Before buying a newly built or off-plan home, verify the legal entities behind the sale, the rights and approvals for the specific land, the contract’s protection for your money and timing, and the warranty and defect process. A brand name, show home or confident sales pitch cannot establish any of those things. Have an independent local property lawyer or conveyancer check the land and contract before you commit money; licensing, deposit protection, warranties and legal remedies differ by jurisdiction.

1. Find out who is selling the home and who is responsible for it

A development may be marketed under a familiar brand while the contract names a different company. Ask for the full legal names of the seller, developer, landowner and any project company. Have your lawyer identify which entity owns or controls the land, which one must build and deliver the home, and which one is responsible for each promise in the contract.

Check the relevant local regulator’s records and confirm whether the builder or developer must be licensed or registered where the property is located. Use official public directories when available, and distinguish regulator findings from promotional material. For example, Ontario’s Home Construction Regulatory Authority (HCRA) provides a public Ontario Builder Directory with information such as years in operation and homes built. Those details and licensing rules apply in Ontario; other jurisdictions may have different systems or no equivalent directory.

Look for completed projects and verifiable information about delivery, workmanship and defect handling. Consider the company responsible for this particular project, not just its parent company or a group brand. A good reputation can help inform your view, but does not prove that the seller owns the land, has the necessary permissions or will protect your deposit.

2. Verify the land and the project—not just the sales materials

Ask an independent lawyer or conveyancer to check the title or other ownership rights being sold, relevant planning and land-use permissions, restrictions, and whether the advertised project and unit correspond to approved documentation. Ask what searches are appropriate for this exact site and what each search does—and does not—cover.

In England and Wales, UK government home-buying guidance explains that a legal representative can identify title or planning issues and advise on searches. Local-authority searches may reveal restrictions and certain external factors; separate specialist searches may be needed for risks such as flooding or mining. The scope and usefulness of searches depend on location. A local-authority search does not tell you about every possible development on neighboring land, so ask whether additional enquiries or searches are warranted.

Visit the site and neighborhood if possible. Check access and nearby conditions yourself, and raise questions about surrounding land with your adviser. Do not assume that a search, brochure or planning summary answers every question about the area.

Some protections apply only within narrowly defined legal frameworks. For example, US federal land-sale disclosure rules under 12 CFR § 1010.109 address matters including title, land use, recording, title insurance and certain purchaser-payment protections within that regulation’s scope. They are not a general rule for every US property transaction, much less a rule for other countries. Ask your lawyer how your interest will be recorded and who controls your money under the rules that actually govern your purchase.

3. Have the agreement explained before you pay

A reservation form, brochure, show-flat display or spoken assurance is not a substitute for the signed contract and approved plans. Before paying a reservation fee or deposit, have an independent local property lawyer or conveyancer explain the documents and identify what happens if the purchase, construction or transfer does not proceed as expected.

Reservation payments and deposits

Confirm whether any reservation payment is refundable, the conditions and deadline for a refund, and when you must sign the main contract. UK government guidance for England and Wales notes that a reservation fee may be refundable only in specified circumstances; the actual terms depend on the agreement and applicable law.

Find out which entity receives the deposit, who holds it and what happens if the developer defaults or cannot transfer the title. Ask whether an independent escrow holder or a local protection scheme is involved, and have your lawyer verify what protection it provides rather than relying on the word “escrow.” In Arizona, the Department of Real Estate’s buyer checklist tells purchasers to note whether earnest money is held in escrow or in the developer’s own funds. That is a state-specific caution, not a universal deposit rule.

Payment milestones, completion and cancellation

Check when installments are due, what construction or other milestones trigger them, and what remedies apply if either party defaults. Make sure you understand the expected completion or handover date, what happens if it changes, whether the contract sets a long-stop date, and when you may withdraw or recover money. In England and Wales, a long-stop date may provide a contractual route to withdraw after a lengthy construction delay; it is the actual contract, not the label alone, that determines your rights.

