If an AI testing vendor blocks access to production results, treat the refusal as an operational and governance risk—not a routine support delay. Preserve the refusal and missing evidence, check the agreement’s audit and cooperation terms, escalate to the accountable risk owner, and offer a tightly controlled way to review the evidence. If access remains unavailable, make a time-bounded decision to pause, constrain, roll back, replace, or formally accept the residual risk.
This approach keeps your organization able to monitor a system after deployment while protecting confidential data and preserving contractual and regulatory options.
Why a refusal matters after deployment
Pre-deployment testing is only a snapshot. Real users, changing inputs, model updates, integrations, and operational workarounds can produce behavior that was not visible in a test environment. NIST AI 800-4 (2026) describes post-deployment monitoring as crucial for validating reliable operation in real-world scenarios, tracking unforeseen outputs caused by factors such as model non-determinism or dynamic inputs, and seeing unexpected consequences in the deployment context.
NIST AI Risk Management Framework (RMF) 1.0 treats operations testing, evaluation, verification, and validation (TEVV) as a continuing lifecycle activity. Its operations guidance calls for ongoing monitoring around updates, testing, subject-matter-expert recalibration, incident and error management, emergent properties and impacts, and redress and response. A vendor that prevents review can therefore remove evidence needed for safety decisions, incident response, compliance reporting, and renewal or termination decisions.

The refusal does not automatically prove that the vendor breached a contract or a law. It does create a documented control gap. Your response should establish exactly what is unavailable, why it is unavailable, how long the gap may last, and what safeguards will operate while the gap remains.
First response: freeze the facts
Do not let a verbal conversation become the only record. Create an access-refusal case in an immutable or tightly access-controlled system and attach contemporaneous evidence.
- Save the request. Keep the original email, portal submission, ticket, meeting invite, or API request that asked for production results. Record the requester, recipient, requested date range, systems covered, and business purpose.
- Save the refusal. Preserve the vendor’s exact wording, response time, ticket number, stated legal or security basis, and any conditions it proposed. Export portal conversations before they expire.
- Identify what is affected. Record the product, model and test-tool versions, deployment environments, regions, users, decision types, integrations, and subprocessors involved.
- Capture the timeline. Add deployment and update dates, previous review dates, incidents, customer complaints, outages, and any change notices. Note when access stopped and whether the vendor gave a restoration date.
- Protect independent evidence. Preserve your own application logs, prompts or input records where lawful, outputs, reviewer decisions, alerts, performance dashboards, and incident tickets. Apply legal holds or retention rules when a dispute or investigation is reasonably foreseeable.
Give the case one owner and a severity level. The owner should be able to convene procurement, security, privacy, legal, compliance, the system owner, and the executive who accepts AI risk.

Define the minimum evidence you need
Separate evidence that is necessary to make a safe decision from information that would merely be useful. Start with a minimum review package, then negotiate the access method and format.
| Evidence | Decision it supports |
|---|---|
| Test methodology, test-set description, and pass/fail criteria | Whether the assessment measures the risks relevant to the deployed use |
| Production sample or aggregate performance results | Whether real-world behavior remains within approved thresholds |
| Failure cases, severity ratings, and reproducible examples | How often harmful or unreliable outcomes occur and how they can be reproduced |
| Model, test-tool, and dataset identifiers | Which exact versions produced each finding |
| Change, release, and configuration history | Whether an update, prompt change, integration, or policy change altered risk |
| Incident, error, complaint, and remediation records | Whether known problems were contained, corrected, and closed |
| Drift, emergent-behavior, and recalibration findings | Whether performance or risk changed after deployment |
| Limitations, exclusions, and confidence information | What the results cannot establish and where compensating controls are needed |
| Redress outcomes and unresolved cases | Whether affected people received review, correction, or other remedy |
Ask the vendor to identify which item it is withholding, the reason, the data owner, the retention period, and the earliest date an equivalent artifact can be supplied. “We cannot provide production results” is not precise enough to manage risk.
Offer a controlled access design
A vendor may have legitimate concerns about trade secrets, personal data, security-sensitive test cases, or misuse of an unrestricted interface. Address those concerns with least-privilege options instead of accepting a permanent information blackout.
Read-only export
Request a signed, versioned export of aggregate metrics, test reports, failure categories, incident counts, and change history. Read-only files avoid giving your staff the ability to alter the vendor’s environment. Require a data dictionary and a statement identifying the measurement window.

