.

Why product details matter
The legal question depends on whether the particular product falls within gambling rules, not simply on whether a game contains a randomized reward or virtual item. A publisher or operator should not treat a mechanic’s label as conclusive. Where items can be traded or used in gambling-like activity, companies need to consider the product’s actual operation and obtain jurisdiction-specific advice. The evidence here does not resolve the treatment of every mechanic or country.

4. AI-enabled features and transparency
The European Commission identifies August 2026 as the start of AI Act transparency rules and names AI-enabled video games as an example. That makes transparency a current issue for some game features, but it does not mean every use of AI in a game is high-risk or subject to identical obligations. Treatment depends on the specific AI system and how it is used.

Assess the feature, not just the label
Teams should identify where AI appears in a product and determine which transparency requirements apply to that particular use. A game’s use of AI does not, by itself, establish that the system belongs to a high-risk category. The Commission’s example signals that AI-enabled games can be relevant to the rules; it is not a blanket classification of games as a whole.
5. Platform duties, privacy and age assurance
The EU proposal discusses age-checking tools designed to protect privacy and safety-by-design measures. It also refers to existing duties under Article 28 of the Digital Services Act (DSA), which require certain online platforms to take appropriate measures to protect minors’ privacy, safety and security. Keep those existing DSA duties separate from the additions proposed by the KIDS Act: the proposal is not yet law.

Games that connect players across services
The proposal also addresses safeguards against games enticing minors to initiate contacts on other services that may pose risks. This highlights a design issue for games with social features or pathways to outside services. The practical question is not only whether a game has age checks, but also how the service protects minors’ information and handles interactions that may move beyond the game.
6. Accessibility and inclusion
A 2025 European Parliament report draws attention to access to online games for people with disabilities. It provides policy context for accessibility, but the material reviewed does not establish a new comprehensive 2026 accessibility mandate for games. A binding-duty claim therefore needs to be checked against the law in the relevant jurisdiction and the specific service or product.

Separate policy attention from legal obligations
Accessibility remains a meaningful design and compliance consideration, but a Parliament report calling attention to the issue is not, by itself, proof of a new universal legal requirement. Publishers should verify which accessibility rules apply to their game, distribution model and markets instead of treating the report as a single global standard.
How to read the 2026 regulatory picture
These developments differ in legal status, territory and who they affect. Some concern game publishers or service providers; others focus on online platforms, advertisers or gambling operators. A useful first step is to identify the feature that creates the issue—such as chat, user-generated content, age assurance, AI, randomized purchases or tradable items—and then check the audience and jurisdiction involved.
- Proposal: The EU KIDS Act, published on 17 September 2026, is under consideration and is not yet law.
- Existing framework: DSA Article 28 already applies to certain online platforms; the KIDS Act would add proposed measures.
- Policy pressure: European Parliament calls for stronger protections around monetization do not create a blanket loot-box ban.
- Conditional enforcement: UK gambling action depends on whether a particular game product amounts to unlicensed gambling.
- Use-specific rules: AI Act transparency treatment depends on the system and its use, rather than on the mere presence of AI in a game.
The evidence is weighted to the EU and UK. It does not establish uniform global treatment, settle every country’s gambling or loot-box rules, or define a comprehensive 2026 accessibility mandate. Game companies should assess each feature against the law and regulatory status in the markets where their services operate.
