Before work begins, get a written contract that records the agreed work, costs, timing, and promises made in conversation. When an instruction or proposed change could affect the work, materials, price, or schedule, send a dated written recap and ask the contractor to confirm it. Keep that response with your contract and project records. This is practical U.S. consumer guidance, not a universal legal formula: contract requirements vary by state.
Set a clear written baseline before work starts
A written contract gives both sides a reference point if memories differ later. The Federal Trade Commission recommends asking for a written agreement even if state law does not require one, and says the agreement should include promises made in conversation that relate to the work and labor or material costs. The FTC’s home-improvement guidance also recommends reading the contract carefully before signing.
- Check the contractor’s license with the relevant state or county authority and ask for proof of insurance.
- Get a written estimate describing the work, materials, completion date, price, and contractor contact details. The FTC recommends getting multiple estimates and asking about large price differences.
- Review the final contract for the scope of work, start and estimated completion dates, costs, and promises made in earlier conversations. Fill in blank spaces before signing.
- Keep a copy of the signed contract and attachments somewhere you can find them throughout the project.
Down-payment limits and cancellation requirements can vary by state. The FTC notes that some consumers may have a three-business-day cancellation right when they sign at home or another location away from the seller’s permanent place of business, subject to conditions and exceptions. Check the FTC guidance and your state or local consumer agency rather than assuming that right applies to every contractor transaction.
How do I document a contractor’s verbal instructions?
Write down what was said while the details are fresh, then send a calm recap by email, letter, or another written channel you already use with the contractor. Identify the speaker, the affected work, and any possible effect on price or timing. Ask the contractor to correct anything you misunderstood and to confirm the details.

- Note the date, time, location or communication channel, who spoke, and who else was present.
- Describe the instruction in plain language and identify the work area or contract item it affects.
- Send a dated written recap soon after the conversation. Ask the contractor to confirm the instruction and any effect on price or schedule.
- Save your sent message, the response, and any attachments with the contract.
If the contractor does not respond, follow up and check the contract’s notice process. Do not treat silence as proof that the contractor accepted a change. A text, email, letter, or oral exchange may have different legal significance depending on the contract and applicable law; this practical recordkeeping approach does not establish a universal legal rule.
Should I get a change order in writing?
For a change that could affect scope, price, materials, or timing, request a written record and confirmation before the contractor proceeds when practical. Follow the contract’s change and notice terms, along with applicable local requirements. This is a prudent way to reduce misunderstandings, not a claim that every state requires the same form or signature process.

New Jersey illustrates why location matters: for covered home-improvement contracts over $500, changes to the contract terms must be in writing and signed by all parties under N.J. Admin. Code § 13:45A-16.2. That is a New Jersey rule, not a nationwide threshold. Check your own state’s requirements.
What should a contractor change order include?
Use a dated record for each material change, and make it specific enough that someone reviewing it later can tell what changed and what the parties confirmed. Include:

- Project address and original contract date.
- A change number or another clear identifier, the date proposed, and the person requesting it.
- The original work affected and the work being added, removed, or revised.
- Any changed material, fixture, or product specifications.
- The price increase or decrease, or a clear note that the price remains to be determined and how it will be set.
- Any revised milestone or completion date.
- Whether work should wait for approval, consistent with the contract.
- Dated confirmation from the parties and copies of any supporting estimate or drawing.
These details are a clarity checklist, not a nationally mandated change-order template. If the contractor’s proposed record leaves a key item unresolved, ask for clarification rather than assuming the original agreement or a later conversation answers it.

- Invoices, receipts, warranties, work orders, and payment records.
- Relevant permits and inspection records.
- Dated notes about conversations, instructions, and site events.
- Photos and all relevant contractor emails or texts.
USAGov lists receipts, warranties, contracts, work orders, email messages, and records of contact among the documents a consumer may gather before making a complaint. Its complaint guidance explains how to prepare, while USAGov’s state consumer protection office directory helps locate state-level assistance. Back up digital records and retain originals of important signed documents. A binder, logbook, change-order pad, email folder, or spreadsheet can help organize records; none is itself a legal requirement. No universal retention period for every contractor record is established here, so keep documents needed for warranties, tax matters, unresolved disputes, and applicable limitation periods, and check local guidance where necessary.

Try to resolve the issue with the contractor first. After a phone conversation, follow up in writing so the discussion and any proposed next steps are recorded. If the problem remains unresolved, the FTC advises sending a letter by certified mail and requesting a return receipt; keep a copy. Its guidance on solving problems with a business recommends keeping notes, letters, and copies of relevant records.

Preserve the contract, changes, messages, receipts, and a brief chronology of events. Use USAGov’s complaint guidance and state consumer office directory if you need to identify a complaint route. Organized, timely records can make it easier to explain what was agreed, what changed, and what happened afterward; they do not guarantee a refund, legal protection, or a particular outcome. The significance of the record depends on the facts, contract, and applicable law.