Redacted or sampled logs
Ask for a statistically meaningful sample or event classes with direct identifiers, secrets, and sensitive content removed. Define the sampling frame, exclusions, redaction method, and integrity check so that a favorable sample cannot be mistaken for a full-population result.
Secure review room
Use a vendor-hosted or customer-hosted clean room with named reviewers, multifactor authentication, export restrictions, screen recording where lawful, and automatic expiry. Permit inspection without allowing bulk download.
Customer-provided queries
Provide approved queries that the vendor runs against its environment and returns as signed outputs. This can expose counts, trends, and specific test cases without granting broad database access. Keep the query text and execution timestamp with the result.
Independent assessor
Have an assessor bound by confidentiality review the vendor’s environment and deliver findings to both parties. Define independence, conflict-of-interest rules, permitted evidence, retention, and the assessor’s right to report material safety concerns.

Read the contract before arguing about access
Pull the signed agreement, order forms, security addendum, data-processing terms, service-level agreement, acceptable-use rules, and incorporated policies. Check the version in force when the system was deployed and when the refusal occurred.
| Contract control | Questions to answer |
|---|---|
| Audit and inspection | Who may inspect, what systems and records are covered, how much notice is required, and are independent assessors allowed? |
| Cooperation and evidence retention | Must the vendor provide reports, logs, explanations, or assistance, and for how long must those records be retained? |
| Incident notification | What events trigger notice, who receives it, and what are the notification and update deadlines? |
| Change and drift notification | Must the vendor disclose model, dataset, test-tool, infrastructure, subcontractor, or material configuration changes? |
| Service levels and support | Are response times, critical-support hours, restoration targets, and escalation contacts defined? |
| Confidentiality and data use | Can the vendor cite confidentiality as a reason to withhold results, and what approved disclosure or redaction process applies? |
| Subcontractors | Which subcontractors hold test data or operate monitoring, and does the vendor remain responsible for their cooperation? |
| Dispute and cure process | What written notice, cure period, executive escalation, mediation, or arbitration steps are required? |
| Suspension and termination | Can you suspend use, terminate for cause, terminate for convenience, or require transition assistance? |
| Liability and remedies | Do indemnities, service credits, caps, insurance, or specific remedies apply to withheld evidence or a monitoring failure? |
Send a formal notice through the channel required by the agreement. Cite the applicable audit, cooperation, incident, service-level, or change-notification clause; describe the exact artifacts denied; request the vendor’s written legal or security rationale; and set a reasonable date for a response and restoration plan. Do not threaten termination unless the agreement and your authority support that step.

