Sometimes—but there is no worldwide yes-or-no rule. Whether you can own, sell, collect, or export a dinosaur fossil depends on where it was found, who owned the land, how it was collected, its legal classification, and where it is going. In the United States, federal rules prohibit casual collection of dinosaur fossils on covered federal lands and restrict trade in fossils known or reasonably expected to have been unlawfully removed. China’s rules provide a different example: they claim state ownership of fossils in its territory and regulate sales and exports. A fossil’s presence in a private collection or an online listing does not establish that its history is lawful.

What determines whether a dinosaur fossil is legal to own?

Separate four questions that are often treated as one: Was the fossil legally collected? Who owns it now? Can it be sold or transferred? Can it cross a border? The answers can differ. A lawful sale does not necessarily establish that a prior collection was lawful, and permission to possess a specimen does not automatically authorize export.

For a specific fossil, start with its country and locality of origin, the land’s status when it was collected, the collection date and method, prior permits or ownership records, and the destination country. The relevant rules may involve federal, state or local, tribal, private-property, export, and import law. The examples below illustrate particular frameworks; they do not settle every jurisdiction or specimen.

Can you collect dinosaur fossils on U.S. federal land?

The Paleontological Resources Preservation Act generally requires a permit to collect paleontological resources from federal land. Its limited casual-collection exception applies only on qualifying lands managed by the Bureau of Land Management, Bureau of Reclamation, and Forest Service, and remains subject to other applicable land rules. The statute states: “Except as provided in this chapter, a paleontological resource may not be collected from Federal land without a permit issued under this chapter by the Secretary.” 16 U.S.C. § 470aaa-3.

The casual-collection exception does not include dinosaur fossils

BLM guidance permits reasonable amounts of common invertebrate and plant fossils for personal use where local rules allow. It says fossils with skeletal structure—including dinosaur, reptile, fish, bird, and mammal remains—and dinosaur track castings cannot be collected casually. Special-area designations, posted restrictions, or local rules may be more restrictive, so check with the land-managing office before collecting. BLM permits and fees guidance and BLM: What is paleontology?

A permit does not make the fossil private property

Fossils collected under a federal permit remain U.S. property; the permit is not a transfer of ownership. The statute also requires permitted resources to be deposited in an approved repository under the applicable terms. 16 U.S.C. § 470aaa-6.

Can you sell a dinosaur fossil in the United States?

Federal law prohibits selling or buying—or offering to do so—a paleontological resource if the person knew or should have known it was excavated, removed, sold, purchased, exchanged, transported, or received from federal land in violation of applicable law. It also restricts certain exchanges, transport, exports, and receipt of resources known or reasonably expected to have been unlawfully removed from federal land. The rule is tied to unlawful federal-land provenance; it does not, by itself, resolve every private-land transaction or state-law question. 16 U.S.C. § 470aaa-5.

That knowledge standard makes documentation important for both buyers and sellers. Useful records can include the find location and land status, landowner consent, collection permits, collection and ownership history, receipts, and any applicable export paperwork. A seller’s assurance or a sales listing alone does not establish lawful provenance.

How do China’s rules treat fossil ownership, sales, and export?

China’s Regulation on the Protection of Paleontological Fossils, revised March 2, 2019, states that fossils within China’s territory and jurisdictional waters belong to the state. It distinguishes fossils by protection classification, so a single blanket rule about whether “fossils are legal” would be misleading. China’s Regulation on the Protection of Paleontological Fossils.

Sales and transfers depend on classification

The regulation prohibits sales of key-protected fossils except for specified transfers between collecting institutions. Sales of ordinary-protection fossils are to take place at venues designated under local rules. It also restricts transferring, exchanging, gifting, or pledging key-protected fossils to foreign persons or organizations. A specimen’s category and the parties involved therefore matter to any proposed transaction.

Export requires approval, and some fossils cannot leave

Unnamed fossils may not be exported. Export of key-protected fossils requires approval from the competent national authority and is framed around scientific cooperation or exhibitions; ordinary-protection fossils also require approval from the relevant provincial-level authority. The process calls for an inventory and photographs, and customs must receive the approval document. These are source-country requirements; the destination country’s import rules may impose additional conditions.

What does Brazil require for research-related fossil collection?

Brazil’s National Mining Agency (ANM) says researchers linked to educational or research institutions who seek to collect fossils for scientific, technical, or educational projects, as well as those undertaking paleontological salvage, need ANM authorization through its service. That describes an authorization process for those activities; it does not establish ownership or commercial-sale rules for every fossil. ANM fossil-collection information.

What to check before buying, selling, or shipping a fossil

  1. Establish origin: Identify the country and locality where the fossil was found, not just its current location.
  2. Determine land status: Establish whether the site was federal, state or local public, tribal, or private land when collection occurred.
  3. Document collection authority: Request relevant permits, landowner consent, or other records showing how the fossil was collected.
  4. Trace ownership and classification: Review transfer records and determine whether the specimen is subject to a protected category or institutional restrictions.
  5. Check the transaction rules: Confirm that sale, transfer, or possession is allowed under the laws governing the specimen and the parties.
  6. Check both sides of a border crossing: Verify source-country export approval and destination-country import requirements before shipment; retain required declarations and documents.

For an actual transaction, confirm current rules with the responsible land agency or relevant authorities in both countries. A jurisdictional overview cannot determine the status of an individual specimen without its provenance and records.
