A vehicle advertised as a 4000W e-bike capable of 45 mph falls outside the federal low-speed electric-bicycle definition and the PeopleForBikes model three-class definition described here. That does not, by itself, settle whether a particular vehicle is street-legal or what it is classified as: those answers depend on the vehicle and the laws where you plan to ride. The power and speed claims are also not independently verified performance figures. Treat them as a reason to check the rules and the vehicle’s documentation before riding, not as proof of its legal category or safety.
How the advertised specifications compare with e-bike definitions
Two definitions help explain why the familiar “e-bike” label may not tell you how this vehicle is regulated. The federal statute defines a narrow low-speed electric-bicycle category for a specified consumer-product purpose. PeopleForBikes’ three-class definition is a model used in legislation; it is not a universal rule for every state or locality.
| Measure | Federal low-speed definition | PeopleForBikes model three-class definition | Advertised vehicle |
|---|---|---|---|
| Motor power | Below 750 watts | 750 watts or less | Claimed 4000W |
| Speed condition or cutoff | Motor-only maximum below 20 mph on a paved, level surface with a 170-pound operator | Class 1 and 2 assistance cutoffs at 20 mph; Class 3 pedal assistance up to 28 mph | Claimed top speed of 45 mph; measurement method and operating mode are not established |
| Other defining feature | Two or three wheels and fully operable pedals | Class 1 and 3 use pedal assistance; Class 2 includes throttle operation | Whether the advertised vehicle meets these features is not established |
The federal figures come from 15 U.S.C. § 2085. PeopleForBikes’ model definition was presented on January 4, 2023, in a document hosted by the U.S. Consumer Product Safety Commission (CPSC). The advertised figures are claims, not a test result.
Is a 4000W e-bike street-legal in the United States?
There is no single nationwide answer based on the two advertised numbers alone. The specifications place the vehicle outside the federal low-speed definition and outside the PeopleForBikes model definition, but neither fact assigns it a definitive classification in every jurisdiction. The federal statute defines a particular category; it does not say that every electric bicycle must meet that category or settle every public-road question.

Do not assume the vehicle is an ordinary bicycle, a Class 1, 2, or 3 e-bike, a moped, or a motorcycle based only on a sales description. Classification may depend on the actual vehicle, how its motor operates, and local law. The power rating could also refer to peak rather than continuous output; the listing and available evidence do not establish which. Check the relevant state vehicle code and local rules, then confirm the classification with the motor-vehicle agency that administers them.
What to verify before riding on a road, path, or trail
- Classification: Ask the state motor-vehicle agency how the specific make and model is classified, and what evidence it needs to determine that.
- Licensing and registration: Confirm whether the classification requires a driver’s license, registration, title, or other credentials.
- Equipment: Check applicable requirements for safety equipment and vehicle equipment.
- Where it may be ridden: Verify access rules separately for public roads, bicycle lanes, shared paths, and trails. Permission for one does not establish permission for the others.
- Local traffic rules: Follow the rules in the place you ride. CPSC’s general micromobility guidance also tells riders to follow local traffic laws.
PeopleForBikes describes a model definition, not a substitute for the current law where you will use the vehicle. Requirements and access rules can vary by state and locality, so do not rely on an online “Class” label or a seller’s general claim as a legal determination.

What the speed and power claims do—and do not—tell you
A watt figure and a top-speed figure do not provide a full legal or safety assessment. The federal definition’s speed condition is specifically a motor-only measurement under stated surface and rider-weight conditions. The 45 mph claim does not say how speed was measured, whether the motor was providing assistance or propulsion, or whether that speed is repeatable. The 4000W claim does not establish whether the figure is peak or continuous power.

Without the make and model, technical documentation, jurisdiction, and independent performance or safety testing, it is not possible to determine the vehicle’s precise legal category, road eligibility, stopping distance, crash performance, or suitability for a particular rider. Do not treat claimed top speed as a proxy for braking capability or safe operation.

Safety considerations for a high-speed electric vehicle
CPSC’s micromobility guidance recommends wearing a bicycle helmet, keeping both hands on the handlebars, keeping items off the handlebars, slowing down and leaning back when approaching bumps, and never riding under the influence of alcohol or drugs. These are general recommendations for micromobility riding—not a product-specific safety assessment, certification, or finding that a bicycle helmet is adequate for a vehicle advertised at 45 mph.
Follow the equipment requirements that apply to the vehicle’s legal classification and location. Do not infer that ordinary e-bike guidance or a seller’s description establishes that a vehicle is safe at its claimed speed.

Battery and charger precautions
CPSC advises micromobility owners to follow the manufacturer’s instructions, stay present while charging, unplug the device when charging is complete, and use only the charger supplied with the device or one the manufacturer recommends. Avoid a charger described as “universal” unless it has been tested and approved for the specific device.
For a replacement or secondary battery, CPSC advises using one tested and approved to work safely with the device and confirmed as suitable by its manufacturer. It warns against modified or reworked battery packs and repurposed or used cells. A physical fit or matching connector is not, on its own, evidence of compatibility.

What CPSC’s incident figures mean
- In a December 20, 2022, release, CPSC reported receiving at least 208 micromobility fire or overheating incident reports from 39 states and at least 19 associated fatalities, including three associated with e-bikes. The reports covered January 1, 2021, through November 28, 2022.
- In a September 5, 2024, release, CPSC said it had received 156 reports of fire and thermal incidents involving “universal” micromobility chargers from January 1, 2023, through May 16, 2024.
These are reports received by the agency over the stated periods, not estimates of the chance that a particular battery, charger, or ride will cause a fire or injury.
Quick Recap
How to make a decision about this vehicle
- Get the exact vehicle identity and specifications. Ask the seller for the make and model, the manufacturer’s documentation, and clarification of whether the power rating is peak or continuous and how the speed claim was measured.
- Confirm its legal category locally. Give the motor-vehicle agency the exact model and documentation, and ask about classification, licensing, registration, equipment, and road access.
- Check the intended route. Confirm rules for every road, path, or trail you plan to use; do not assume that bicycle access follows from the seller calling it an e-bike.
- Review the manufacturer’s safety and charging instructions. Use a compatible, manufacturer-approved charger and battery, and follow CPSC’s charging precautions.
- Do not treat a helmet or general safety checklist as proof of suitability. The cited CPSC guidance does not certify this vehicle or evaluate riding it at the advertised speed.