Escalate in a defined sequence
- Operational owner: Confirm the scope, business impact, and immediate safety controls with the system owner and the team that operates the integration.
- Procurement and vendor management: Open a supplier issue, verify the governing contract, and check whether the vendor is in breach of a service, audit, or cooperation obligation.
- Security and privacy: Assess whether the refusal concerns secrets, personal data, regional processing, or a suspected incident. Approve the redaction, clean-room, or query design.
- Legal and compliance: Interpret audit rights, cure periods, termination options, evidence holds, reporting duties, and applicable AI, privacy, sector, and records laws.
- Accountable AI-risk executive: Decide whether residual risk can be accepted, and set the deadline after which operation must change if access is not restored.
- Vendor executive escalation: Request a named remediation owner, a written rationale, the missing-artifact list, and a dated plan. Keep the communication factual and avoid disclosing unnecessary sensitive information.
Create a risk-register entry that records the risk statement, affected decisions, likelihood and impact assessment, existing controls, temporary controls, owner, due date, and acceptance authority. A support ticket alone does not show that the organization made a deliberate risk decision.
Use temporary compensating controls while access is blocked
Compensating controls reduce exposure; they do not recreate the vendor’s missing evidence. Mark each control as temporary, assign an owner, and give it an expiry or review date.
- Increase independent sampling: Review a larger or more frequent sample of production interactions, stratified by language, user group, geography, decision type, and known edge cases.
- Strengthen runtime monitoring: Track error rates, refusal rates, latency, confidence or calibration indicators where available, policy violations, distribution shifts, and human overrides.
- Require human review: Route high-impact, low-confidence, novel, or potentially harmful outputs to trained reviewers before action is taken.
- Preserve local telemetry: Retain version identifiers, input and output hashes or content where lawful, reviewer outcomes, alerts, and corrective actions.
- Prepare rollback: Keep the last approved model, prompt, configuration, and integration package deployable; test the rollback path and define who can invoke it.
- Triage incidents independently: Classify severity, contain affected workflows, notify required parties, and record whether the vendor was contacted and how it responded.
- Limit scope: Remove high-risk users, regions, features, or decision types until the evidence gap closes.
Document the assumptions behind every temporary measure. For example, a small internal sample cannot establish population-wide reliability, and extra human review may reduce harm without proving that the underlying model is stable.
Choose a go, pause, constrain, rollback, or replacement decision
Set a decision date rather than allowing an indefinite extension. The authorized risk owner should consider the decision’s impact, the severity and reversibility of potential harm, the quality of independent evidence, the effectiveness of compensating controls, and the vendor’s restoration commitment.
Continue with defined conditions
Use this only when independent monitoring is strong, the use case is within approved risk tolerance, no serious unresolved incident exists, and the vendor has a credible, dated plan to restore equivalent review. Record conditions such as sampling frequency, human-review thresholds, and a hard stop if evidence is not delivered.
Do these 3 things before closing this tab:
1Scan for outdated or missing drivers - takes under a minute2Repair Windows errors before they cause bigger problems3Fix the driver behind crashes, sound loss and screen glitchesConstrain operation
Reduce volume, remove sensitive workflows, disable autonomous actions, or require approval for every consequential output. State exactly what is out of scope and when the restriction will be reassessed.
Pause deployment
Stop new users or transactions when the missing evidence prevents a safe decision, when monitoring shows unexplained degradation, or when a serious incident cannot be investigated. Preserve the system state and user communications needed for an orderly pause.

Roll back
Return to the last approved model or configuration when a recent change may have caused the problem and a tested rollback is available. Verify data compatibility, access controls, and monitoring after the rollback.
Replace the vendor
Begin transition when refusal is persistent, contractual remedies are ineffective, independence is compromised, or the vendor cannot meet evidence, response, or regulatory requirements. Plan data return or deletion, continuity, migration testing, and evidence handover.
Quick wins for a faster PC:

State the unavailable evidence, assumptions, affected population, controls, review date, and trigger that will revoke acceptance. “The vendor would not cooperate” is not an adequate rationale by itself.
EU high-risk AI responsibilities require role-by-role analysis
For an EU high-risk AI system, involve legal or compliance early. Applicability, classification, transitional dates, and the identity of provider and deployer depend on the system and use case; a refusal alone does not establish a violation.
Article 26 of the EU AI Act assigns deployer duties that include following the provider’s instructions, ensuring human oversight, monitoring operation, keeping logs for at least six months, and communicating relevant risks or incidents to providers or authorities as applicable. If a contractor is uncooperative, those deployer responsibilities do not automatically disappear.
Article 72 requires providers of high-risk AI systems to establish and document a proportionate post-market monitoring system that actively and systematically collects, documents, and analyzes relevant performance and compliance data throughout the system’s lifetime. Contract negotiations should therefore address how the provider supplies monitoring evidence and responds to incidents, updates, and corrective actions.

