Yes—although the normal two-year GST refund period runs from communication of the appellate order, the Gujarat High Court has ordered a refund where the department uploaded Form GST APL-04 more than two years later and the taxpayer filed Form GST RFD-01 the next day. In Panila Chem Limited v. State of Gujarat (R/Special Civil Application No. 4610 of 2025), decided on 23 October 2026, the court treated the departmental upload date as the relevant date on the case’s unusual facts. It quashed both rejection orders, directed processing of the refund, and awarded interest. The judgment is a narrow, fact-specific remedy—not an automatic extension whenever an APL-04 summary is delayed.
What did the Gujarat High Court decide about the delayed APL-04 upload?
The Division Bench of Justices A.S. Supehia and Vaibhavi D. Nanavati held that Panila Chem Limited could not be denied its refund merely because the department uploaded the appellate summary late. The company’s physical appellate order had been delivered in March 2022, but Form GST APL-04 was not uploaded until June 2024. Panila Chem filed its refund application on the following day.
The court emphasized that the ordinary limitation rule still exists. It granted relief because strict application of that rule, in these particular circumstances, would allow the State to retain money after the underlying demand had been set aside.

What happened in the Panila Chem case?
- Section 129 payment: Panila Chem had deposited ₹5,41,032 in connection with a detention proceeding from November 2019.
- Appeal allowed: On 28 February 2022, the appellate authority allowed the company’s appeal. The record noted that the e-way bill was active and that there was no intention to evade tax, and it directed a refund.
- Physical order received: The authorised representative received the physical appellate order on 8 March 2022.
- Portal summary delayed: The department uploaded the Form GST APL-04 summary only on 3 June 2024.
- Refund filed: Panila Chem submitted Form GST RFD-01 on 4 June 2024, the next day.
- Rejection and first appeal: The refund officer rejected the claim as time-barred on 10 July 2024. The first appellate authority dismissed the company’s appeal on 30 January 2025.
What is the normal GST limitation rule?
Section 54(1) of the Central Goods and Services Tax Act, 2017 generally allows a refund application within two years from the relevant date. Explanation 2(d) provides that, for tax refundable because of an appellate order, the relevant date is communication of that order.

Applying that provision in the usual way, 8 March 2022—the date Panila Chem received the physical order—would control. On that calculation, a June 2024 RFD-01 application would ordinarily be late.
Does a taxpayer have to wait for APL-04 before filing RFD-01?
No. The court described Form GST APL-04 as a summary under Rule 113. Rule 89 and Form GST RFD-01 do not state that a taxpayer holding the appellate order must wait for the department to upload APL-04 before applying for a refund.

That means a taxpayer should normally preserve the communicated order and file within two years of communication, even if the portal summary has not yet appeared. Waiting for the summary can create a limitation dispute.

- The department, not the taxpayer, caused the APL-04 delay of more than two years.
- The appellate order expressly directed a refund.
- Panila Chem filed RFD-01 on the very next day after the summary became available.
- Keeping the money would mean retaining a payment after the demand had been set aside.
The judgment invoked Articles 265 and 300A of the Constitution and the principle that procedure should facilitate substantive justice. It reproduced the Supreme Court’s formulation: “Procedural law is not to be a tyrant but a servant, not an obstruction but an aid to justice.” The court therefore treated the upload date as the relevant date for this claim, while stressing that the result was confined to the peculiar facts.
What relief did the court order?
The Gujarat High Court quashed the refund rejection dated 10 July 2024 and the first appellate order dated 30 January 2025. It directed the authorities to process Panila Chem’s 4 June 2024 refund application.

The order also provides a practical fallback: if the portal would not accept or process the application, Panila Chem could submit a fresh application offline. The court awarded 6% interest on ₹5,41,032 from 15 August 2024 until payment, and required implementation within 12 weeks. If the directions were not implemented within that period, interest would rise to 9% per annum after the deadline.

| Issue | Ordinary statutory treatment | Panila Chem ruling |
|---|---|---|
| Starting point | Communication of the appellate order under Section 54(1) and Explanation 2(d). | Departmental APL-04 upload date used because of the exceptional facts. |
| Physical order | A communicated physical order can start limitation. | Order received on 8 March 2022, but the court did not let that date defeat relief. |
| APL-04 | Summary under Rule 113; not ordinarily a prerequisite to RFD-01. | Uploaded on 3 June 2024 after a delay attributable to the department. |
| Taxpayer’s filing speed | Application should be filed within the two-year period. | RFD-01 filed on 4 June 2024, one day after upload. |
| Filing route | Use the prescribed portal process. | Offline filing permitted if the portal could not accept or process the application. |
| Interest | Depends on the applicable refund provisions and facts. | 6% from 15 August 2024; 9% after the 12-week compliance period if unpaid. |
What should a taxpayer do when the physical order exists but APL-04 is missing?
- Record communication: Keep the physical order, acknowledgement, dispatch details, email, or other proof showing when it was received.
- Check the order’s direction: Confirm that the appellate authority actually directs or supports a refund and identify the amount involved.
- Do not wait unnecessarily: Because APL-04 is not ordinarily a filing prerequisite, prepare RFD-01 within two years of communication.
- Document portal problems: Save screenshots, error messages, grievance numbers, and correspondence if the portal lacks the summary or rejects the filing.
- Use a defensible fallback: If electronic filing cannot be completed, seek an offline submission and retain proof of delivery. The Panila Chem order shows that an offline route may be directed where the portal prevents processing.
- Explain the chronology: If a limitation objection is raised, provide the appellate order, proof of communication, evidence of the department’s delayed upload, and proof that the refund was filed promptly afterward.
Does this judgment automatically extend every GST refund deadline?
No. The court expressly limited its reasoning to the peculiar combination of a departmental delay, an appellate direction to refund, next-day filing, and the risk that the State would retain money after the demand had been annulled. A taxpayer cannot assume that a late APL-04 upload, by itself, restarts the two-year period.

The safer compliance position remains to calculate limitation from communication of the appellate order and file RFD-01 without waiting for the portal summary. Panila Chem is most useful as authority for challenging an unjust limitation result where the taxpayer acted promptly and the department’s own system delay caused the problem.
Frequently Asked Questions
What proof shows when a GST appellate order was communicated?
Use the strongest contemporaneous record available, such as an acknowledgement signed by the authorised representative, a registered-post delivery record, an official email, or a portal download log. Keep the complete order and a dated covering letter together so the communication date and the refund direction can be read in context.
Can a refund officer reject RFD-01 only because APL-04 is not visible on the portal?
The absence of an uploaded summary does not ordinarily make the taxpayer ineligible to apply when the appellate order has been communicated. Ask the officer to record the precise statutory basis for rejection and attach the order, proof of communication, and filing evidence.
What if the portal accepts the application but does not issue an acknowledgement?
Preserve the ARN, screenshots, electronic receipts, and any error or status messages immediately. A dated grievance or written representation can help establish that the taxpayer attempted timely filing even if back-end processing failed.
Is interest on an appellate-order refund always 6%?
No. The 6% rate and the 15 August 2024 start date were directions specific to Panila Chem’s case. Interest in another refund dispute depends on the governing statutory provision, the relevant dates, and the relief granted by the deciding authority.
