Ericsson and OPPO announced a multi-year global patent cross-license covering cellular standards, including 5G, on July 15, 2024. Ericsson says OPPO will pay royalties, but neither company disclosed the rate or amount. The companies also announced cooperation on 5G-related activities.

What the Ericsson–OPPO agreement covers

Ericsson describes the deal as a “multi-year global patent cross-license agreement” covering patents essential to cellular standards, including 5G. OPPO likewise says the cross-license covers cellular standard-essential patents. The announcements do not include a patent-by-patent list or a schedule of countries covered. Ericsson’s July 15, 2024 announcement and OPPO’s announcement on the same date use the term “global”; neither release publishes a country schedule.

“Cross-license” means the parties license patent rights to one another. However, the public announcements do not describe the reciprocal economic terms, so they do not establish that the two sides’ licenses have equal value or that OPPO’s royalty payment is offset by a payment from Ericsson. The stated duration is “multi-year”; no specific expiration date is given.

Who pays royalties, and how much?

Ericsson says OPPO will make royalty payments to Ericsson. Neither company disclosed a royalty rate or a standalone payment amount, and Ericsson did not quantify the agreement’s contribution to its results.

Ericsson said the agreement’s financial benefit was already reflected in its second-quarter 2024 financial results. That timing statement is not a disclosed deal value. Ericsson’s release also quotes its Chief Intellectual Property Officer, Christina Petersson, saying the royalty-bearing agreement allows Ericsson to further invest in fundamental communications technologies. That is Ericsson’s stated rationale, not a quantified account of the agreement’s financial impact.

What other cooperation did the companies announce?

The announcements pair the patent license with broader 5G cooperation. Ericsson names 5G device testing, customer engagements, and marketing activities. OPPO describes technical cooperation, market expansion, and other collaborations. Neither release details specific projects, schedules, or completed outcomes.

Why cellular standard-essential patents matter

Cellular standards define technical requirements that compatible devices and networks need to follow. A standard-essential patent is one that is necessary to implement a relevant standard. Ericsson says patent licensing compensates holders for research and development and is part of practice among companies whose products use cellular 3GPP standards. That is Ericsson’s explanation in its release; the announcements are not a full legal analysis of standard-essential patent obligations in every jurisdiction.