How to monitor the system if the vendor cuts off testing access
Build an independent monitoring package from the telemetry and review capability you control. It should answer four questions: what changed, what failed, who was affected, and what was done.
Performance and distribution
- Track task-level accuracy or quality measures using a stable, versioned evaluation set.
- Compare input and output distributions over time and by important user or regional segments.
- Watch refusal, escalation, override, latency, and timeout rates for abrupt changes.
- Record model, prompt, policy, retrieval, tool, and configuration identifiers with each measurement.
Safety and incidents
- Classify harmful, discriminatory, privacy, security, reliability, and policy failures by severity.
- Link each incident to the affected workflow, version, date, containment action, and resolution.
- Track repeat failures and near misses, not only events that caused confirmed harm.
- Keep evidence of user complaints, appeals, corrections, and redress outcomes.
Change and emergent behavior
- Require approval records for releases, data changes, prompt changes, and integration changes.
- Run regression tests after every material change and after unexplained production drift.
- Have subject-matter experts review novel outputs and decide whether recalibration is needed.
- Document hypotheses, test results, decisions, and unresolved uncertainty.
Use a dashboard with an owner, alert thresholds, escalation paths, and retention rules. Monitoring without a response procedure only produces more records; it does not control risk.
Preserve evidence for a dispute, investigation, or transition
Maintain a complete chain of custody. Store original files separately from working copies, restrict editing, record access, and hash exports when your tooling supports it. Preserve:

Coordinate retention with privacy, employment, sector, and litigation requirements. Minimize personal data in the evidence set, but do not delete material that is subject to a hold or needed to reconstruct a safety decision.
What to demand from a replacement vendor or independent assessor
Use the refusal to improve your next procurement. Evaluate the assurance arrangement, not just the vendor’s pre-deployment test report.
| Comparison axis | What to verify |
|---|---|
| Access model | Read-only API or export, secure review room, customer-run queries, or independent on-site review |
| Coverage | Pre-deployment testing, production monitoring, incident investigation, drift, red teaming, and redress |
| Independence | Separation from the model vendor and documented conflict-of-interest controls |
| Evidence quality | Reproducible test sets, versioned reports, retained logs, and traceable findings |
| Response commitments | Incident notification, remediation deadlines, support hours, and escalation service levels |
| Data protection | Minimization, retention, regional processing, confidentiality, and deletion controls |
| Regulatory mapping | Ability to map findings to applicable laws, standards, and internal risk tolerances |
Require a sample report, an evidence-retention schedule, a change-notification process, and a documented method for handling disagreements. Make continued access to post-deployment findings a contractual deliverable, with named contacts and remedies if it fails.
Common mistakes to avoid
- Waiting for a support ticket to resolve itself: A delay can outlast the period in which logs or portal records are retained.
- Demanding unrestricted raw data first: A broad request can give the vendor a defensible privacy or security objection. Start with the minimum evidence and a protected access design.
- Accepting a polished summary: Without versions, methods, samples, exclusions, and limitations, a summary may not support an assurance decision.
- Assuming a contract right guarantees practical access: You may still need notice, confidentiality controls, an assessor, or a cure period before exercising a remedy.
- Using compensating controls without an expiry: Temporary sampling or human review can become permanent, underfunded, and unowned.
- Terminating before preserving evidence: Secure the records, transition data, and deletion instructions before access is withdrawn.
- Letting legal uncertainty stop operations work: Counsel can determine applicability while security and operations preserve evidence and reduce exposure.
A concise escalation message
Your written notice should be specific enough to start the contractual process and practical enough to invite a safe solution:
We requested post-deployment review materials for [system and version] covering [dates and scope] on [date]. Your response on [date] denied [specific artifacts] and cited [stated reason]. Please confirm the legal or security basis, the records covered, the retention period, and the remediation owner. We propose [read-only export, redacted sample, secure review room, customer-run queries, or independent assessor] under the attached confidentiality and access controls. Please provide the missing evidence or a dated restoration plan by [date]. Until resolved, we are applying [temporary controls] and will review continued operation on [date].
Keep the final version aligned with your notice provisions and have legal review it when a breach, incident, or termination may be involved.
Closing the issue
When access is restored or the relationship ends, record what was delivered, which limitations remain, whether temporary controls can be removed, and whether a contract remedy was used. Update vendor-selection requirements, incident playbooks, monitoring procedures, and risk-acceptance thresholds based on what happened. The objective is not merely to win an argument about access; it is to maintain reliable evidence and accountable control for the full life of the AI system.