Plans, specifications and continuing costs

Compare the contract and approved plans with what you were shown. Ask whether the developer can change layouts, materials, fixtures or specifications, and what recourse you have if it does. Ontario HCRA guidance advises buyers of pre-construction homes to put their expectations about the final product in the contract.

Have your adviser identify service charges, estate facility charges, management arrangements and other ongoing obligations, including how they can change and who makes decisions about shared facilities. UK government guidance specifically cautions buyers about additional estate facility charges and recommends getting contractual obligations explained.

If the seller refers you to a lawyer or mortgage adviser, you generally do not have to use that firm in England and Wales, according to UK government guidance; referral fees should be disclosed there. Rules differ elsewhere. Wherever you are buying, choose advisers independently where possible and ask about referral relationships.

4. Check the warranty and the process for fixing defects

Ask who provides the warranty and obtain the actual policy or certificate. Check that the specific home is enrolled, when coverage begins, what is covered, what is excluded, how to make a claim and what deadlines apply. A phrase such as “10-year warranty” is not enough to establish the coverage for your home.

Warranty arrangements vary. UK government guidance describes most new-build homes in England and Wales as having a 10-year warranty for major structural problems and a two-year period for general defects, while cautioning that coverage may not extend to the entire property or attached land. This is a jurisdiction-specific description, not a guarantee for every home or policy. In Ontario, HCRA oversees builder licensing and regulation while Tarion administers warranty coverage; that division of roles is specific to Ontario.

Where the contract and local process allow, consider arranging an independent snagging survey after construction and before completion. Snagging means identifying defects or unfinished work. Agree when access is permitted, record findings, send them to the developer in writing and request a clear response and correction timetable. UK government guidance recommends considering a pre-completion snagging survey.

5. Compare developers using the same evidence

If you are choosing between projects, compare like with like. A claim about a company’s reputation should not outweigh an unresolved problem with the particular land, contract or buyer protections. Use official records where available, and note when information is unavailable rather than treating silence as proof of a clean record.

What to compare Evidence to look for
Identity and oversight Correct contracting entities, applicable licensing or registration, and relevant public regulator records.
Delivery and quality Completed-project history, verifiable delivery information, available quality records, and documented defect responses.
Land and permissions Independent title and planning checks, relevant approvals and restrictions, and searches for the specific site.
Money and timing Deposit holder and applicable protection, payment triggers, completion terms, and contractual delay or withdrawal rights.
Warranty and aftercare Named provider, actual policy terms, claims process, defect-reporting deadlines and response arrangements.
Ongoing obligations Service or estate charges and management terms, considered alongside the purchase price.

Singapore illustrates why local rules matter: its Urban Redevelopment Authority (URA) publishes developer construction-quality performance under its system. A URA and Building and Construction Authority circular dated 22 May 2026 describes additional construction-quality checks and deterrence measures with stated scope and exclusions. These Singapore measures are not a standard that applies elsewhere.

Do not assume that a show home represents the exact unit you will receive. Singapore URA advises buyers to review project and unit information at the show flat and states that plans, models and show units must meet local rules. For your own purchase, rely on the approved specifications and the contractual description of your unit under the rules that apply where it is located.

Before committing: a short decision check

  • Identity: You know which legal entities are selling, building and responsible for the home.
  • Site: An independent professional has checked the land rights, permissions and relevant local searches for the property.
  • Contract: You understand deposit handling, payment triggers, completion and delay terms, cancellation rights, permitted changes and ongoing charges.
  • Aftercare: You have the warranty terms and a workable process for inspection and defect reporting.
  • Evidence: Your view of the developer rests on verifiable records and the terms for this project—not only its brand or sales presentation.

If any of these points remains unclear, pause before paying or signing and ask your independent adviser to resolve it. A property lawyer or conveyancer can assess legal and title questions; a qualified surveyor or new-build snagging inspector can assess the physical home. The right professional and process depend on local rules.
