Apple and OpenAI-related defendants are disputing what evidence and arguments should be considered at a reported October 14, 2026 hearing on Apple’s request for a preliminary injunction. Apple says the defendants’ objections to its expert evidence go beyond procedural challenges and introduce new arguments and evidence; the defendants have objected to evidence they characterize as new. No ruling resolving that dispute or the underlying trade-secret claims is established in the reporting reviewed.
What is the October 14 hearing about?
Current reporting says the U.S. District Court for the Northern District of California is scheduled to hear Apple’s motion for a preliminary injunction on October 14, 2026. Apple is seeking interim relief addressing the use or disclosure of information it alleges is trade-secret material while the lawsuit proceeds. The hearing date and purpose are reported details, not independently confirmed here against a current court calendar; the available docket mirror was last retrieved September 4, 2026. Justia’s docket mirror should not be treated as confirmation of later scheduling updates.
A request for an injunction is not a finding that misconduct occurred. The judge may consider the parties’ arguments about interim relief without deciding the full merits of Apple’s allegations.

What are the parties disputing about the evidence?
The immediate disagreement arose during briefing on Apple’s injunction request. Apple filed a reply that included expert declarations. Defendants objected to what they described as new evidence in that reply. In a response dated October 5, Apple argued that the defendants’ objections themselves went beyond challenging new evidence and added arguments and evidence of their own. 9to5Mac reported the exchange; APPDOOK also reported on Apple’s response and the hearing.

Apple alleges that former employees accessed or took confidential information and that it was used in OpenAI hardware work. The Associated Press reported that OpenAI, when the lawsuit was filed, denied interest in other companies’ trade secrets. These are allegations and a response, not findings by the court. The AP’s account quotes Apple’s complaint as describing the case as involving former employees “stealing Apple’s trade secrets for the benefit of OpenAI”; that is Apple’s characterization, not an established fact. - Known: Apple filed a trade-secret and breach-of-contract lawsuit on July 10, 2026, and seeks preliminary relief.
- Reported, but not confirmed by a current primary calendar here: The injunction hearing is set for October 14, 2026.
- Contested: Whether Apple’s reply introduced improper new evidence, and whether defendants’ objections added new arguments or evidence.
- Not established: That trade secrets were stolen, that OpenAI directed theft, or that the judge has accepted or excluded the disputed material.
The next meaningful development is a court decision on the injunction request or a procedural order addressing the disputed submissions. Until then, distinguish what a party alleges from what the court has ruled.
