Yes, in some places—but the route depends on where you drive. Federal labor law generally excludes independent contractors from its employee union protections. California and Massachusetts have created separate bargaining frameworks for rideshare drivers, and each has certified a representative for units that include Lyft drivers. Certification lets a representative bargain for the covered unit; it does not mean every driver personally joined a union or that a contract is already in place.
Why the answer depends on location
Section 7 of the National Labor Relations Act (NLRA) gives covered employees the right to organize, join or assist labor organizations, bargain through chosen representatives, and engage in concerted activity for mutual aid or protection. But the Act excludes independent contractors from its definition of employee. The National Labor Relations Board (NLRB) likewise lists independent contractors as outside the employee protections it administers. That is the federal baseline, not a nationwide ban on driver organization. States can establish distinct systems, as California and Massachusetts have done. Whether a driver can participate in a particular bargaining process depends on the law and coverage in the state where they work.
California: a bargaining framework with a certified representative
California’s AB 1340 created the Transportation Network Company Drivers Labor Relations Act (TNC Act), effective January 1, 2026. The Act gives covered TNC drivers the right to form, join, and participate in driver organizations, bargain collectively through an organization, or refrain from those activities. The Public Employment Relations Board (PERB) administers certification, representation, and bargaining procedures. See PERB’s TNC Act rulemaking information and its TNC Act page.

On September 9, 2026, PERB certified the California Gig Workers Union (CGWU) as bargaining representative for a statewide unit of drivers of covered TNCs. PERB currently identifies Lyft and Uber as covered companies. CGWU may represent drivers in that unit and bargain with covered TNCs over terms and conditions of work. The certification does not make drivers employees under the NLRA, and it does not establish that every driver affirmatively joined CGWU. See PERB’s certification announcement.
Massachusetts: an industry-wide bargaining unit
Massachusetts Chapter 150F provides a separate unionization process for transportation network drivers. On May 22, 2026, the Department of Labor Relations certified App Drivers Union, SEIU 32BJ/IAM as the exclusive bargaining representative for an industry-wide unit. The certification names Lyft, Uber, Via, SilverRide, and UZURV among the covered companies. The state guidance says Chapter 150F does not require rideshare drivers to pay union dues, either before or after a union is certified. This is a rule of the Massachusetts framework, not a general statement about dues in every state or under every labor law.

These laws allow covered drivers to bargain through state-created frameworks even though the federal NLRA generally does not cover independent contractors. A representative’s certification concerns the bargaining unit; it is not proof that each driver chose to join the organization.

What federal union procedures do—and do not—tell you
For employees covered by the NLRA, the NLRB says that when at least 30% of workers sign cards or a petition showing support for a union, it will conduct an election. That threshold describes the federal employee process only; it should not be treated as the procedure for California’s TNC Act or Massachusetts Chapter 150F. The state certifications had their own support showings: PERB certified CGWU after a showing of at least 30% support, while Massachusetts’ certification followed verification of at least 25% support. Those figures describe the basis for the respective certifications, not the share of drivers who joined, a dues obligation, or the outcome of bargaining.

What to check if you drive for Lyft
- Identify where you drive. Use the state where you perform the rideshare work, because the applicable framework and agency are state-specific.
- Clarify what you mean by “join.” Joining a driver organization, being represented in collective bargaining, paying dues, and having a contract are different questions.
- Check the relevant labor agency’s current coverage and procedures. The California PERB and Massachusetts DLR pages linked above describe those states’ systems. The information here does not survey every state or determine an individual driver’s legal status.
- Do not infer a contract or personal membership from certification. Certification identifies a representative for a bargaining unit; it does not by itself establish the terms of a final agreement or that every covered driver personally joined.
For an individual driver, a useful precise question is: “In the state where I drive, can I join a driver organization, be represented in bargaining, or owe dues under the current rules?”
