Tell your manager, HR, or the person named in your workplace accommodation policy that a medical or pregnancy-related limitation means you need more frequent, longer, or more flexible bathroom breaks. You can make the request verbally or in writing; no special phrase or form is required. The rules differ depending on whether the need is pregnancy-related under the Pregnant Workers Fairness Act (PWFA), disability-related under the Americans with Disabilities Act (ADA), or covered by state or local law.
How do you ask for more bathroom breaks at work?
State the work-related limitation and the change that would help. You do not need to give a precise schedule before starting the conversation. If you know what would work—for example, being able to step away when needed, or having additional breaks during a shift—say so. The EEOC’s pregnancy guidance gives a direct example: “I need more bathroom breaks because of my pregnancy.” EEOC: What You Should Know About the Pregnant Workers Fairness Act
You may make the request in a conversation or send an email. A written request can help you keep a record of what you asked for and when, but writing is not a legal prerequisite under the EEOC guidance. Contact your manager, HR, or the workplace contact specified by policy.
Example email
Subject: Request for bathroom-break accommodation
Hi [manager or HR contact], I have a [brief description of the limitation, if you are comfortable sharing] that affects my work, and I need more frequent or flexible bathroom breaks. Could we discuss an arrangement that lets me use the restroom when needed while meeting my job responsibilities? I can explain how the limitation affects my work and discuss possible options. Please let me know the next step in the accommodation process.

This is a starting point, not a required form. Focus on the limitation’s effect at work and the change you need; the amount of medical detail that may reasonably be requested depends on the law and circumstances that apply.
Which law may cover the request?
For pregnancy-related needs, the main federal law is the PWFA. For a qualifying disability, the ADA may apply. Pregnancy itself is not an ADA disability, although some pregnancy-related conditions may meet the ADA definition. State and local laws may offer additional or broader protection, so coverage depends on your circumstances and location. EEOC: What You Should Know About the Pregnant Workers Fairness Act

Pregnancy-related limitation: PWFA
The PWFA generally requires a covered employer to accommodate a worker’s known limitation related to, affected by, or arising out of pregnancy, childbirth, or a related medical condition unless the accommodation would cause undue hardship. The EEOC lists additional, longer, or more flexible restroom breaks as possible accommodations. Covered employers include private and state or local public employers with 15 or more employees, as well as Congress and federal agencies, employment agencies, and labor organizations. The statute took effect June 27, 2023; the EEOC’s final implementing regulation took effect June 18, 2024.
You do not need to use legal terminology or say “PWFA” to begin the conversation. Under the EEOC’s guidance, an employer should respond promptly and communicate with you about the known limitation and needed adjustment. EEOC PWFA guidance

Disability-related limitation: ADA
The ADA may require a reasonable accommodation when a qualified employee has a disability and needs a workplace change to perform essential job functions or access employment benefits. You or someone representing you can request a change orally or in writing. You do not have to say “ADA” or “reasonable accommodation.” The employer should discuss what you need and why; if your preferred arrangement is not workable, an effective alternative may be considered. Can your employer require a doctor’s note?
Not in every case. The EEOC says it is not reasonable to require documentation when a currently pregnant employee needs bathroom breaks. That specific PWFA guidance should not be treated as a blanket rule for every pregnancy-related request or every ADA request. EEOC PWFA guidance

For an ADA request, an employer may seek reasonable supporting medical information when the disability or the need for an accommodation is not obvious or already known. The information should relate to the disability-related limitation and accommodation need, rather than automatically requiring a detailed diagnosis in every situation. EEOC ADA guidance

There is no universal federally prescribed break schedule in the cited EEOC guidance. Describe the barrier and discuss an arrangement that addresses it in your actual workplace. If you are weighing options, consider:

- Whether you can use the restroom when medically needed, including during tasks that require scheduled coverage.
- Whether additional, longer, or more flexible breaks would address the limitation.
- How the arrangement can fit the essential duties of your job and the way your workplace operates.
- Whether an employer-proposed alternative would effectively address your limitation.
- Whether the need is temporary or may change and should be revisited.
These are practical discussion points, not an EEOC-mandated checklist. The EEOC describes the PWFA interactive process as communication about the known limitation and the adjustment or change needed at work. EEOC PWFA guidance
What if the employer delays or denies the request?
Follow up with the person handling the request and ask when you can expect a response or discussion. Explain the work barrier, clarify what change would help, and consider other effective options if the first proposal cannot be implemented. The EEOC recommends that workers affected by pregnancy-related conditions explain barriers, share ideas for what could help, and contact the EEOC for help deciding next steps if an employer says no. You can also check the law in your state or city, which may provide broader rights. The EEOC accepts PWFA charges, but filing deadlines and procedures depend on the type of claim, jurisdiction, and facts.
