If you have just passed a stopped school bus, keep driving predictably: do not slam on the brakes, reverse, or turn suddenly in traffic. Watch for children and follow any directions from an officer or other authorized person. The United States has no single federal checklist for what to do after a pass; reporting duties, exceptions, evidence rules, and penalties depend on where it happened.
What to do immediately
- Stay predictable. Do not stop abruptly in a live lane, reverse, or make a sudden turn to get back to the bus. Those moves could create another crash risk.
- Watch for children. If the bus or children are still nearby, remain alert for pedestrians and obey traffic signals, signs, and any directions from an officer or other authorized person. Stop only where it is safe and lawful to do so.
- Respond to an emergency. If anyone may have been hit or injured, contact emergency services. This is general safety guidance; federal school-bus guidance does not establish a special post-pass emergency procedure.
- Check the local rules. For any possible reporting duty, deadline, penalty, or next step, consult the official guidance for the state or locality where the event occurred, or ask the relevant local authority.
Do not assume that making a voluntary report will prevent a citation or change the legal outcome. The applicable authority and process vary by location.
How to tell whether the bus was in an active stop
NHTSA says it is illegal in every state to pass a school bus while its red lights are flashing and its stop arm is extended. Yellow flashing lights mean the bus is preparing to stop: slow down and be ready to stop. Red flashing lights and an extended arm mean the bus has stopped for students. State rules can differ for traffic approaching from the opposite direction, particularly on divided or multi-lane roads. The legal definition of a divided highway can also vary, so do not assume that a road’s appearance alone establishes an exception. NHTSA’s overview of illegal school-bus passing

Why you need location-specific guidance
There is no universal post-incident reporting process established by the national guidance. States and localities differ in who can report a violation, what evidence may be used, who can initiate enforcement, and whether roadway conditions create an exception. The exact penalty, any reporting duty or deadline, and appeal options must be checked with official sources for the place where the event happened.
For example, Pennsylvania says motorists following or traveling alongside a bus should remain stopped until its red lights stop flashing, the stop arm is withdrawn, and children have reached safety. Pennsylvania’s Operation Safe Stop guidance Wisconsin says drivers must stop at least 20 feet from a bus flashing red warning lights and cautions that the absence of an extended stop arm alone is not a reason to pass while the red lights are flashing. What to check with the relevant authority
Use the state DMV, state transportation agency, or local law enforcement agency for the jurisdiction where the pass occurred. Check official guidance for these points:
- Whether the road layout or direction of travel creates an exception for opposing traffic.
- Which agency accepts reports and whether any reporting deadline applies.
- What evidence or witness information is required and who may submit it.
- The applicable penalty and any process for contesting an enforcement action.
A national statistic underscores that illegal passing is a widespread safety concern, but it cannot predict an individual case: NHTSA reported more than 43.5 million illegal school-bus passing events in the United States during the 2022–2023 school year, based on the 2023 NASDPTS survey of school-bus drivers.
