Torrenting is a way to distribute files directly among connected computers using the BitTorrent protocol. It is not automatically piracy: whether a particular transfer is lawful depends on the file, your authorization or other legal basis, and the law where you are. BitTorrent participants may upload pieces while downloading, and a completed job left seeding can continue uploading to other peers.

What torrenting means

BitTorrent is a peer-to-peer file-distribution protocol. Instead of relying on one computer to send an entire file to every recipient, participants exchange pieces of the file with one another. As more people download the same file, they can also contribute pieces, reducing reliance on a single source. “Torrenting” describes this method of transferring data; it does not tell you whether the file is authorized to share. The same protocol can be used to distribute material with permission, public-domain works, or material shared without the rights holder’s authorization.

How a BitTorrent transfer works

A torrent workflow uses information about the file, known as metainfo, and a peer-discovery process to help participants find one another. Trackers are among the components described in the protocol specification. Once peers connect, they exchange pieces rather than requiring one source to provide every byte to every recipient.

In BitTorrent Limited’s applications, the company’s End User License Agreement says users downloading through its software in turn enable other users to download pieces from them. It also says files explicitly being downloaded or shared, or previously downloaded or shared through those applications, may be made available to others. That describes the vendor’s products and terms; it should not be treated as a universal statement about every BitTorrent client’s settings or defaults. BitTorrent End User License Agreement

What is seeding?

Seeding is uploading a completed torrent’s files to other peers. BitTorrent Help explains: “After a torrent job finishes downloading, if you leave the torrent job seeding, it uploads the file(s) to other peers so they can enjoy them too.” BitTorrent Help: What is seeding?

Seeding is one way participants help keep a file available to others. Because uploading can happen during a download as well, a peer-to-peer transfer can involve both receiving and sending data in the same session.

Is it legal to download works from peer-to-peer networks?

There is no universal yes-or-no answer. The key question is whether you are authorized to obtain and share the work, or whether another legal basis applies, under the rules that govern you. Using BitTorrent itself does not establish that a transfer is unlawful, but using it does not make an unauthorized copy lawful either.

For the United States, the U.S. Copyright Office says that most original works fixed in a tangible medium, including computer files, may be assumed protected by federal copyright law unless there is clear information to the contrary. It also notes that peer-to-peer networks predominantly distribute copyrighted works and that downloading from them carries a risk of liability. That guidance is U.S.-specific. It does not establish the law or penalties in other countries, and it does not resolve state-specific details. If you need to assess legal consequences, identify the jurisdiction and consult current local legal resources.

What a copyright complaint does—and does not—mean

A complaint or takedown notice is not the same as a court finding that infringement occurred. BitTorrent Limited’s copyright policy says it responds to properly submitted notices and may remove or disable access to files or links alleged to infringe. In the United States, the Digital Millennium Copyright Act established a notice-and-takedown system and certain conditional limitations on service-provider liability. How to think about installer and file safety

Protocol mechanics do not guarantee that a client installer or a downloaded file is safe. BitTorrent Support’s antivirus article, modified October 24, 2022, says some antivirus products may classify its installer as a potentially unwanted program because of optional third-party offers. The page advises obtaining the official build and declining offers you do not want. This is dated guidance about one vendor’s installer; an alert should not automatically be dismissed as false, and the explanation does not apply to every client or torrent. BitTorrent Limited’s EULA also disclaims responsibility for harm from its applications or downloaded software and content, and says vendor approval does not guarantee that content is complete, accurate, or free of bugs, viruses, or other harmful material. A practical decision checklist

  • Confirm the source has a right to share the work. Look for clear permission, a reliable public-domain basis, or another applicable legal basis rather than assuming a file is authorized because it is available.
  • Consider both directions of transfer. Your client may upload pieces while downloading; leaving a completed job seeding can upload the files to other peers.
  • Check local rules when legal consequences matter. The cited Copyright Office guidance covers U.S. law, not every jurisdiction.
  • Evaluate software and content independently. Obtain installers from the vendor’s official source, review optional offers, and do not treat an antivirus alert or a file’s availability as proof of safety.
