Before buying Bitcoin, make four checks: decide whether you can tolerate losing the money, understand whether you want Bitcoin itself or a security tied to its price, compare custody and total costs, and verify the provider while rejecting pressure tactics. These checks cannot make Bitcoin safe or guarantee a good outcome; they can help you understand what you are choosing.
The regulatory descriptions below are US-specific. If you live elsewhere, check your local rules and official investor guidance.
1. Check whether Bitcoin’s risk fits your finances
Bitcoin is speculative and its price can move sharply. The SEC urges investors to consider that volatility and treat an investment as money they could afford to lose entirely. That is a suitability check, not a prediction about where the price will go. See the SEC’s Bitcoin and other virtual currency-related investments investor alert.
Before committing money, ask yourself:
- Could I lose this amount without affecting rent, bills, debt payments, emergency savings, or other essential needs?
- When might I need the money? A sharp decline can be especially difficult if you must sell to meet a near-term goal.
- Would I be able to stick to my financial plan through a large loss, rather than buying more or selling in a panic?
If the answers make the risk unacceptable, not buying is a valid decision. Do not use money you need soon just because a service makes buying quick or easy.
#1 Best Overall
- BITCOIN EXCLUSIVE, PHONE VERIFICATION: Bitkey is designed from the ground up exclusively for bitcoin — a dedicated hardware wallet for secure bitcoin storage. Approve transactions with a tap using your phone and NFC. No device screen is required.
- SELF-CUSTODY, NO EXCHANGE OR CUSTODIAN REQUIRED: You hold two of the three keys in the Bitkey system – one on your phone and one on your Bitkey device. The third is stored on Bitkey’s server and cannot move your bitcoin on its own.
- NO SEED PHRASE: Set up and use Bitkey without creating or storing a seed phrase.
- 2-of-3 MULTISIG: Three keys are stored separately across your phone, Bitkey device, and Bitkey’s server. Any two keys are required to move your bitcoin.
- BUILT-IN RECOVERY: Encrypted backup and recovery tools can help you regain access if you lose your phone or Bitkey device. You can also designate a Recovery Contact.
2. Choose between Bitcoin itself and a security tied to it
Buying Bitcoin directly means acquiring the asset and deciding how it will be held. A spot Bitcoin exchange-traded product (ETP), by contrast, is a security traded through a brokerage account that provides exposure to Bitcoin’s price through its own structure. It is not the same thing as holding Bitcoin directly, and its structure does not remove the underlying price volatility.
| Question | Direct Bitcoin | Spot Bitcoin ETP |
|---|---|---|
| What do you acquire? | Bitcoin itself. | A security that provides exposure to Bitcoin; you do not acquire Bitcoin directly through the ETP. |
| Where does custody sit? | With a service provider or, if you choose, in a wallet whose private keys you manage. | Within the product’s custody and operating arrangements; you hold the security through a brokerage account. |
| What should you compare? | Trading, transfer, and account costs; custody arrangements; withdrawal and transfer options. | Product-specific costs and risks, alongside brokerage account terms. |
| What is the US regulatory distinction? | Bitcoin is not itself a security. Applicable rules depend on the activity and circumstances. | The SEC says spot Bitcoin ETP offerings and securities register under the Securities Act of 1933 and Exchange Act of 1934, but these products are not registered as investment companies under the Investment Company Act of 1940. |
The SEC’s Sept. 9, 2024 investor bulletin on crypto asset ETPs describes that US framework. Registration does not mean the SEC endorses an investment or that it is safe; ETPs still carry product-specific risks as well as exposure to Bitcoin’s volatility. The better route depends on your circumstances, jurisdiction, and comfort with custody—not on a universal ranking.

3. Compare the purchase route, custody, and full cost
If buying Bitcoin directly, look beyond the buy button. Check how the service holds assets, what happens if it fails or suspends withdrawals, whether you can transfer Bitcoin elsewhere, and what you would pay at each stage. The SEC’s crypto asset custody bulletin explains how custody and wallet access work.

Understand wallet access before choosing self-custody
A wallet does not literally hold Bitcoin. It manages the private keys or passcodes that provide access to crypto assets. With a custodial service, the provider manages custody and access under its terms. With a wallet you control, you take responsibility for safeguarding the keys and recovery material.

| Option | Connectivity and convenience | Key responsibility and main trade-off |
|---|---|---|
| Custodial service | Access and transactions depend on the provider’s service and terms. | The provider manages custody. Check withdrawal rules, service-failure procedures, and fees. |
| Hot wallet | Internet-connected and generally convenient for transactions. | Internet connectivity brings greater exposure to cyberthreats. If you control the keys, you must protect them. |
| Cold wallet | Generally less connected, and less convenient for transactions than a hot wallet. | Often a physical device; it can be lost, damaged, or stolen. You still need to protect keys and recovery material. |
A Bitcoin-compatible hardware wallet is one possible cold-storage device for someone who chooses self-custody, not a requirement for every beginner. A device does not protect you from Bitcoin’s price declines or from mistakes such as phishing or mishandling recovery material. Self-custody shifts responsibility to you; it does not remove investment risk.
Calculate the costs that apply to your route
Depending on the service, costs can include transaction charges, transfer fees, annual asset-based fees, and account setup or closure charges. Ask for the current amounts and check when each applies; fee schedules can vary by provider and account. For an ETP, also review its product-specific costs and your brokerage’s terms. Compare the total likely cost, not just the advertised trading fee.

4. Verify the people involved and reject pressure
Before sending money, identify who operates the service, how it is regulated in your jurisdiction, and whether claims about returns and risk can be substantiated. Use relevant official registration or background-check resources where available, and be cautious if it is unclear who is responsible for your funds or how you can withdraw them.
Guaranteed high returns, claims of “little or no risk,” unsolicited pitches, and pressure to act quickly are warning signs—not reasons to invest. A joint SEC and CFTC alert describes fraudulent digital-asset websites that used those kinds of claims. Its 2019 alert gives 20–50% returns as an example of promises made in scam pitches; that figure is not a current statistic, typical return, or evidence of what Bitcoin investments deliver. Read the SEC and CFTC alert on digital asset-related fraud and investigate the individuals and firms behind an offer.

For readers in the United States, an older SEC Bitcoin alert said Bitcoin holdings in wallets or exchanges did not have protections similar to bank deposits or brokerage accounts described in that alert. That statement reflects the alert’s date and scope; it should not be treated as a complete description of every current custody arrangement or law. Rules and protections depend on the product, provider, and jurisdiction. Check current official guidance where you live, including tax guidance, before making decisions.
